power to fill up vacancies that may happen during the recess of the senate.

Whether the president can create an office and fill it during the recess of

VACANT POSSESSION, estates. An estate which has been abandoned by the

tenant; the abandonment must be complete in order to make the possession

vacant, and therefore if the tenant have goods on the premises, it will not

be so considered. 2 Chit. Rep. 17 7; 2 Str. 1064; Bull. N. P. 97; Comyn on

Landl. & Ten. 507, 517.

VACANT SUCCESSION. An inheritance for which the heirs are unknown.

VACANTIA, BONA, civil law. Goods without an owner. Such goods escheat.

TO VACATE. To annul, to render an act void; as to vacate an entry which has

been made on a record when the court has been imposed upon by fraud, or

taken by surprise.

VACATION. That period of time between the end of one term and beginning of

another. During vacation, rules and orders are made in such cases as are

urgent, by a judge at his chambers.

VACCARIA, old Eng. law. A word which is derived from vacca, a cow, and

signifies a dairy-house. Co. Litt. 5 b.

VADIUM, contracts. A pledge, or surety.

the sheriff to compel the appearance of a jury in the cause between the

parties. It answers the same purpose in that court as the Distringas

HABEAS CORPUS, remedies A writ of habeas corpus is an order in writing,

signed by the judge who grants the same, and sealed with the seal of the

court of he is a judge, issued in the name of the sovereign power where it

is granted, by such a court or a judge thereof, having lawful authority to

issue the same, directed to any one having a person in his custody or under

his restraint, commanding him to produce, such person at a certain time and

place, and to state the reasons why he is held in custody, or under

restraint.

2. This writ was it common law considered as a remedy to remove the

illegal restraint on a freeman. But anterior to the 31 Charles II. its

benefit was, in a great degree, eluded by time-serving judges, who awarded

it only in term time, and who assumed a discretionary power of awarding or

refusing it. 3 Bulstr. 23. Three or four years before that statute was

passed there had been two very great cases much agitated in Westminster

Hall, upon writs of habeas corpus for private custody, viz: the cases of

Lord Lei-ah: 2 Lev; 128; and Sir Robert Viner, Lord Mayor.of London. 3

Keble, 434, 447, 470, 504; 2 Lev. 128; Freem. 389. But the court has wisely

drew the line of distinction between civil constitutional liberty, as

opposed to the power of the crown, and liberty as opposed to the violence

JEOFAILE. This is a law French phrase, which signifies, "I am in an error; I

have failed." There are certain statutes called statutes of amendment and

jeofails because, where a pleader perceives any slip in the form of his

proceedings, and acknowledges the error, (jeofaile,) he is at liberty by

those statutes to amend it. The amendment, however, is seldom made, but the

benefit is attained by the court's overlooking the exception. 3 Bl. Com.

JEOPARDY. Peril, danger. 2. This is the meaning attached to this word used

in the act establishing and regulating the post office department. The words

time, the offender shall wound the person having the custody thereof, or put

his life in jeopardy by the use of dangerous weapons, such offender shall

OATH. A declaration made according to law, before a competent tribunal or

officer, to tell the truth; or it is the act of one who, when lawfully

2. It is proper to distinguish two things in oaths; 1. The invocation

by which the God of truth, who knows all things, is taken to witness. 2. The

imprecation by which he is asked as a just and all-powerful being, to punish

3. The commencement of an oath is made by the party taking hold of the

book, after being required by the officer to do so, and ends generally with

the words,"so help you God," and kissing the book, when the form used is

4. Oaths are taken in various forms; the most usual is upon the Gospel

by taking the book in the hand; the words commonly used are, "You do swear

that," &c. "so help you God," and then kissing the book. The origin of this

oath may be traced to the Roman law, Nov. 8, tit. 3; Nov. 74, cap. 5; Nov.

124, cap. 1; and the kissing the book is said to be an imitation of the

priest's kissing the ritual as a sign of reverence, before he reads it to

that heroic struggle of revolutionary days, but the bourgeois
historians have failed to recognize the great part those heroes
played in the battles for freedom, and have showered praise
where it did not belong.

And there are just as many patriots — real patriots — in
proportion to the population, here today as there were in those
revolutionary days. And these revolutionists will arise in the
near future — will go to the ballot box — and overthrow a com-
bination of capitalist rulers who are more arrogant and more
oppressive today than King George III ever dared to be.
And the result of this revolution will be decisive and sure,
for the working class cannot longer be deprived of its own.

longs to us, and it belongs to us because it is right that it

She comes off as saying that Reagan was a good president, rather than the unmitigated disaster that set us on the road to ruin.

