Extractions: Special to the National Catholic Reporter M With nearly 2 million people incarcerated, the growth of the U.S. prison population has dramatized the severe racial imbalances in the justice system, inequities that begin with enforcement strategies and carry through the court system and sentencing. Mandatory sentencing has stripped judges of discretionary authority that historically has resided in that position and handed it over to prosecutors. And the clamor for more punishment from a frightened electorate, say the critics, has incited politicians to weigh into the justice system repeatedly in recent years, often sacrificing long-term wisdom to vote-friendly short-term fixes. Growth of for-profit prisons The overwhelming majority of that growth has occurred in the United States. The Private Corrections Project of the University of Florida in Gainesville notes that 10 years ago there were just under 11,000 private prison beds throughout the world. Today, that figure stands at 138,000 in 188 facilities worldwide, most of them in the United States. In 1998, according to the project, the capacity of private prisons in the United States was 116,923 in 160 facilities owned and/or operated by 14 companies. The largest company is CCA with more than 67,000 beds in the United States. The state with the most privatized prisons is Texas with 43.

NEWS FOR AUGUST 2000 SEPTEMBER 13, 2001 Reprieve granted during crisis Death row inmate's appeal cannot be heard while courts are closed Associated Press HUNTSVILLE, Texas Gov. Rick Perry, in the wake of the terrorist attacks, issued a 30-day reprieve to halt the scheduled Tuesday night execution of convicted killer Jeffery Tucker. "This reprieve is granted due to the tragedy that has occurred in Washington, D.C., and New York and the extraordinary circumstances under which the U.S. Supreme Court has been closed," Mr. Perry said. "My decision to grant the reprieve was made to ensure that Jeffery Eugene Tucker has full and complete access to the court system and to ensure that justice is served," he said. Mr. Tucker, 41, had faced lethal injection after 6 p.m. for fatally shooting a Parker County man 13 years ago while stealing his truck. State law says Mr. Perry can issue a one-time 30-day reprieve to condemned prisoners. The U.S. Supreme Court last week refused to halt Mr. Tucker's punishment. His lawyers sought an 11th-hour reprieve from the Texas Court of Criminal Appeals, which also closed early Tuesday after the terrorist attacks. Mr. Tucker said in a recent death row interview that he didn't want a reprieve.

Do you agree with the prosecutors in this case? Yes. Only God (and the state of Texas) have the right to take a life. I agree that he must be charged with something but murder one for an 89 yo is like hunting quail with a Patriot missile. No! He should not be punished for trying to end the suffering of a loved one. Besides, any person capable of being married to the same person for years is a saint!

A number of law professionals are convinced that these five justices should be on trial for a criminal offense. The question is, how does an unwealthy and unempowered public bring about this legal justice? We must give energy to a powerful ground swell for justice. We need to meet with these law professionals and encourage them to act.
