"This book addresses a variety of issues related to planning for a child with a disability, including special needs trusts, guardianships, government benefits programs, and taxes.It focuses on the importance of developing a comprehensive life plan for the child and is written on a level that is fairly easy to understand.Because this book was published in 1995, information gathered from it may need to be updated according to more recent changes in the law."
I deducted one star for the publication date (1995), but the overall info is invaluable for someone facing this situation.

I just wanted to share this book with those who may be interested.It is so detailed - I have never seen so much information in one place in my entire life about future planning for a child with a disability.The first section just blew me away - the second and third - same thing.I look forward to finishing the remaining 400 pages of this whopper of a book (which is 642 pages in length).This book has already answered every single question that I've ever had about the future, in regards to my son, who has Autism.I would venture to say that the education that I have received in the first 240 pages makes it worth every single penny - and then some.Everything from the differences in housing options to caregiver options to community living to managing finances to specifying your child's joys so that they may continue after your death (even down to writing a letter of intent which specifies that your child likes to bowl or go to the movies!).Over and over again I've seen the authors stress how important it is to GET INPUT FROM THE PERSON WITH THE DISABILITY and to TELL THE PEOPLE WHO YOU EXPECT TO CARE FOR YOUR CHILD about your decisions, which involve them.Readers are prodded to write a "letter of intent" and to revise it each year so that it's always current and changes with the needs of your child.The book is expensive but if you're looking into this topic, I would highly recommend making this purchase before consulting an attorney or hiring someone blindly.Please note that this is not my "formal" review but is my way of sharing this book NOW instead of waiting until I'm completely finished.

Dukeminier's text is among the better I've bought for class; the cases are interesting, the commentary & after-case notes are clear and often illustrate interesting departures from the majority rule.This is one of the few I won't resell.

This is a great textbook.It nicely balances foundational materials with the cases.The layout of the book makes for an easy outline.The rules are clear and thoroughly laid out in each section - I barely needed the supplements I bought.

I looked at someone's outline based on the last version of the text and there were a lot of cases that were missing and UPC sections that were incorrect.I did not compare books side by side but my prof. focused a lot on the things that have recently changed so the old version of the text would not have been that helpful for our class.

This book is a good book, but the update is not needed.My friend next to me in class has the seventh edition of this text and comparing the eighth edition to the previous it is obvious that the publisher is just going after more money.So few pages have been updated, so few cases have been added, they could have easily issued a paperback supplement to the seventh edition and saved students money.Putting my objections to how the textbook industry operates aside, this book is a decent read.The authors do a good job of explaining the law and the cases are edited fairly well.I'm in my third year of law school and have had several different texts by now.I would place this one on the better end.The text itself - 7 of 10.Was it a necessary update - 0 of 10. ... This book is helpful in one way only - making the job of being an executor appear so frightful that no one in their right mind would ever accept it. Not the combined imaginations of Dickens (Bleak House) and Kafka (The Trial) could paint a picture as awful as these two authors (both lawyers - surprise!); the courts,lawyers, beneficiaries, and the IRS all wait like vultures for the executor to make any one of thousands of possible mistakes.I don't know how many times the authors write of the "personal liability" awaiting the executor if this or that is or is not done in a timely manner, yet with all due deliberation.The book may,in fact, be a good one; it may take the reader like Virgil takes Dante into the bowels of a new and terrible hell.Indeed, the book's main thesis may well be "abandon hope, ye who enter here."

I will probably be asked in the next few yearsto be an executor, but, asis mentioned in this book's introduction, "You know generally that anexecutor is someone who handles the affairs of a deceased person, but youhave no idea how to get the job done." After reading this book, youknow that the first thing to do after the funeral is to hire an estateattorney to tell youwhat must be done. The book also mentions that itmight be possible to totally avoid probate, which could greatly simplifythings and save money.This book stresses that there is no need to tryto be a do-it-yourself executor. You're definitely going to consult with alawyer to see what the current estate laws are in your area, and you mightneed to also hire other professionals, but these people should all remainhired hands; the executor must stay in command.I didn't expect thisbook to give the estate-law quirks for all fifty states; you might findthat some of what it says doesn't apply in your state. It's still a verygood introduction to being an executor, and it let me know that an executordoesn't have to be totally helpless in legal land. That in itself is worththe book's cost!