Although I have admired Arianna Huffington for years, I was initially apprehensive about reading RIGHT IS WRONG in this year of 2010, since when it was published in 2008 we had the Bush Administration still in power, and this book frequently bashes George W. Bush, as well as other members of the right. I wasn't sure I wanted to hear all that over again, as now we have a promising new start with the Obama Administration. (Perhaps check out the new book The Promise: President Obama, Year One by Jonathan Alter.) However, once I got into this book I quickly realized what a GEM it is! So many terrific and cogent arguments here, including many details and perspectives that I did not know or had not thought of. Although there are some subjects dealt with here in which the situation has changed substantially since 2007-2008, such as the Iraq War, most subjects are essentially the same situation now, including global warming, health care reform, immigration, energy, and so on. Also, I like having a book to turn to for support when someone does not fully appreciate the absurdity of right-wing zealots in this country. I can just show them some sections in Arianna's book and say, "Here, read THIS and see what I mean!!" I especially admired the chapter condemning the Bush Administration's promotion of the torture of prisoners, which to me is one of the most shameful episodes in the history of the United States. Also, RIGHT IS WRONG is a real breeze to read and enjoy, because it covers a multitude of subjects and is also very funny. I don't know HOW she comes up with so many witty zingers! Also, if you're a thinking person, check out Arianna's web site, The Huffington Post!!

There is nothing new about this book.It is not worth the paper that it is printed on.Rather than pass it on, I threw it in the trash and feel bad that I spend MY HARD EARNED money on the book.
I think arianna would be good at writing novels since this actually is one.
No matter which side she's on at the moment she is dead wrong about too many things.The only thing I can really agree with, is that the Constitution of the United States is being trampled by both sides.I think it is time for all the Arianna's to stay home and raise a kid, rather than aborting them so they can have time to write such a silly worthless book.

I question everything I read and this may be one of the most difficult and useless books I have ever read.Here's why:
1. The sentence structure is all over the place and reminds me of an angry person spoutting off in an email.
2. Citations are not easily cross referenced.
3. Facts are either incorrect or not referenced.Sometimes both.
4. There isn't a logical argument as to why her proposed solutions are better than others.Simply put, Arianna states that her conclusions are the only answer and any arguement against them isn't even worth the time of day.
If your are looking for a good Liberal vs. Conservative book, please don't waste your time with this book. ... Read more

For the benefit of all those unfortunates who grew up without the benefit of Yiddish speaking grandparents, the word "chutzpah" means brazen effrontery.The classic example is a man who kills his parents and pleads for mercy on the grounds that he's an orphan.

It's chutzpah, pure and simple, for right-wingers to complain about violations of our constitutional rights by the Omama administration.During the Bush administration our Habeas Corpus and Sixth Amendment rights were effectively abrogated.When the President declared somebody to be an enemy combatant the individual so described was held indefinitely, with no judicial ruling on the legality of the detention and with the right of the accused to have a fair trial denied.

While this was going on, the right wing of our political spectrum stayed silent or actively supported the administration.For them to now discover the Constitution because poor people will get access to medical care or for other programs they dislike is the essence of hypocrisy.The legality of the Affordable Care Act and of other administration actions will be decided by the courts, as they should be.If the legal system says the administration is acting legally, then it's acting legally.

As far as this ebook goes, it's good, though overpriced.The Table of Contents is active, the search function works as it should, and the text is easily readable even for somebody with my 74 year old eyes.
I recommend it to everybody.

Finally proof of the anointed ones mistakes as president (no not W). Two months in and already bowing to kings. This compilation is excellent and everyone should read it until it is burned in their brains. All real Patriots know how the 2009 "New New Deal" is ripping our rights away; read this and remember that we are here as a country because of the blood spilled for the documents inside. No better read out there.

Get it while you can, before it's gone. Our precious U.S. Constitution is being dismantled as we speak. The Bush/Cheney administration has done untold damage to this precious document our Founding Fathers fought so hard to shape and place in the world.

If you really consider yourself an American, and certainly if you think you are a patriot, buy it and read it. Every word. Then read the Patriot Act; put the FISA bill side by side with the Fourth Amendment. Start digging into the history of the last, oh, eight years or so and ask yourself: "What ya gonna do when they come for you?"

I've alway's been interested in the Constitution, but because of the language I've always looked for an easier way tobetter understand it. Some of the words that were used by our Founding Fathers, can be just a little intimidating. As much as I hate to admit it, the U.S. Constitution for Dummies, makes it a breeze. I love it.

I thought that because this is a , "Dummies" Book, it would be easy tofollow. I found it to scattered...having each ammendment explained in one block would've been much easier to follow than having every thing chopped up...

This is a no-nonsense book. It is clearly written for everyone to understand, and all the topics are on the money!!! There are no philosophical tangents that lead to outragiously foolish and hazardous conclusions. The author (Michael Arnheim) knows his Constitutional history and presents it in a well writren prose for everyone to understand and (more importantly)to enjoy!!!

