5-0 out of 5 stars A Thoughtful and Hopeful Approach to Ethics
Luizzi outlines a very sensitive and hopeful view of ethics in this book.He favors a pragmatic approach to ethics that makes room for a multiplicity of truths and ongoing evaluation of one's actions. He rejects the ethics that emerge from Kantianism and Utilitarianism because they are too rigid, and if they are to be followed as the standard of rule, they can lead to absurd ethical decisions. His pragmatic view is flexible and requires personal ongoing evaluation into what roles we play in our personal and professional lives.

Essentially, Luizzi says that as the conceptions of ourselves change, so do our moral behaviors. Our ethical decisions emerge from the way we conceive of ourselves in different situations. He thinks that legal ethics is a particularly good example of the versatility of moral behavior emerging from one's self-conception because lawyers have to continually define and redefine their professional roles.

He says that ethical behavior is tied to conceptions of self. For Luizzi, ethics is a reflective, constructive, fluid process that changes and adapts according to the way we change the conception of ourselves. Our rules of conduct change as our ongoing inquiry into who we are produces different results. He says that individuals must take an active role in constructing who they are, from their general to specific roles in their lives.Upon careful examination, we will find that we play a diverse array of roles and ought to engage in an ongoing assessment of these roles as they form and guide our moral conduct.

Overall, this book is very thoughtfully and clearly written. It offers a fluid and reflective approach to ethics that can't be found in Kantianism or Utilitarianism. This book is of interest to people inside and certainly outside the legal profession as its implications are far reaching into other professions and into personal lives. ... Product Description
The legal profession has played a key role in enabling businessto move goods and services across borders, but the regulation of thelegal profession has not kept pace with the changes that have occurredin communications, transportation and technology. Lawyers whoregularly counsel clients on transactions and litigation having aninternational dimension frequently find themselves without clearguidance on their ethical responsibilities. The extent and scope oftheir potential liability to clients is similarly uncertain. This work is the first major study by transnational lawyers andacademics of ethical and practice-related problems and challengesarising from the provision of cross-border legal services. Itdiscusses such topics as conflicts of interest from the perspective ofthe US, English, French and Dutch legal systems, and the rights offoreign lawyers to practice in Belgium, France, Great Britain,Germany, Japan and the US. Particular attention is paid to the Code ofConduct for Lawyers in the European Community and the Draft Directiveon the Right to Establishment for Lawyers in the European Community.Audience: Practitioners and academics will find the work aninvaluable resource. For practitioners, the chapters are sensitive toreal-life dilemmas that are regularly encountered. For academics, there is a comparative approach and analysis that is bothintellectually rich and provocative. ... Read more

Editorial Review

Product Description
Over the last 20 or 30 years of the 20th century the discipline of medical law has become an acknowledged area of specialism in law schools and medical faculties throughout the world. The medical lawyer is required to engage with philosophy, medicine, law, nursing, and social and political policy. As medicines progress, so the opportunity - even need - to use human subjects in research expands. Although a practice with a long history, the treatment of human research subjects has long been controversial and remains so. Few subjects can be so emotive as the decisions made by individuals at the end of life. Although this text covers many aspects of medical law, it is confined to four broad areas, from the traditional issues in medical law, such as negligence, to the specifically "modern" problems - issues at the beginning and end of life. ... Editorial Review

Product Description
The intersection between law and literature is a developing area in literary studies. Recent work argues that literature provides an imaginary forum in which legal ideals and practices may be tested. Dieter Polloczek's study develops this idea to show how the novel, with its increasing social scope and formal sophistication provided a means of transmitting, questioning and refining society's traditions, values and modes of self-questioning. Polloczek's study is both theoretical and historical, extending from the eighteenth century to the modernist period, and covering texts from Sterne, Dickens, Bentham and Conrad. ... Read more

Editorial Review

Product Description

In countries outside the developed world, although writers have written commentaries on specific legal codes, very little attention has been given to legal writing which has focused specifically on the ethics of the legal profession. This book makes a special contribution in that regard providing, as it does, a comparative study of prevailing efforts to enhance ethical standards in a profession potentially in crisis and under much public scrutiny.

Countries which have been examined include the UK, the US, Canada, South Africa, and countries in the Pacific, South East Asia and the Caribbean. Valuable guidance and learning are provided on such topical issues as wasted costs orders, conflicts of interests, legal and judicial codes, confidentiality, privilege and the ethics of the criminal process, where the jury system comes in for critical evaluation.

This book will be a valuable text on the ethics and status of the profession. It will be of considerable interest to law students, practitioners and legal academics, Bar Associations, Attorneys-General and Directors of Public Prosecutions as well as members of the judiciary.
