    Standards Bodies: The Battle Over Patents and Royalties
    by "Rags" Srinivas , Technology Evangelist In my last few columns, I outlined the general workings of standards bodies. I concluded by imploring developers to participate in standards bodies, as this is the only way to influence standards and the general direction of the computer software industry. A source of tension and conflict within the standards bodies of the computer software industry is the topics of patents and royalties. Specifically, the World Wide Web Consortium (W3C) has been caught up in a maelstrom regarding patent issues. There is growing tension between those who envision widespread standards' adoption and those trying to protect their investments in a standards' effort whose future potential is unknown. I'll attempt to present an unbiased view of what this clash means to the computer industry and developers. We may be at a defining moment of a different kind of warthe war over patents.

In Summit's case, the company alleged that Nidek infringed both its Azema (4,973,330 Surgical Apparatus for Modifying the Curvature of the Eye Cornea) and Marshall (4,941,093 Surface Erosion Using Laser) PRK patents. VISX claimed alleged infringement of three L'Esperance patents, assigned to VISX via its merger with Taunton Technologies (4,729,372 Apparatus for Ophthalmic Surgery; 4,718,418 Apparatus for Performing Ophthalmic Surgery; and 4,732,148 Method for Performing Ophthalmic Surgery). The Summit case, with Summit now merged into Alcon Laboratories, came to trial first and the results of the case were announced on September 26th. The Federal Judge ruled that both the Azema and Marshall patents were valid and had been infringed by Nidek, ordering that company to pay $14.8 million for lost profits plus $2.4 million in past royalties for infringement to January 2001, plus 5% royalties on all sales after January 2001. The judge, in his discretion, could award treble damages and possibly costs and attorneys' fees. He could also rule on an injunction against Nidek's continued participation in the U.S. market.

    Robert Crumb
    Robert Crumb was born in Philadelphia, PA on August 30, 1943. Though he never studied art nor had any formal teaching, he began drawing at an early age. While still in his early teens, he and his brother drew single issue comics for fun. Among these was "Fritz the Cat" which Robert would later draw for Harvey Kurtzman's "Help" magazine. In 1962, Crumb's family moved to Cleveland and Robert went to work for the American Greeting Card Company.He married his first wife, Dana, in 1964 and began doing work for other entities, including the aforementioned Help magazine, where he worked with/for one his greatest influences, comic artists and Mad co-creator Harvey Kurtzman. Many artists who later became part of the Underground Comic Counter-Culture with Crumb also worked at Help. Also during this period, Crumb began to experiment with drugs, resulting in some bad experiences with LSD, but these "bad trips" only led to Robert creating some of his most enduring characters, including the pop icon< "Mr.Natural". During this time he was doing illustrations and strips for New York's "East Village Other", a Greenwich Village newspaper. He moved to San Francisco in 1966 and almost immediately began interaction with many other blossoming artists including Rick Griffin, Spain Rodriguez, S.Clay Wilson and Victor Moscoso. It was not long before their creative minds were tapped by San Franciscan's Don Donahoe and Charles Plymell and "Zap Comix" #0 was published in 1967. A smash hit, Crumb and the other artists became overnight sensations.

A Pocket Guide to the Characters of The Phantom Menace by Ryder Windham. The recently elected leader of Naboo Queen Amidala rules from the city of Theed. Deeply committed to her people, she hopes to achieve a nonviolent resolution in the face of the Trade Federation invasion. Here's what I have put together: Amidala is the daughter of rural peasant farmers. However, at an early age, Amidala was trained by the best teachers on Naboo for her future role. She was partially raised in Theed, Naboo's capital city, by her late and very much beloved grandmother, Winama. Prior to her election as Queen at the age of 14, Amidala served as Governor of Theed for two years. Amidala's was a hard won election, as many people thought she was too young. She traveled extensively on Naboo, earning the trust of her people. Ultimately, she bested the corrupt King Veruna, and Sio Bibble, who succeeded her as Governor. Although Sio Bibble was one of the people who thought her too young to rule, Amidala later grew to respect Sio Bibble highly, and he became one of her closest advisors. Former King Veruna went on to farm rocks in the Naboo wastelands.