This is an excellent book for someone who has not had any schooling in the Constitution. I am just an average working man with a high school/tech school education but I do care about the direction our country is headed. This book explains the Constitution and many aspects of how government should operate so that even I can understand it. It is a big help to me to let me know if our elected officials are operating within the Constitution

The author does give his opinion on many of the controversial issues of the past and present but he makes it clear that it is his opinion only. He also gives the possible reasoning behind opposing viewpoints and actions in which he disagrees. It is not simply an ideological one sided book but something anyone could learn a lot from regardless of your political views.

The book does not go to great depth but I don't think you could expect that from a "Dummies" book. Overall, a great book for beginners.

As an earlier reviewer pointed out, these documents have been "formatted" for the Kindle with literally no thought or care whatsoever. The text arrangement is shoddy and very distracting, and with no active table of contents, getting to a specific portion of any of these great founding documents is a tiresome chore.

Do note that this one star review is solely for the Kindle version of these documents, and not for the principles and values held within any of them which I would rate five stars many times over.

Review the Constitution of the United States, I shall not. Yet, for me to read the Constitution is to see in fleeting review the fruits of abundance I so freely pick from the tree so firmly rooted by our founding fathers. Though many may argue about the twigs broken or the limbs grafted, time still ripens the wisdom of evolving the Articles of Confederation into a strong Constitution to "secure the blessings of Liberty to ourselves and our Posterity."

The freedom available to instantly download this document into my pocket is to indeed "Kindle" a sense of wonder in the heart of this citizen now senior.

This is a classic work by one of the most noted constitutional scholars of the early 20th century.Unfortunately, there is nothing in the Amazon information to indicate that the book was actually published in 1919.(My first clue was the passage saying that something that happened in 1805 or thereabouts was "a hundred years" ago.)The book sounds amazingly modern and it's remarkable that much of the discussion about separation of powers and the history of the Constitution seems so contemporary.Of course, the Rehnquist and Roberts Courts have radically changed the interpretation of the Constitution's stance on "state sovereignty," so the portions on Marshall's great later opinions on states and the Constitution do seem different from current understandings.Very interesting to read the views of a major scholar from nearly 100 years ago on the events of the early Republic.

Rather than inevitable allies, black churches and political activists have been uneasy and contentious partners.

From the 1920s on, some of the best African American minds—W. E. B. Du Bois, Carter G. Woodson, Benjamin Mays, Nannie Helen Burroughs, Mary McLeod Bethune, Charles S. Johnson, and others—argued tirelessly about the churches’ responsibility in the quest for racial justice. Could they be a liberal force, or would they be a constraint on progress? There was no single, unified black church but rather many churches marked by enormous intellectual, theological, and political differences and independence. Yet, confronted by racial discrimination and poverty, churches were called upon again and again to come together as savior institutions for black communities.

In Your Spirits Walk Beside Us, Professor Savage sets out to discuss the important history of theorizing about the practice of religion in black America while being attentive to critical thinkers and activists in black history whose rhetoric concerned the link between black social progress and the role of religious institutions.Never generalizing about the arguably ambivalent role afforded to black political movements by individual and collective religious institutions within the US, Savage nevertheless makes sure to highlight the neglected roles of intelligent black women in American religious history whose stories are lost when we acknowledge that they were not afforded the usual positions of authority occupied by black men as religious and political leaders.In addition, Savage paints a realistic and refreshing image of diverse thought within African American religion, illuminating not only the reality of diverse religious traditions but also diversity of opinion and theology within black Protestantism--attitudes about (the existence of) God, about non-Christians (namely, the forgotten black Christian fascination with Gandhi), about white religions, and about the efficacy of black pastors and churches in struggles for social equality.

As ultimately revealed in the final chapter, Savage's construction of a black pantheon of sorts for meaningful, critical intellectual thought about black religion in the US serves to provide the reader a better sense of how to locate modern black leaders in a larger historical debate about the relationship between religion, race, and politics with a focus on two such men, then-presidential candidate Barack Obama and Rev. But the author's best work remains her ability to make sure that any modern discussion about religion, race, and politics is sensitive to the history of gendered divisions within black social history.Perhaps a more robust discussion of the political divides between black women in religious institutions would complicate Savage's important response to the minimization of black women in African American history and religion, but I believe it would have helped to further illuminate reasons for why such progress in black history was made only by a minority within a minority, one composed of a majority of women. ... Page 53, in large, all caps, bold type, the title page for the "Declaration of Independence", SOHO Books demonstrated they cannot spell independence. An inexcusable error in this book. Of course it is five stars for content but the misspelling made it 4 stars for me - especially when it was spelled correctly numerous times throughout the book. This must have been done by a human, not a spellchecker, as there is no such word as "independance" the spelling used by SOHO Books.
