Exclusion The Struggle for Citizenship Japanese American Internment The Struggle for Citizenship There are voices and experiences that have routinely been excluded in mainstream accounts of American history. These include the voices and experiences of people of color, of women, and of working people. In addition, many people have been denied the basic rights of law. People have been limited in access to employment opportunities, education, housing and more based on gender or race, as well as religion, class, disability or sexual orientation. As shown above, legislated immigration exclusion affected Asian Americans in unique and profound ways. But more profoundly, once Asians were in the U.S., they were also excluded from citizenship. Naturalization is the means by which the U.S. government has conferred "American-ness" to immigrants. For most of their history, Asians were deemed "aliens ineligible for citizenship" and could not be naturalized. Thus, the view of Asians as "not American" has another significant historical root besides immigration exclusion; the exclusion of Asians from naturalization rights has also deeply impacted on the experiences of Asian Americans and how they are perceived in the U.S. The Bill of Rights was signed over 200 years ago in 1790. In that same year, Congress passed the Immigration and Nationality Act, which limited eligibility for naturalized citizenship in the United States to "free white persons." After the Civil War, the Act was amended in 1870 to entitle "alien Africans" to become naturalized citizens. But Asians were still excluded from naturalization. This exemption was not lifted for all Asian ethnic groups until 1952. In short, Asian immigrants were legally forbidden from becoming U.S. citizens until less than 50 years ago. In this sense, the "foreigness" of Asians in the U.S. has little to do with their cultural background or historical presence in this country and everything to do with legislation that forbid Asians to become "American," keeping them legally "foreign."

Times Headlines By JEAN GUCCIONE, TIMES STAFF WRITER Jacqueline H. Nguyen could not have predicted her future on the day in 1975 when she and her family huddled inside a U.S. military helicopter as they escaped war-torn Saigon. Later, in the United States, her parents worked around the clock to save enough money to open a doughnut shop in North Hollywood. Nguyen studied between customers, won a full academic scholarship to college and went to law school, though she had never met an attorney. The 37-year-old federal prosecutor was appointed Tuesday to the Los Angeles County Superior Court, where she will become the first Vietnamese American woman to serve on the California bench. She will be joined by another Asian American immigrant, Tammy Chung Ryu, 41, whose judicial appointment on Friday will make her the first female Korean American state judge in California. Both women immigrated to California as children, helped their parents run small family businesses, attended the same law school and became respected attorneys. Their appointments by Gov. Gray Davis represent the changing ethnic and gender composition of the California judiciary.