    Microsoft Applauds European Commission Decision to Close Santa Cruz Operation Matter Decision upholds Microsoft's right to receive royalties if SCO utilizes Microsoft's technology REDMOND, Wash.-November 24, 1997 - Microsoft Corporation today applauded the decision of the European Commission to close the file and take no further action on a dispute between Microsoft and Santa Cruz Operation (SCO) involving a 1987 contract. The Commission's decision follows progress by Microsoft and SCO to resolve a number of commercial issues related to the contract, and upholds Microsoft's right to receive royalty payments from SCO if software code developed by Microsoft is used in SCO's UNIX products. "We are gratified that the European Commission rejected SCO's request for further action and approved our request to close the file on this case," said Brad Smith, Microsoft's associate general counsel, international. "We were prepared to address SCO's concerns as long as our intellectual property royalty rights could be protected at the same time. The unique nature of the original 1987 contract made it difficult, but we were able to find a workable solution that resolves SCO's major concerns and still protects Microsoft's intellectual property rights," Smith said.

    Grand Duke Dmitri Dmitri Pavlovich was one of the few Romanov Grand Dukes to survive the Revolution. His son and grandchildren will be able to see the restored Alexander Palace, a true rarity among the Palace's 20th century residents. Ironically, he survived because of his involvement in the plot to murder Rasputin . Sent in disgrace by Nicholas to join an Army unit in Persia after the murder, Dmitri later escaped to England, and from there to the United States. He is the only later resident whose son has achieved political success.
    Dmitri left no memoirs. The only information we have of him is personal recollections and second hand accounts of his activities. We can see him among the many photographs left behind by the Imperial Family. He can be seen in film footage escorting his cousin, Anastasia , during the dynasty's tercentennial celebrations in 1913. He gave the impression of being a carefree, bon-vivant Grand Duke for much of his life. Impressions can be deceiving, though. His actions, at least at certain times in his life, reveal a much more purposeful and complex human being than he wanted the world to see.

    Dmitri Pavlovich Romanov, Grand Duke of Russia, was born in 1891, the only son of Princess Alexandra of Greece and Grand Duke Paul (or Pavl) Alexandrovich. The beginning of Dmitri's unstable childhood can be traced to the death of his mother in childbirth. A stray Goomba named Bill decided to join the circus (because of their 50 Koopabits an hour payroll). After a very successful year, Bill decides to become a Goomban Cannonball for the season closer. Just to give the impression of a really dangerous act, he puts on an explosing bullet disguise. When he is loaded into the cannon, the croud is going wild and wants to see him possibly get blasted to his fate. When the trigger explodes, he flies out at a speed much too fast for the net to catch him. He soars right through the net and out into the sky. While the circus owners thought they were out of buisness, the fans swamped them with huge money payments. A lot of them started to immitate Bill's daring stunt. They installed cannons all over the world, got a gigantic supply of explosive bullet suits, and have fired themselves ever since.

    (AP) As Microsoft awaits court approval of its landmark antitrust settlement with the government, the company has angered some competitors by tightly limiting the technical data it promised to release.
    Microsoft says the restrictions are normal for the software industry and do not violate the terms of the settlement. But competitors contend that Microsoft's actions are reminiscent of the behavior that led to the antitrust case and reinforce their claim that the entire settlement is inadequate. "It has done nothing to level the playing field," said Mark Webbink, general counsel for Red Hat, which sells a version of the Linux operating system that competes with Microsoft's Windows. Deborah Majoras, the Justice Department's deputy attorney general for antitrust, said her office is aware of the concerns and is closely looking at them. Jim Kulbaski, an outside lawyer hired by nine states that joined the settlement, said he is also examining the issue. "These issues are not being taken lightly," Kulbaski said.
