Grandparent Visitation Rights KNOW YOUR OPTIONS, CHOOSE A PLAN OF ACTION by Loma Davies Silcott Gone are the days when your children and grandchildren lived down the block or around the corner and you could visit them whenever you wanted. In our mobile society, many children live half way across the country and grandparents are lucky to see their grandchildren once or twice a year. Today, even that seldom is better than what an increasing number of grandparents are facing: a court fight for the right to see their grandchildren.
Although no one knows how many such visitation cases there are in the United States today, experts agree that the numbers are rising. Richard Victor, an attorney in Michigan, has made a specialty of such cases. When he began in 1979, he had only half a dozen clients. In the years since then, his firm has represented well over 600. He also founded and is executive director of the nonprofit, nationwide group, Grandparents Rights Organization (GRO), based in Birmingham, Michigan.
Problems usually occur when there has been a nasty divorce and your child's ex-spouse has custody of the children. For whatever reason, he or she decides to deny you access to your grandchildren. Fortunately, many state laws now provide reasonable visitation rights for maternal and paternal grandparents. However, since legislation varies widely from state to state, even if you win your case in one state, you will have to start all over again if your grandchildren move to another state.

The U.S. Supreme Court's decision to affirm the right of a mother to prevent her daughters from seeing their grandparents may not be quite the victory for parental rights that observers first thought, a University of Illinois family law expert says. On the face of it, last month's closely watched decision (Troxel vs. Granville) was a defeat for grandparents seeking court-ordered visitation rights in cases where the parents have divorced or one of the parents has died. What was most striking about the split decision, said David D. Meyer, a UI law professor, was the narrow grounds on which the majority of justices based their ruling. "The court did not rule on the constitutionality of the Washington state law itself, holding only that the judge's application of the law in this case was unconstitutional. This seems to leave the door open for a better balancing between the rights of parents to raise their children without interference and the rights of other members of the family to continue a meaningful relationship with the children."

...More Likely Now than Ever ... Families who hesitated to travel all the way to grandma's house for the holidays might have to reconsider this year. Under a newly amended state statute, the likelihood of grandchildren spending time with their grandparents became significantly greater. Section 30-3-4, Alabama Code (1975), gives Alabama grandparents who feel they don't get to see their grandchildren often enough the right to intervene in an intact marriage to gain access. "Even in a family where the mother, father and children are together there isn't a divorce or death in the family the grandparents can now take the parents to court if the grandparents' time with the children has been limited," says John M. Wood, managing partner of Wood & Shaw, L.L.C., and chairman of the family law section of the Alabama Bar Association." This is an unprecedented expansion of grandparents' rights in this state." The revised Section 30-3-4 says that grandparents may file an original action for visitation rights "when the child is living with both biological parents who are still married to each other, whether or not there is a broken relationship between either or both parents of the minor and the grandparent or either or both parents have used their parental authority to prohibit a relationship between the child and grandparent."

For grandparents who find themselves in a visitation struggle, it’s important to know options, rights, avenues to resolution and whether or not legal intervention might be necessary. Grandparents’ Rights Organization Executive Director Richard S. Victor began working diligently for grandparents’ rights in 1978, and founded the nonprofit organization in 1983. In the area of grandparents’ rights, where laws previously didn’t exist, the Bloomfield Hills, Mich., family-law attorney says by 1985 laws had been passed or modified in all states on this issue. Grandparents’ rights have become increasingly important in an era of family dysfunction. A grandparent/grandchild bond can enrich and strengthen. "It’s good for both grandparents and grandchildren to maintain contact and share memories and experiences," says Victor, who looks at the relationship in terms of the child’s rights.

But one prominent conservative, Justice Antonin Scalia, wasn't happy at all. He accused his colleagues of abandoning judicial restraint something conservatives revere nearly as much as the family. His dissent will no doubt persuade some on the right that parental rights truly are no business of the courts. What it ought to do, though, is alter their view of the Constitution and the courts.

Grandparents lose ground on visitation rights

Staff writer of The Christian Science Monitor MIAMI For many older Americans there is no greater joy than building a relationship of love and trust with a grandchild. But what happens when parents refuse to permit contact between a child and his or her grandparents? Increasingly, grandma and grandpa are answering with an all-too-common battle cry: "We'll see you in court!" That's what happened in south Florida where Leonor and Roberto Azicri filed suit seeking to visit their granddaughter Kelly Von Eiff. The Azicris' daughter died when Kelly was two years old. Two months later, another woman moved in with the Azicris' son-in-law and the grandparents' regular visits with Kelly were sharply curtailed. They sued for visitation rights and won. But in November the award was overturned by the Florida Supreme Court, which ruled unanimously that Kelly's parents - including her new adoptive mother - had a fundamental right to raise Kelly (and decide whom she may visit) without being second-guessed by a state judge.

(CBS) The U.S. Supreme Court has drawn sharper lines on the rights of grandparents.
On Monday, the High Court ruled 6-3 that a Washington state law went too far in giving grandparents the right to see grandchildren over the objections of the parents. CBS News Correspondent Eric Engberg reports the court strongly reaffirmed the right of parents to control the rearing of their children in striking down the law, which two grandparents used to try to win more time with their grandchildren. The ruling written by Justice Sandra Day O'Connor a grandmother herself and joined in by five other Justices holds that the U.S. Constitution's due process clause
