    (New York, October 30, 2000) Government interference in Azerbaijan's upcoming parliamentary elections has diminished prospects for a free and fair vote, Human Rights Watch said today. In a nine-page backgrounder issued ahead of the November 5 vote, Human Rights Watch described how the government has prevented opposition candidates from contesting the election, and charged that Azerbaijan was backtracking on its commitments to the Council of Europe.     Azerbaijani Police Raid Village

    Up to 200 armed police entered the village of Nardaran early in the morning of February 5 and attacked sleeping villagers at a protest site, Human Rights Watch said today. At least 15 villagers were injured during the 15-minute police assault, some suffering severe head injuries and broken ribs from truncheon and rifle-butt blows. The authorities have detained eight and denied them access to legal counsel.

    The incumbent government of the republic lays all responsibility for further events in the republic on Mikhail Gorbachev. President Alieyv said that the suggestion to institute the criminal persecution against Gorbachev was a “right suggestion.” This statement became news number one not only in Azerbaijan, but also far abroad. However, mass media did not pay attention to a very important stipulation: Gorbachev trial will become possible only if all procedure formalities are observed.
    Those formalities make a criminal case against the former president of the Soviet Union absolutely impossible. Yury Kolosov, a specialist of law from the Moscow State University of International Relations said in his interview to the Nezavisimaya Gazeta newspaper: “The given situation looks like the one with Pinochet, from the legal point of view. Mikhail Gorbachev is a foreign citizen for Azerbaijan. Needless to mention that he will not rush to yield to the Azerbaijan government. As a matter of fact, Baku will have to address to Moscow with a request to deliver the genocide crime suspect. However, there are no bilateral agreements between Russia and Azerbaijan to deliver criminals. Russia is a member of the European Convention for delivering criminals, although Azerbaijan is not. This means that the only thing that Baku can do about it is to put Mikhail Gorbachev on Interpol’s wanted list. Azerbaijan should have very weighty arguments to prove Gorbachev’s guilt at that. If Mikhail Gorbachev goes somewhere abroad, Interpol agents will be authorized to arrest him then.”

    Azerbaijan: Government Claims Victory In Controversial Referendum
    By Richard Allen Greene The government of Azerbaijan has claimed an overwhelming victory in a controversial referendum on 24 August that the opposition and independent observers say was marked by fraud and intimidation. The government defended the referendum, which made 39 changes to the country's constitution, as being necessary for Azerbaijan to meet its international human rights commitments. But critics argued that that explanation was merely a smokescreen for changes intended to cement the ruling party's grip on power, possibly for another generation. Baku, 26 August 2002 (RFE/RL) According to preliminary results from the Central Election Commission, nearly 90 percent of Azerbaijan's 4.4 million voters turned out to cast ballots in the 24 August referendum on amendments to the constitution. The commission also reported that nearly 100 percent supported all 39 changes. But the opposition, which had called for a boycott of the vote, says such results are absurd. They claim turnout was closer to 15 percent, and that the government shuttled voters from polling station to polling station so they could cast multiple ballots. They also charge that people were forced to vote, that ballots were stuffed, and that monitors and election officials were threatened and intimidated. Eldar Ismayilov, head of the nongovernmental organization For the Sake of Civil Society, summarized the opposition's position. "These violations represent a continued effort by the government of Azerbaijan to falsify elections. The four political parties that observed these elections declare that a quorum did not take place and that the will of the people was distorted and that state-organized crime took place across the country. Therefore, the results of this referendum are illegal," Ismayilov said.

    By Julie Moffett Washington, 30 January 1998 (RFE/RL) The U.S. State Department says that Azerbaijan's human rights record was poor in 1997, and that the government continues to commit serious abuses. In its annual report on human rights practices around the world, the State Department says that despite significant steps toward economic reform, Azerbaijan has made little progress moving toward democracy. The report says police were responsible for most of the serious violence, and in many cases severely beat persons in custody, resulting in several deaths. The report also says that in 1997, the police arbitrarily arrested and detained people, conducted searches and seizures without warrants, and suppressed and refused to allow peaceful public demonstrations. Prison conditions remain harsh, says the report, and the entire judiciary system is "corrupt, inefficient, and subject to executive influence." The report also says that the government arrested at least 19 members of the opposition party, the Azerbaijan Popular Front Party, and prevented its citizens from being able to peacefully change their government. The report says the government of Azerbaijan restricted freedom of speech, press, assembly, association, religion, and privacy when it seemed it in its interest to do so.

    Azerbaijan: Government Acknowledges Rights Limitations, But Claims Improvements Being Made
    By Richard Allen Greene In the past six weeks, no less than three different groups have issued major reports criticizing the human rights situation in Azerbaijan. The country is accused of abuses such as detaining political prisoners, suppressing freedom of speech and of the press, and restricting opposition political activity. The government in Baku acknowledges shortcomings but says international bodies should recognize Azerbaijan is making improvements. Baku, 17 April 2002 (RFE/RL) Two major international organizations have joined the U.S. government in charging Azerbaijan with fundamental abuses of human rights. Both Amnesty International and Human Rights Watch recently expressed concern about Azerbaijan's detainment of political prisoners, its alleged torture of some detainees, and the harassment of critics of the government. In an even more sweeping condemnation, the U.S. State Department's annual human rights report, released in early March, touched on many of these same issues and also accused Baku of restricting freedom of speech and of the press, denying religious freedom to "nontraditional" faiths, and "continuing to restrict citizens' ability to change their government peacefully." The government of Azerbaijan admits there may be examples of human rights violations in the country, but says the reports do Azerbaijan an injustice by focusing only on criticism.

    A Turkish secret service intelligence report has revealed that the British oil giant BP was allegedly involved in backing a military coup that overthrew the democratically elected government of Azerbaijan in 1993. In testimony included in the report, a former intelligence officer accused BP of trading arms for oil in an effort to secure a better deal on oil concessions in the country.
    The intelligence report, leaked to the Sunday Times of London, documents how BP, using bribes and a supply of military arms, systematically undermined the government of Azerbaijan, and perpetuated the overthrow of President Abulfaz Elchibey. The coup caused the death of 40 people, along with violence and repression of Azeri citizens.
    "As a result of our intelligence efforts, it has been understood that two petrol giants, BP and Amoco, British and American respectively, which together form the AIOC [Azerbaijan International Oil Consortium], are behind the coup d'etat carried out against Elchibey in 1993," said the report.
    Azerbaijan won independence in 1991 after the collapse of the Soviet Union and the global oil industry quickly moved in. In 1993, in two extraordinary votes, the parliament elected former KGB chief Heydar Aliyev into Parliament and then made him Speaker of the House just after the current Speaker mysteriously resigned. This put Aliyev second in line to the presidency. At that point, the report alleges that, "middlemen" paid off government officials and arranged to supply the incoming government with military equipment and an "arms-for-oil" deal, all on behalf of BP. This allowed BP to consolidate its position in the country.
