PROP 36: Treatment, not prison, for drug possession
The Substance Abuse and Crime Prevention Act

If this measure passes, people convicted after July 2001 of nonviolent drug possession or personal drug abuse would go into treatment programs rather than prison. Courts could assign convicted offenders up to one year in treatment with six months of aftercare. Offenders who successfully complete their programs can petition to remove charges from their criminal records. If they fail to successfully complete their treatment, they could face other penalties including prison. The state would pay for treatment if the person couldn't afford it.
Arguments for
  • Drug addiction is an illness, not a crime Treatment works: Criminal activity drops 72 percent after offenders receive substance abuse treatment. Every dollar invested in substance abuse treatment saves taxpayers $7.46 Most people who go to prison for drug possession currently do not get treatment Treatment can intervene early and channel drug users into vocational training and counseling Children would be less likely to be separated from parents by incarceration (Parents may not need residential treatment or may be able to bring kids to residential treatment programs) More than one-fifth of the women now in California prisons, many of them mothers, are there on nonviolent drug possession and use charges

    A patient information handout on parenting, written by an AAFP staff patient education writer, is provided on page 1591. C hild abuse or maltreatment includes physical abuse, sexual abuse, psychologic abuse, and general, medical and educational neglect. The National Center on Child Abuse and Neglect has established a set of working definitions of the various types of abuse; however, the specific acts that constitute the various forms of abuse are defined under state law and, thus, vary from one jurisdiction to another. For this reason, child abuse is a legal finding, not a diagnosis. Poverty is the most frequently and persistently noted risk factor for child abuse. Primary prevention is defined as both the prevention of disease before it occurs and the reduction of its incidence. In the context of child abuse, primary prevention is defined as any intervention designed for the purpose of preventing child abuse before it occurs. This definition encompasses what some authorities have defined as secondary prevention. Family physicians should be aware of the risk factors for child abuse and possible interventions that could prevent it. This article reviews possible causes of child abuse and current intervention strategies.

This is the first statistically significant drop in four years. • Overall drug use remains level. While there is notable improvement in the youngest age group (ages 12 to 17), THERE IS STILL A SERIOUS PROBLEM AMONG YOUNG ADULTS (ages 18-25). Cocaine use, in particular, increased significantly, from 1.2 percent in 1997 to 2.0 percent in 1998. • TEENS WANT MORE GUIDANCE FROM PARENTS. In the nationally representative 1999 Uhlich Report Card, filled out by teenagers from throughout the United States, teens gave adults a "D+" on their efforts to stop teenagers from using alcohol, tobacco, and drugs. • TEENS HAVE AN INFLATED VIEW OF PEER DRUG USE. In a 1997 study, teenagers thought that more than 70 percent of their peers used marijuana at least occasionally. In truth, less than half of teenagers surveyed (44 percent) reported ever trying marijuana.

LINKS FICTION FACTS My child is too young to do drugs. Forty-nine percent of teens admit to having smoked marijuana at age 13 or younger. I’ve spoken to my child about the dangers of drugs. Nearly half of middle- and high-school students say that their parents have never discussed the dangers of drugs with them. Drugs are not a problem in my child’s school. Seventy-eight percent of high school students say that drugs are used, kept, and sold at their schools. Only 13 percent of principals and 15 percent of teachers believe that a majority of the students in their schools have tried marijuana. Yet 53 percent of their students say that the majority of their peers have at least tried the drug. Drug use is not a problem in my community. Teens continue to rank drugs as the single most important problem facing people their age.
