Myth vs. Fact
Promoters of "educational choice" make many assertions about the positive effects of private school vouchers on America's educational system. Are these claims true? What would vouchers really do? Let's examine some of the common myths about vouchers and review the facts.
MYTH: All voucher programs are constitutional. FACT: Sectarian schools account for 85 percent of the total private school enrollment in the United States. These schools serve as arms of religious ministries and integrate religious values and doctrine throughout their curriculum, indoctrinating students on controversial subjects such as abortion, creationism and the role of women in society. Despite these facts, however, the Supreme Court, in June 2002, upheld a voucher program in Cleveland, Ohio. The decision was extremely narrow. It is limited to circumstances in which the non-religious options that are available to students – such as through charter and magnet schools – predominate over religious options. The Court refused to overrule pre-existing decisions striking down voucher systems where private schools are the only options available to students apart from regular public schools.

Accountability in charter schools is a bottom line concern in this new experiment in public schooling. Charter schools receive freedom and autonomy in exchange for improvements in learning and climate. Are charter schools indeed accountable to their constituencies: students, their parents, and the taxpaying public at large? This paper looks at the issue of accountability in three broad categories: student learning; equity concerns, and public accountability. In each category, the goal is to raise points that can, in the long run, lead to the weakening of this experiment.     AMHERST The inclusive-style classroom may be denying elementary school special needs students the attention they require and the education they deserve, according to some local teachers. But an analysis of available data gives a different picture. Now only one question remains: which method of grouping is most effective in helping students, with and without disabilities, to achieve their expected goals? IDEA requires that disabled students be placed in a setting that constitutes the "least restrictive environment." In other words, the government calls for disabled students to be educated with those who are nondisabled, to the maximum extent appropriate. However, teachers such as Mary Donovan, a fourth-grade instructor at Crocker Farm Elementary School in Amherst, say the law is often misinterpreted. The "least restrictive environment" isn’t always the regular classroom for special needs students, Donovan said.

    Colorado prosecutors will soon decide the fate of Randy and Colleen Bates, parents of 13-year-old Amanda Bates who died from complications of diabetes after medical treatment was withheld due to religious beliefs. The Bateses are members of the General Assembly Church of the First Born, a Christian sect that believes in the power of faith healing instead of medical treatment. Police were called to the Bateses home on February 5th, after Amanda had stopped breathing. Members of the church had been praying over her and anointing her with oils. Amanda was revived and placed on life support, she later died. This is the second child of the twelve Bateses children that have died, although the first child died of sudden infant death, which was ruled as impossible to detect prior to the child's death.

Section 504 of the Rehabilitation Act of 1973 is Congress’s directive to schools receiving any federal funding to eliminate discrimination based on disability from all aspects of school operation. It states: “No otherwise qualified individual with a disability shall solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” Since Jefferson County Public Schools is a recipient of federal dollars, we are required to provide eligible disabled students with equal access (both physical and academic) to services, programs, and activities offered by our schools. Section 504 is a civil rights statute and not a special education statute. Therefore, it is the responsibility of regular education staff and administration to implement those practices and procedures necessary for a school to fulfill this law’s requirements. It is also important to understand that schools receive no additional funding to implement Section 504 accommodations. At each school, the responsibility for insuring Section 504 compliance rests with the building principal or principal’s designee. Please note that when working with disabled students, Section 504 serves the same purpose as ADA (Americans with Disabilities Act).
