A Blind Eye to Justice in Cambodia By Balakrishnan Rajagopal The United Nations, which has had a terrible record in dealing with Cambodia ever since the horrific Khmer Rouge revolution, has now added a new chapter to the sorry tale. The United Nations recently abandoned its negotiation with the Cambodian government over establishing a tribunal for prosecuting Khmer Rouge leaders. The reason offered was that it would be too difficult to guarantee observance of international standards of justice. Surprisingly, international human rights groups have greeted this act with approval, because of their fear that the proposed tribunal would not measure up to international standards. Both the United Nations and the human rights groups are wrong on this matter. And by overstating the importance of international standards of justice, they have missed a great opportunity to continue to pressure Cambodia to build a culture of accountability. The United Nations' unenviable record in dealing with Cambodia goes back more than a quarter-century. The world body ignored atrocities during the Khmer Rouge's brutal reign in the 1970s, and it continued to recognize the Khmer Rouge as Cambodia's legitimate U.N. representatives until 1991, even though the whole world knew that they were mass killers. Worse, it refused to provide any systematic assistance to the Cambodian people during the 1980s, while aiding the Khmer Rouge by supplying them food in refugee camps on the Thai-Cambodian border.

We share your deep concern for the children and families who have been caught up in the problems associated with the adoption process in Cambodia. We will share with you today our assessment of the overall situation in Cambodia. What is that assessment? Two points. Let me tell you how we arrived at our assessment of the situation in Cambodia. In brief, this is what we learned. These are our conclusions about the defects in the Cambodian adoption regime. I want to stress that we are not simply reiterating the viewpoint of any single institution. · We have reason to believe that facilitators have been able to get the paperwork for these "abandoned" children through the Cambodian system by paying significant bribes. The facilitators charge thousands of dollars for their services, very little of which goes for official fees or the bona fide cost of care for the children. · How does this happen? Cambodian law and procedure does not ensure that children offered for adoption are genuine orphans. Children acquired in such manner are not "orphans" under U.S. law, nor under the Hague Convention on Adoptions - the international standard to which the U.S. and many other nations subscribe.

Prospective adopting parents are advised that the December 21, 2001 decision by the U.S. Bureau of Citizenship and Immigration Services in the Department of Homeland Security (BCIS) to suspend all orphan processing for Cambodia remains in effect. While it may be possible to complete a legal adoption through the Cambodian courts, children adopted in Cambodia, including those adopted through the court system, will not be issued orphan visas to enter the United States unless the case falls under the special Humanitarian Initiative announced by the Department of State and the BCIS on March 5, 2002. The Department of State is sympathetic to the desires of U.S. citizens to build families through intercountry adoption. In Cambodia, however, mounting evidence of serious irregularities, including illegal baby selling, dictate that the suspension must remain in place until the Cambodian Government can implement adoption laws and procedures that meet international norms and prevent abuses.
