Law students rejoice ...

This is an essential buy for any law student taking IP. IP is a tough course with a lot of uncertainty, but this volume does a great job of simplifying the material. It was easy to digest and an enjoyable read during finals period.

The book is laid-out in a similar pattern as my course was, dividing trademark, patent, trade secret, copyright, as well as providing a short treatment on international IP and federal preemption of state IP law.

Be warned: this edition was published in 2003 and there's been a lot of change in the law of IP since then. You'll want to study the KSR case, TM Dilution Revision Act of 2006, and the latest from the Fed. Cir. in addition to this excellent treatment.

I plan on keeping this book by my side when I begin practicing, and look forward to the 2nd edition.

Intellectual Property Made Easy
It is a comprehensive but thorough book. I recommend it as a starting point in this field.

Good from European point of view
Intellectual property is now very different from 1997, when the comparable work of the eminent Paul Godstein was published.
The present work is a service for European lawyers, who must know rather much about the American legal tradition and be able to discern the similarities behind different concepts and the differences where one would not expect to find them.

Excellent book for introductory- intermediate level. Broad coverage, lucid style
I work in the area of Tech Transfer and had the great pleasure of taking Prof Rockman's class. We used this book. The book covers a very wide range of materials - from copyrights to software issues to patenting of live cells to cyber quatting. It is excellent for a beginner or someone who has basic knowledge of IP law. What's most impressive about the book is that it has excellent examples which makes concepts lucid.

Practical Introduction to Intellectual Property
This book is exactly what it says it is: a book for scientists and engineers.The author knows his audience is intellectually capable of handling complex information on legal topics even though they have little or no legal background.I never felt he was talking down to the reader.However, unlike other patent law books I have read that are aimed at future patent lawyers, he does not write on and on about legal theory and philosophical justifications of the patent system.The author sticks to explaining just what the law says, what it means, and how to comply.It is a very practical guide.I especially liked the sections on non-disclosure and patent ownership waivers.These are the contracts scientists and engineers have to sign all the time, even if they end up never patenting anything themselves.

Excellent choice, great breadth of coverage
I am involved in an infringement team at work and needed to learn more about patent law.I also am involved in product development and wanted to know about trademarks.I looked at several books and selected this one based on its broad coverage and structured approach.

After receiving the book, I was plesantly surprised to learn it is a graduate level text book.It is well written, well organized, and easy to read and understand.I highly recommend it!

Essential reading for anyone creating intellectual property
This is a book whose content is something that I should have read years ago. I am a part-time college instructor, have my own business and edit material for publication. In all three of these areas, questions and conflicts regarding intellectual property have arisen.
The colleges that I teach for have policies that dictate that all instructional material and software the instructor creates for the courses become the property of the college. While I have successfully resisted this policy at two colleges, my defense would have been much stronger had I known what I learned from reading this book.
I generally create my own material for the training I do through my business and my clients and I have had occasional minor differences concerning educational and intellectual property rights. There have been a few occasions when I was working as a contractor, and the contracts that were presented had clauses that would have prevented me from doing any work for anyone else that they perceive as one of their competitors. This has been a major point of disagreement; it has taken several hours of intense negotiation to resolve these issues.
In a previous job, my title was that of research scientist. My employers considered applying for patents on some of programs I wrote. This was nearly a decade ago, before software patents were so commonplace, so they never pursued the matter. Finally, I edit a math journal and occasionally write or edit a book.
In reading about the working situations of others, it is clear that my need for knowledge in the area of intellectual property law is not unique. Everyone who invents physical or cyber products should be aware of the legal standing of what they create. Questions concerning copyright and patentability are nowhere near as easy to resolve as you may think. Even if you sign a contract stating that all you make becomes company property, you still retain some, albeit limited, rights to the product. With more and more workers performing tasks on contract and telecommuting, this area is becoming increasingly muddled. The fact that I developed training material on my own time and using my equipment allowed me to successfully resist the attempts of the colleges to acquire the rights.
The first section of the book deals with patents, what they are, how to perform a patent search for prior art, how to obtain one, what can be patented, the requirements for originality and non-obviousness; how to continue the patent process if your application is rejected, how to obtain competent legal assistance, how to enforce patent rights and how to use a patent right as a business asset. I read these sections with fascination, I follow some of the "patent wars" processes in the trade journals, but until I read the material on patents, I never realized how complex the patent process is.
The next section deals with employment contracts and non-compete restrictions, something that affects all workers in the technical areas. It was heartening to read that while employers have a lot of power to enforce non-compete provisions, it is not absolute and workers are generally not denied their right to earn a living using their skills.
The next chapters cover copyright issues, what copyright is, how long it lasts, what the requirements are for originality, what can be copyrighted, the consequences of recent legislation, and mask work protection rights. The final chapters deal with trade secret law, trademarks and cybersquatting.
As I organized my thoughts before beginning this review, the question that I pondered many times and in as many ways as I could think of was: "Is there any area of information technology where a worker would not benefit from reading at least several chapters of this book?" After hours of thought, the answer is that there is no such area. Every line of code you write or alter is potentially part of a patentable product. There is no dispute that intellectual property is rapidly becoming the greatest single asset that many companies have. I have no way of knowing when it will occur, but at some point the worldwide monetary value of intellectual property will exceed that of physical assets. With this backdrop, understanding the basics of intellectual property will become a business skill as essential as knowing the fundamental rules of economics. To some, that is already the case.
Therefore, whatever your position in the intellectual property food chain, this is a book that you must read. I may have learned more valuable information from this book than from any other that I have read. It is definitely on my best books of the year list.

