    National headlines this summer about a Supreme Court case involving grandparents' visitation rights made it sound like grandparents across the country lost in their bid to keep in touch with grandchildren. But a Madison attorney familiar with family law says grandparents in Wisconsin shouldn't be affected by the Troxel vs. Granville Supreme Court Case, because laws in Wisconsin are different than those in Washington State, where the Supreme Court case originated. "All the Supreme Court case really said is that parents shouldn't have to prove in court that a relationship with their children's grandparents is harmful," says attorney Theresa Roetter, who works for Stafford Rosenbaum LLP, a Madison law firm. "The Supreme Court's ruling focused on a parent's right to decide what is best for their children." Roetter says some lower courts have since misinterpreted the case. "There is a general perception that the Troxel case prevents all grandparent visitation actions. That is simply not true. Because Wisconsin laws don't put the burden of proof on parents, our current grandparent visitation statues should not be affected."

    Grandparents often envision their golden years spent by happily caring for and treating their grandchildren. In recent years, as a symptom of our skyrocketing divorce rates, much litigation has occurred when grandparent's are prevented from seeing their grandchildren. As a direct result, today all states have statues authorizing a court to award visitation to a grandparent under certain circumstances.
    In Minnesota, a district court has broad discretion to determine what is in the best interests of a child regarding visitation. The authority of the Court to consider grandparents when making visitation decisions with regard to Grandparents is spelled out in Minnesota Statute § 257.022, subd. 2 (1994). This statute specifically allows the district court to consider a request (by petition) for grandparent visitation if the grandparents are the parents of a deceased parent of the child. It states that: Moreover, Minnesota's divorce statute also allows grandparents to file a petition for visitation as a separate action outside of a divorce , paternity action or legal separation.     In recent years, the issue of Grandparent's rights to visitation in divorce has come to the forefront. Sadly, what will often happen in divorce are the parents of the non-custodial parent end up cut off from their grandchildren. This may be especially true if the grandparents and grandchildren live a far distance from each other.
    Grandparent's rights have become a controversial issue. On the one hand why should grandchildren be denied time with a grandparent because their parents no longer live together or are getting a divorce? Conversely, at what point does the intervention of the courts infringe upon a person's civil liberties?
    People going through a divorce often feel that they have little or no control over their lives anymore. It seems the court system takes over their life, telling them how to live, where to live, how much money to live on and on.
    VISITATION
    Exactly what is visitation? To put it into its simplest form, visitation is when the court sets a specific schedule for a person to have access to the child. In other words in the case of grandparent's visitation the court will order that the children be made available to the grandparent on specific day for a specified amount of time.
    Unfortunately, just because a grandparent is being denied access to their grandchild does not necessarily mean they will qualify for court ordered visitation. Grandparent visitation is governed by statute and case law, and each state has their own laws.

Grandparents who are denied visitation with their grandchildren may turn to the courts for help. What You Should Know State Laws Vary State laws may provide legal remedies for grandparents who are being denied visits with their grandchildren. Grandparents should be aware, however, that no state grants an automatic right to visitation. Judges are required to consider the circumstances of the individual family in deciding if a child would benefit from visits with grandparents. In all 50 states, the best interest of the child is used as a basis for determining whether to order visitation. In other aspects of visitation, individual state laws differ widely.

    AARP's Grandparent Information Center The new limits reverse a 30-year-old trend in which grandparents in all 50 states gained the legal standing to seek visitation rights in court. "Now state court decisions are all over the map," says AARP attorney Rochelle Bobroff. "There's tremendous confusion, tremendous conflict." While very few family disputes go to court, grandparent advocates say, visitation rights are crucial because most grandparents play an invaluable role in the lives of grandchildren. Prior to 1965, that role was not well recognized, and grandparents who were blocked from seeing their grandchildren, usually by the parents, had no legal right to seek visiting privileges. As divorce rates, out-of-wedlock births and drug use increased, states began passing laws bolstering grandparent rights when parents died, divorced, separated or were jobless or disabled. Now the pendulum is swinging back, and more than a third of the states have narrowed those laws. One reason, says Traci Truly, a Dallas family law attorney and author of "Grandparents' Rights" (Sphinx Publishing, 2001), "was a perception that parents' rights had eroded." The reversals are a "reminder" that parents do have rights.

Grandparents’ rights are not specifically written into law in Canada except in Quebec. The laws of Prince Edward Island give any person the right to apply to Court for custody or for access and visiting rights - this includes grandparents. You can make an application at any time in the child’s life. When family circumstances change, arrangements concerning custody, access and visitation may be changed as well. You must have a good reason and you will need the services of a lawyer to apply for this. The application will go through a court process and a judge will decide what is in the best interests of the child. If your child becomes a parent while still living at home, is under 18 years of age and is dependent, you have a legal obligation to provide for him or her. But because your child is now a parent, he or she has the right to make decisions about your grandchild that you may or may not agree with.

One area which has undergone change concerns when and how those who are not parents can obtain custody and visitation rights to the children of others. This article explores this subject. In Alaska, for a non-biological parent to obtain custody, it must be proven to the court that the biological parent is unfit, has abandoned the child, or that the welfare of the child requires that a non-parent have custody. There is a presumption that a parent is fit to have custody of a biological child. Parents have a custody preference, unless clear evidence is shown of a parent's unfitness or that the welfare of a child requires that court to place custody in a non-parent. It is easier for a non-parent to ask the court for visitation with a child than it is to petition the court for custody. Alaska courts will provide for visitation by grandparents and other non-parents only if visitation is found to be in the best interests of a child. A non-parent who has, over time, become a psychological parent to a child, can ask a court to award visitation. The psychological parent relationship can be demonstrated by day to day interaction between the child and the non-parent which fulfills the child's psychological need for an adult. The adult must be an essential focus of the child's life, meeting the emotional and psychological needs of the child, and the psychological parent must treat and love the child as a wanted child.
