    Charter Schools
    Overview
    A charter is a contract allowing a group of founders or a specific entity to receive public per-pupil funding to operate a public school in exchange for fulfilling specific educational outcomes. Charter schools are subject to fewer regulations than traditional public schools, and are, therefore, somewhat more autonomous and independent. The National Education Association (NEA) believes that charter schools can be a positive vehicle for public school reform, depending on their development, funding, structure, and governance. Charter schools must be held to high levels of educational and public accountability and must be prepared to welcome and educate all students.
    Background
    According to the U. S. Department of Education, nearly 1,800 charter schools run by such various groups as parent/teacher partnerships, community groups, and universities were in operation in the 1999-2000 school year. That number has exceeded 2,100 in the current school year. For-profit companies also have an increasingly high profile as managers of charter schools. Congress created the federal charter school start-up grant program in 1994, providing seed money for public charter schools meeting specific criteria, such as compliance with civil rights laws, free tuition, and nonsectarian status. Amendments enacted in 1998 provide more charter funds where state law meets certain requirements, such as requiring evaluations every five years and increasing the number of high-quality charter schools.

California's schools, which face many challenges, are not meeting these goals. Among the many efforts designed to address the shortcomings of today's education system is the charter school movement. Charter schools are grounded in private-sector concepts such as competition-driven improvement, Total Quality Management, employee empowerment and customer focus. But they remain very much a public-sector creature, with in-bred requirements of accountability and broad-based equity. Simple in theory, complex in practice, charter schools promise academic results in return for freedom from bureaucracy. With the 100 charter school slots authorized in California's law already filled, tensions are growing. Critics, some with vested interests in the existing system, fear that charter schools will prove to be a fruitless pipe dream. Proponents, some who favor the complete dismantling of the existing system, are pushing for an expanded opportunity to spread creativity and innovation. With the law's mandated evaluation report still three years in the future, the Little Hoover Commission decided to examine the record of charter schools in California.

    Autonomy
    Charter schools are a means of granting schools freedom from district rules and regulations in order to stimulate innovation in educating students. The degree of autonomy granted to charter schools, however, varies tremendously among states. All charter school statutes include language indicating that certain provisions concerning health, safety, civil rights and disability rights cannot be waived. The degree of autonomy provided to charter schools must be weighed against accountability, because the two are interrelated. By waiving regulations automatically, sponsors may lose the ability to exert control until the charter school becomes eligible for renewal. Charters can be revoked, but only for specific transgressions (see "Oversight, Renewal and Revocation" section of this document). The following areas should be considered when granting waivers of district and state regulations to charter schools.
    Considerations:
    Overall Waivers
    A few states grant charter schools "superwaivers," automatically freeing the schools from virtually all district and state regulations. Some charter schools are required to explicitly request waivers in the charter school petition, often accompanied by a mandated explanation for the waiver. More commonly, full waivers are granted.

    APPENDIX B AFT Criteria For High-Quality Standards Virtually every state in the country is in the process of developing reviewing or strengthening their academic standards, many of them encouraged to do so by Goals 2000 legislation. In the development of those standards-as is true with so many other important undertakings-the devil is in the details. If the standards are vague of fuzzy; if they are too skimpy ... or too overwhelming; if their focus is not on academic content; if they are set too high or too low, they not only fail to serve their intended purpose, they can also turn people against the basic notion of establishing standards. Based on lessons learned from recent standards-setting efforts undertaken by various national, state and local groups, as well as from our study of curricular and assessment materials of many European and Asian countries, the AFT developed criteria for teachers, parents, and others to judge the usefulness and effectiveness of student achievement standards. Since we first published these criteria in the fall of 1994, they have been used by states and districts developing standards, and they have been used in professional development workshops for teachers and others who are concerned about the quality of what is being put forward in the name of "standards."

    Definition The basic charter school concept is encompassed in the idea of " autonomy for accountability ". Charter schools are public schools of choice that are granted a specific amount of autonomy (determined by state law and the local charter) to make decisions concerning the structure, curriculum, and educational emphasis of the school. In return for this autonomy, charter schools are held accountable for the academic achievement of the students in the charter school, and the school faces suspension or closure if accepted performance standards are not met. The charter school typically receives between 85 percent to 95 percent of the public school funds for each student enrolled. Most charter schools are newly established schools, but some are conversion schools-those that previously existed as either public or private schools. Charter schools are as likely to have minority enrollments as other public schools. Charter schools do tend to be smaller than other public schools. Other than these similarities, there are few other generalizations that can be made about charter schools. The variety of curriculum focus is extensive-the sky does not limit the creative endeavors of charter school developers and operators. History of Charter Schools
    Minnesota was the first state to establish legislation allowing for the creation of charter schools in 1991. Since then, 34 states, Puerto Rico, and the District of Columbia have enacted some variation of charter school legislation. As of September 1998 there are more than 1200 charter schools that exist in urban, suburban, and rural areas.
