Russell, Acting Director, National Institute of Justice When the Americans With Disabilities Act (ADA) was enacted on July 26, 1990, a new era began in the quest to integrate persons with disabilities into the mainstream of society. The ADA is perhaps the most sweeping civil rights legislation passed since the enactment of the Civil Rights Act of 1964 nearly 30 years before. This law is predicated on the belief that persons with disabilities have traditionally been isolated and segregated and that this discrimination took many forms, including architectural, transportation, and communication barriers; overprotective rules; exclusionary standards; lesser services, programs, activities, benefits, jobs, or other opportunities; and outright exclusion from certain places and privileges.1 One purpose of the ADA is simple: "to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities."2 The goal is to provide the estimated 43 million persons with disabilities3 access to employment, to governmental programs, services and activities, and to public accommodations such as restaurants, hotels, theaters, and shopping centers. To achieve this goal, the ADA contains five sections designed to eliminate barriers in employment, public services, transportation, public accommodations, and telecommunication.

MISSION
    The mission of the Bureau of Prisons is to provide overall administrative support for Delaware's five state prisons. These correctional facilities provide sanctions for sentenced offenders and pre-trial detention services for offenders awaiting disposition of criminal charges. The five facilities housing inmates sentenced to Level V sanctions provide:

BACKGROUND
Delaware has five adult correctional facilities. The Baylor Women's Correctional Institution is Delaware's only female correctional facility. The Delaware Correctional Center, the Multi-Purpose Criminal Justice Facility and the Sussex Correctional Institution provide incarceration at all security levels to male populations (MPCJF accommodates a small juvenile population in the Young Criminal Offenders Program-YCOP). The John L. Webb Correctional Facility is a minimum-security male facility. Delaware Department of Correction facilities have a design capacity of 6,469 and a temporary maximum capacity of 7,005. The average daily population is approximately 6,500 (as of Dec. 1, 2001). Currently, the Department of Correction experiences approximately 20,000 admissions and 20,000 releases a year.

Seven Ways to Fix the Criminal Justice System

Our present methods of dealing with criminals have not made society safer and crime-free, rather they have made the problems worse. A leading American prison reform activist tells what we can do reverse this trend. How can we reduce the frightening levels of crime and violence that plague out society today? The usual answer from politicians and the media is that we have to be tougher on crime. If we had the guts to crack down like, say, those Singaporeans, then we'd straighten this country out. But that's just a myth, and a dangerous one, because it is actually preventing us from solving the crime problem. Here's the reality: America now locks up prisoners at a rate five times greater than most industrialized nations, a rate of incarceration second only to Russia. The number of inmates in state and federal prisons has more than quadrupled, from fewer than 200,000 in 1970 to 948,000 in 1993. Prisoners currently sleep on floors, in tents, in converted broom closets and gymnasiums, or in double or triple bunks in cells that were designed for one inmate. I have visited about 500 prisons and, I can tell you, they are not country clubs (though they certainly are a luxury item: The average new prison cell costs $53,100 to construct). For the most part, they are terrifying and miserable places that will seem as shameful to us in a hundred years as the infamous nineteenth-century "snake-pit" insane asylums seem to us today.

    This NIJ Research report presents preliminary findings from a multistage study on adolescent violence, which draws from theories of cognitive and developmental psychology to construct a framework for understanding violent behavior. Unfortunately, typical studies on violence cannot explain the occurrence of a violent eventthat mixture of motivation, context, and facilitation that channels arousal into actual violence. The findings from this study indicate that adolescents should be taught negotiating and conflict avoidance skills under conditions that mimic the unpredictable nature of the street.

    THE PRISON ENVIRONMENT.
    Part of the institutional routine involves prison discipline. There are numerous rules inmates are expected to follow. Many of these are designed to keep order, whereas others are designed to establish authority. Prison contraband is the focus of numerous rules in the prison. Such items can be used to make prisoners more comfortable, such as tobacco products, or to aid in their escape, such as weapons. Another aspect of prison life is sexual deprivation . Because of their isolation from the opposite sex, many offenders resort to same gender sex. To reduce such contacts within the prison, conjugal visits have been permitted in several state facilities. These visits permit the inmate and spouse to spend time together in private quarters on prison grounds, during which time they may engage in sexual relations. Another mechanism to reduce same gender sex and to increase control of male inmates is the coeducational prison. Men and women are housed in the same facilities. They eat, study, and work together, but sleep separately. The assumption behind this plan is that men tend to behave better in the presence of women. However, many of these programs have been eliminated or restricted because of jealousies and pregnancies.
    The inmate social system is the result of a secure and custodial environment. Inmates can either live peacefully or they can continually fight the system. Most choose a compromise between these two extremes to survive the conditions within the prison.

    Department of the Youth Authority (5460)
    The Department of the Youth Authority is responsible for the protection of society from the criminal and delinquent behavior of young people (generally ages 12 to 24, average age 19). The department operates training and treatment programs that seek to educate, correct, and rehabilitate youthful offenders rather than punish them. The department operates 11 institutions, including two reception centers/clinics and four conservation camps. In addition, the department supervises parolees through 16 offices located throughout the state. The budget proposes total expenditures of $414 million for the Youth Authority in 2003-04. This is $12.2 million, or about 3 percent, below estimated current-year expenditures.
