Parentage Actions
Parentage cases involve never married parents. The law is significantly different for Dad. Never married fathers have an entirely different set of rights than divorced fathers. First, there is the legal presumption that any child born during the course of a marriage is the child of the marriage. This presumption can have harsh results for the biological father if the child is a result of an extra marital affair with a married woman. If a child is born to a married woman, the legal presumption is that the child is the biological son or daughter of the husband. If that is not true, the biological father must immediately take steps to establish himself as the legal father or forfeit any legal right to participate in the life of his child. Timing is critical. Although Illinois law allows never married fathers to petition for custody and visitation of their children born out of wedlock, any court order affecting the child (e.g., a child support order) will operate to vest sole custody in the mother. This fact can have serious ramifications in the future if the father should ever seek custody of his child.

Improving Scottish Family law 5 Parental Responsibilities and Rights: Unmarried Fathers 5.1 Introduction 5.2 Historical background 5.2.1 Before this century, fathers had custody rights in respect of Scottish children born within wedlock, and the mothers generally did not. The reverse was true of children born outside marriage. Successive Acts during the twentieth century have removed the disabilities suffered by children born outside marriage, and have removed the legal inequalities between mothers and fathers. Most recently there has been a marked shift away from the concepts of parental rights and towards the responsibilities parents have for their children, and indeed the rights of the children themselves. 5.2.2 There is now no difference between fathers and mothers in the eligibility to have parental responsibilities and rights in Scotland, where the parents are married to each other (or have been married to each other at any point since the conception of the child). However, in the case of unmarried parents, the Children (Scotland) Act 1995 confirmed that only the mother has parental responsibilities and rights automatically. The father is eligible to acquire them, but this must be either by marrying the mother, by signing a Parental Responsibilities and Parental Rights Agreement

It is critical that women, women's groups, and all equality-seekers understand what is at stake with these changes, and that they participate in the law reform process. Indeed, many proposed changes could endanger women’s equality rights and run contrary to the best interests of children. The Ontario Women’s Network on Child Custody and Access (hereafter, OWNCCA) has prepared a series of information sheets on some of the key issues at stake: woman abuse, access to justice, parenting after separation, the best interest of children and women’s equality rights in family law. Moreover, this document will present some background information on the law reform process that has been unfolding over the last five years at the federal level, as well as provide you with ideas on what you and your organization can do to lobby for positive change for women and children.

The modern drive to expand fathers' rights in custody cases has significantly diminished decisions made in the best interest of the child, according to the research of a Berkeley professor of family law. States now give higher priority to blood ties than to parenting, so children can be ordered to live with biological fathers they have never known, said Mary Ann Mason, a lawyer and professor of family law at the School of Social Welfare. "An unwed father who has never seen his child will be given custody in most states in preference to unrelated individuals who have done the actual parenting," said Mason. "Unwed fathers now have the same rights as married fathers a major historical change of the past two decades," she said.
