Re-engaging with the Pure Theory of Law developed by Hans Kelsen and the other members of the Viennese School of Jurisprudence, this book looks at the causes and manifestations of uncertainty in international law. It considers both epistemological uncertainty as to whether we can accurately perceive norms in international law, and ontological problems which occur inter alia where two or more norms conflict. The book looks at these issues of uncertainty in relation to the foundational doctrines of public international law, including the law of self-defence under the United Nations Charter, customary international law, and the interpretation of treaties.

This book considers the extent to which States are held accountable for breaches of jus cogens norms under international law. The concept of State accountability is distinguished from the doctrine of State responsibility and refers to an ad hoc practice in international relations that seeks to ensure States do not escape with impunity when they violate norms that are considered fundamental to the interests of the international community as a whole.

State Accountability under International Law sets forth a definition of State accountability and establishes a threshold against which the existence, or not, of State accountability can be determined. Using a Foucauldian influenced interpretive methodology, this book adopts a novel construction of State accountability as having legal, political and even moral characteristics. It argues that the international community seeks to hold States accountable utilising a variety of traditional and non-traditional responses that cumulatively recognise that the institutions that comprise and legitimise the State were instrumental in the particular breach. Using case studies taken from State practice from throughout the twentieth century and covering a range of geographic contexts, the conclusion is that there is evidence that State accountability, as it is conceptualised here, is evolving into a legal principle.

The book draws together the many academic theories relating to accountability that have arisen in various areas of international law including environmental law, human rights and trade law before going on to examine an emerging practice of State accountability. A variety of ad hoc attempts and informal mechanisms are assessed against the threshold of State accountability established, with emphasis being given to practical examples ranging from the accountability of Germany and Japan after World War Two to the current attempts to seek accountability from Russia for former crimes of the USSR.

The book came brand new still in the packaging. I payed extra for the express delivery, but it still took almost a week to get here, which was quite upsetting. Overall--excellent quality but poor delivery time.

has a good part on the legal status of the divided states
Few books on international law ever touched upon the problem of the legalstatus of the divided status. Yet Prof. von Glahn has a sectionspecifically devoted to the discussion ofthe problem of divided statesunder international law.

Also, I found his use of cases to illustrate thevarious issue in international law especially helpful.Otherwise,theteacher and studentshave to go to another case book such as the one putout by Briggs to find the cases.

The american Pure Theory of Law
Hans Kelsen (1881-1973) is, for most of jurists, the most important legal theorist in 20st Century. Born in Prague, he lived and worked in Austria (till 1930), from then on -due to the political circumstances- in Germany (1930-1933), french Switzerland (1933-1940) and the USA (1940-1973).

His main work is the famous "Pure Theory of Law" (1934), a formalistic and structural scheme for interpret modern legal systems.

Throughout his long and prolific life, across the three different legal traditions (german, french and anglosaxon) in wich he lived, taught and wrote, he published a large number of articles and books.

The General Theory of Law and State (GTLS) marks a special phase in his carreer, because it symbolizes not a mere translation of his Pure Theory, but a true american version of it, because for the first time he confronts with the english and american legal tradition.

For those who knows the german version of his Pure Theory, will found the GTLS es a wider and clearer explanation of its main thesis.