I have read six different books concerning wills, probate, and trusts in the past few months.Of the books that I have read, this is clearly the best.All of the standard stuff is here - except the constant reminders bythe authors to hire an attorney.Unlike nearly all the other books, theauthors do not talk-down to readers.The language was never toosimple-minded and only in a few cases did I have to read a paragraph againto determine its meaning.The authors give hints and insights which I didnot find in the other books.And the book contains the best explanation Ihave read concerning why trying to determine and report the lowest possiblevalue of estate assets is not always the best idea.I do not plan to diefor several years.If I could give to my future executor only one book,this would be it.I miss only estate/probate information about each state. Therefore, I am still confused about the interrelationship between stateestate reporting and taxes and federal ones.Essentially, everythingdepends on the value of the taxable estate.If 20% of the readers of thisbook do so in anticipation of a death, my bet is that only 1% of those willhave a taxable estate over $1 million.And those people not having amillion-dollar estate (after 2006) will not need to pay federal estatetaxes - thereby eliminating the need for most of the book.First-timeexecutors reading the book because of immediate need and suspecting ataxable estate value more than $675,000 will be able to afford to hire alawyer to do the (subjectively) most difficult parts of the job. ... The columns are interesting in themselves, but are much more searchable with an index and grouping by subject, starting from planning early in life, then progressing through changing needds at marraige, parenthood, retirment, and estate settlement.This is a great guide for learning about transfer of wealth and how the government is a party to it.The quotations at the beginning of some topics are a nice opeing statement to get you thinking philosophically about a subject, or just to give you a chuckle while reading an otherwise dry subject.

If you just came back from your lawyer and are having trouble understanding the difference between a living trust and a living will, this is the book for you! My dad used to tell me that you don't really understand something unless you can explain it to someone else.Patti can explain complex concepts like charitable trusts, remainder interests, and applicable exclusion amounts so that anyone can understand them.I particularly enjoyed the section on Estate Planning for the Family Business which included helpful discussions of how to plan for the business after the owner's retirement.

This book,excepting 2-3 paragraphs of little value, could be entitled Estate Planning in...West Virginia, South Dakota or any other state. Florida has some unique procedures and ramifications for domiciling which are basic to financial and estate planning, which are conspicuous in this book because of their absence. I had not intended to purchase a generic primer covering various forms and documents known to all mankind. Perhaps my expectations were falsely elevated by those recommending it.

With family members who married last year, I was looking give these newcouples a good, solid reference pertaining to WILLS and ESTATES (e.g., Wills, Trusts, Living Trusts, Durable Power of Attorney, et al).

THE COMPLETE IDIOT's GUIDE to WILLS & ESTATES (Fourth Edition) will give you that foundation of knowledge.It details the various legal entities, reviews the uses of each, and lists the pro's and con's.An excellent primer for people to talk legal-speak to lawyers (Or least understand the basis of the conversation).

For families with children, I would pair this up with THE BUSY FAMILY's Guide to ESTATE PLANNING (Hanks), published by NOLO, which provided extra details dealing with children, guardians, and extended estate planning.

Read the book, use the forms found in the CDs (found in both books), and find a good lawyer who practices in estate planning to solve your concerns.Good luck... ... Read more

You won't buy this book unless you're taking a law school course on trusts and estates. You want a book that will help you pass your exam. It's absurd to think that anyone else would even consider this particular book.

Sadly, no one mentioned this to Gerry Beyer. Instead of fleshing out concepts and explaining the material the way better E&E volumes do (see Glannon's brilliant Civil Procedure), Beyer just skims over the substantive material. Few topics are afforded more than a short paragraph, and his examples seem more obligatory than illustrative. He almost never references case law, even when obvious important cases warrant discussion.

With his constant preaching on the elements of good practice and superficial treatment of substantive law, it often feels like Beyer is trying to write a dummies guide to trust and estate practice. New lawyers mightappreciate his insights, if they're trying to begin practicing in this field, but law students (who, as I said, comprise the entire market for this book) would be better served by a meatier discussion of the law.

If you're trying to make up for poor study habits in the week before an exam, and you're just not satisfied with the free outlines that litter the internet, buy this book. It's a quick read and it won't bog you down with more information than you can memorize. Anyone else should look elsewhere.

This is an excellent reference tool, especially for estate and trust administration paralegals.It is good for those with a low to intermediate knowledge base of the subjects.

I normally love E&E. (The civil procedure E&E is wonderful). This one highly lacks.

The explanations of the concepts (before the examples) are poor. They barely skim the surface of certain concepts and as a result, I kept having to use another supplements to 'supplement' the explanations of this supplement. The explanations do not not give you enough black letter law.