The history and political science of intellectual property law, the challenge of digitization, the many statutes and judge-made doctrines, and the interplay with antitrust principles are all examined. The treatment is both positive (oriented toward understanding the law as it is) and normative (oriented to the reform of the law).

Previous analyses have tended to overlook the paradox that expanding intellectual property rights can effectively reduce the amount of new intellectual property by raising the creators' input costs. Those analyses have also failed to integrate the fields of intellectual property law. They have failed as well to integrate intellectual property law with the law of physical property, overlooking the many economic and legal-doctrinal parallels.

This book demonstrates the fundamental economic rationality of intellectual property law, but is sympathetic to critics who believe that in recent decades Congress and the courts have gone too far in the creation and protection of intellectual property rights.

The starting point for IP economic policy justification
Probably the best starting point for understanding the positive and negative economic effects of intellectual property protection.The book is a fairly easy read assuming an academic exposure to economics 101 and a working knowledge of IP law.I read it in two days over thanksgiving vacation as part preparation for a fall patents exam.The book covers the basic economic benefits of IP protection - incentive, information, reduction in search costs, etc. vs. the economic costs - rent seeking, transaction costs, dead weight loss, etc.Good introductory reading for law students, legislative aids, and aspiring lobbyists from the medical-industrial complex.

The book has three very slight weaknesses, inherent in the topic it covers.First, the book admits early on that its own analysis is something of an over-simplification.Unwarranted self-criticism.A better "criticism" is that the real world fits the exception more often than the general rules, and specific situations will most often require a deeper analysis.Lifesaving pharmaceuticals, internet postings, and talking dog collar inventions are distinct situations and really just beg distinct economic analyses.

The second weakness is the assumption that the primary justification for IP law is/should be economic efficiency, superceding moral rights or property rights.Overall, sustains the status quo thinking that the steelworker, the scientist, the engineers, the farmers are just economic units on a global chessboard - not humans, and not part of a communities social fabric.Ignore at your own peril.

Third criticism, not nearly a strong enough position on the horrific transaction and litigation costs associated with the patent system in the U.S.If we should learn anything from the current financial crisis, is that you are remiss not to sound the alarm loud enough when a system has become expensive, unweildy, and unsustainable.To be fair, significant treatment of these costs is somewhat outside the books thesis of providing simple economic analysis of IP protection; and, transaction costs are covered in th text.Nontheless, it seems to ignore the elephant in the room to not give a more in depth treatment of this subject.

Good Intro at a Steep Price
OK, it covers the basics in a fairly easy-to-read format and moves right along.It is a well-designed, reader-friendly book, but a bit repetitive.The same statements appear in the intro, in the middle, and in the end summary of each chapter.

I take off one star simply for cost.No way is this intro-level material worth over 100 bucks.This is a $20 book in gold plating.

Another star off for quite a number of spelling errors and other typos and goofs (repeated sentence/para fragment, etc.) that should have been caught in proofreading.Hard to believe these are still being carried along in the THIRD EDITION.These little glitches don't interfere with the usefulness of the book, but given the price, they owe us a PERFECTLY PROOFED text.Everybody else gets it right--why can't this team?And, a working paralegal who made these types of errors could be fired.It's ironic and silly for the book to contain such goofs.

An Excellent Introductory Text on IP Law For Paralegals
I was assigned this book in my introductory Intellectual Property class during my paralegal curriculum, and it provided me with a very thorough grounding.

Most intellectual property law books are written for lawyers, so it was helpful to have a book designed for paralegals.

I have recommended it to the Association for Intellectual Property Paralegals (AOIPP), and it is listed on their "IP Books" page at: http://aoipp.org/ip-books/

I would recommend this book as the introductory text for a paralegal who is completely new to IP law, and Richard Stim's "Intellectual Property: Patents, Trademarks, and Copyrights" as a more advanced text for paralegals. I would not have understood many sections of the Stim text without having read the Bouchoux text first.

Good for business types too
I purchased this book to provide good background information for a simple seminar I teach within my company to provide information to inventors.
It is written to provide high level explainations of legal concepts as well as more detailed case law. What was most benificial to me was the section offering example cases and opinions.
This is far beyond what anyone can learn by searching the on-line resources such as the USPTO website and hence very valuable. It is written in a simple and easy to understand way and arranged to get to the information you need quickly.
I think this is a good book to have for lawyers and business people involved in IPR alike.

Gets the general idea but somewhat disorganized
I had a Copyright class this past semester. My book was organized very differently from the supplement, so it's not like the information isn't there, you just had to dig around to find various things that corresponds to your text. Good foundational book on Intellectual Property
This book is an excellent first place to go for people wanting a foundational knowledge of Intellectual Property.In addition to the basics it provides surprisingly comprehensive overview of the three major areas of IP.Making this book an excellent one, and not just a very good one, it also discusses trade secrets.As with most books on Intellectual Property, there is little in the book about who owns patents, how one can transfer ownership to another party, or how one can inadvertantly lose ownership. Overall, though, an excellent book for its stated purpose.
