5-0 out of 5 stars Good intro to the place of rules in the international arena
International Rules is a prime example of a composite being more the sum of its parts. The authors collected writings from the main schools of international law (IL) and international relations (IR) scholarship and provide the reader with the basic analytical tools to ponder the place of rules (and norms) in the international system. In addition to an insightful introduction to each of the eight schools represented (five IL and three IR schools), Professors Beck and Arend wrote an opening (Beck) and closing (Arned) chapter providing a general framework for the discussion. The main problem tackled by the collection is the divergent positions and lack of communication between the fields of international relations and international law. While international law assumes the influence of (though not necessarily compliance with) legal rules on the behavior of its subject (and when it cannot exert such influence, it would no longer be classified as law) this point is, indeed, an open point of discussion among IR scholars. IR's Realists, for example, refuse to accept the influence of rules, rather focusing on power and view whatever rules do exist in the international system as mere reflections of the configuration of power. Even some of the IL schools focus on the influence power has on the formation of rules (IL's Feminists, New Stream and New Haven schools), as Beck aptly points out (pp. 15). Yet, some of the most interesting and groundbreaking work on the enigma of international rules finds no place in the collection. The constructivist program of research in IR focuses on the social determinants of the international system. As such, their work explores, with great detail, such issues as the function of norms and norm emergence, the influence of identity on action in the international arena and on the mutual constitution of the actor and the international system. This school traces its roots to Headly Bull's "The Anarchical Society" and from the late 1980's a flurry of writings on these subjects has emerged. In fact, Arend published an article (Virginia Journal of International Law, Vol. 38, No. 2, 1998, pp.107) and a book (Legal Rules and International Society, 1999) focusing on rules in the international system both of which implement constructivist methods. With the exception of the selection from Keohane setting off the constructivist approach (named by him "reflective"), the selection from Hurrell is really the only one which will give the reader a view into this important body of scholarship (although the select bibliography will set the reader in the right direction). Beyond this obvious shortcoming, there are several smaller ones I feel need to be pointed out. First, bringing Feminist voices to the discussion is laudable, but it is my feeling that the more developed "Third World" voice should not have been overlooked. (see: Third World Attitudes Toward International Law: An Introduction (F. Snyder and S. Sathirathai, Eds.), 1987 and K. Mickelson's "Rhetoric and Rage" article in Wisconsin Int'l Law Journal, Vol. 16 (1998) pp. 353). Second, Beck raises the question of the place of morality in the development of legal norms, yet the selections do not include the work of Lon Fuller, who wrote extensively on this subject. Nonetheless, I feel this book is an excellent starting point for the discussion on the place of norms in the international system and warmly recommend it to anyone with an interest in this subject. ... Akehurst's Modern Introduction to International Law provides a sound basis for understanding the United Nations, treaties, and international law. The only drawback to the book is that the material is becoming somewaht dated with its 1997 copyright.
The book has gone through a number of reprints in between 1998 and 2004 leading me to suggest a 8th edition for 2006. The book
provided an academic premier for a course in Space Law. I enjoyed the Latin legal terms spread throughout the text. I do recommend that the reader have some prior knowledge of the law to more fully appreciate the text.

This book is the essential guide to international law. Not only does it cover important themes and treaties over every conceivable topic, it does so without too much legal jargon and too much dumbing down. It hits the perfect average reading level and provides citations to the primary sources from which statements are taken for further research and understanding. It is extrememly well organized. Truly, this is the best comprehensive book on international law available to the average person.

Building on Akehurst's sound work, Malanczuk provides an accessible but not simplistic introduction to the field. While not as practice-oriented as, for example, Brownlie's , it has a theoretical component that other texts generally lack. It is also - for an introductory text - a very good first point of reference.

This book is quite difficult to read. The books show importnat text in italics (sometimes) not even bold, different font type etc. You really don't know what's importnat and what's not until you get it on exam. Very very difficult to navigate within a text and do a lookup of important terms or topics. The index at the end of book is also very limited. The design is like of a paperback novel - just text, text and text, with very little differences in text. The only bold words are titles of chapters and subchapters. This has been so far the most difficult textbook to read I have ever had and I usually don't have problems reading any kind of textbook.
On the other hand the information within is invaluable, and give you clear idea of what is what and what matters in international law. Sometimes the explanations and text is not well-written, some places it reads like if you are reading a legal document rather than a textbook.
The book provides a generous sample of cases.
Authors should consider improving page layout and design, and writing in a bit lighter tone. ... Read more

I am an experienced lawyer with no background in international law.I had read the 2d edition of Janis' book some years ago and was looking for a more comprehensive treatment.I started with Shaw's book and found the writing turgid (to use a turgid work) and then tried Brownlie's, which was somewhat better but didn't seem worth the effort.(Brownlie authored a chapter in the present book.)This book is just right.Well organized, comprehensive, and clearly written.As with most edited works, the chapters vary in quality, but even in the weaker ones the topic is adequately covered. ... The first edition was one of the earliest to establish that the newly-developing international law of human rights could be set down as any other branch of international law. It also incorporates the complementary fields of international humanitarian law and international criminal law, while addressing the problems associated with their interaction with human rights law.

The book is more than a descriptive analysis of the field. It acknowledges areas of unclarity or where developments may be embryonic. Solutions are offered. Recent developments have confirmed the value of solutions proposed in this edition and the previous one.

Central to most of the chapters is the human rights norm of most salience in the treatment of prisoners, namely, the prohibition of torture and cruel, inhuman or degrading treatment or punishment. The early chapters focus on the period of first detention, when detainees are most at risk of having information or confessions, however unreliable, extracted by unlawful means. Voices contemplating the legitimacy of such treatment to combat terrorism have been heard in the wake of the atrocities of 11 September 2001. The book finds that the evidence clearly suggests that the absolute prohibition of such treatment remains firm.

Other chapters deal with problems of poor prison conditions and of certain extraordinary penalties, notably corporal and capital punishment. A chapter explores ethical codes for members of professions capable of inflicting or preventing the prohibited behavior (police and medical and legal professionals).
