From the supplier: All the justices on the US Supreme Court agreed that Michael Buckley could not obtain damages for emotional distress from Metro-North Commuter Railroad because he was exposed to asbestos but has not developed asbestosis symptoms. Liability insurance companies were relieved by the decision because numerous cases involving everything from the fear of electromagnetic fields to repetitive stress could have entered the legal arena. Metro-North was also not forced to provide Michael Buckley with free tests to determine if he will ever develop an asbestos-related illness.
