Women do not always get justice in the family law courts. Too often the court makes inequitable rulings on divorce, custody and child support. CA NOW has formed a statewide Family Law Task Force to investigate and reform the system. In California and the nation there is a crisis in the family law courts. Reports of incompetence and corruption are increasing. Women are experiencing gender bias, denial of due process, and decisions that are not in the best interest of the child. Women after divorce often have less money than their husbands, and cannot afford the best lawyers for lengthy or difficult court battles. About 40% of custody cases are contested today due to allegations of child abuse, molestation and domestic violence. Tragically, in some of these cases perfectly fit mothers are loosing custody of their children. The controversial and unaccepted theory of Parental Alienation Syndrome has been used in case after case to actually give custody of young children to their abusers.
The CA NOW Family Law Task Force has called for an Executive, Legislative, Judicial and Grassroots Strategy to reform the system.

"Shared Parental Responsibility." In our work as women's advocates, how often have we heard custodial moms wish that their children's father would share the parental responsibility? Unfortunately, "shared parental responsibility" is the new doublespeak for joint physical custody by so-called "father's rights" groups. For example, in Michigan proposed legislation supported by these groups would impose joint custody on parents who are in conflict over custody. Most studies report that joint custody works best when both parents want it and agree to work together. The Michigan legislation states that in a custody dispute the judge must presume that joint custody is in the "best interests of the child" and "should be ordered." To make any other decision, a judge must make findings why joint custody is not in the children's "best interest." This is a high legal standard that makes it very difficult for judges to award any other custody arrangement. It is also a departure from the generally accepted standards determining what's in the best interest of the child. Michigan NOW opposes forced joint custody for many reasons: it is unworkable for uncooperative parents; it is dangerous for women and their children who are trying to leave or have left violent husbands/fathers; it ignores the diverse, complicated needs of divorced families; and it is likely to have serious, unintended consequences on child support.

It is critical that women, women's groups, and all equality-seekers understand what is at stake with these changes, and that they participate in the law reform process. Indeed, many proposed changes could endanger women’s equality rights and run contrary to the best interests of children. The Ontario Women’s Network on Child Custody and Access (hereafter, OWNCCA) has prepared a series of information sheets on some of the key issues at stake: woman abuse, access to justice, parenting after separation, the best interest of children and women’s equality rights in family law. Moreover, this document will present some background information on the law reform process that has been unfolding over the last five years at the federal level, as well as provide you with ideas on what you and your organization can do to lobby for positive change for women and children.

Introduction
Families Need Fathers is a registered charity which currently has over 2,500 subscribing members. Founded in 1974, we celebrate our 25th anniversary this year. We provide information on and support for separating or divorcing parents, married and unmarried, of either sex. We are particularly concerned with the problems of maintaining a child's relationship with both parents following family breakdown. Membership is open to all irrespective of race, creed, colour, gender, disability, sexuality or political affiliation. FNF is heavily reliant upon subscriptions and donations. FNF advocates shared parenting, the introduction of parent and child rights into family law, equal treatment for all parents, and the use of mediated settlements to reduce family conflict. This response offers our views on the Improving Scottish Family Law consultation paper. The twenty-four questions are answered below.

Lawyers from the state attorney general's office failed to appear Thursday in the Fourth District Court of Appeals to counter a challenge to the law, which requires birth mothers to publicize their sexual histories in newspaper ads. The challenge comes from six mothers, who say the law violates their privacy. Legislators, including the bill's prime sponsor, are drafting a new bill they say will address the privacy issue. The law, which makes no exception for rape victims or minors, requires a mother - before putting her child up for adoption - to take out newspaper advertisements listing her name, age and description, and the descriptions of any men who could have been the father. The ads must run once a week for a month in any city where the child was believed to be conceived. "The state is saying now that somebody's challenging this law, it's time to fix it," Amy Hickman of the American Academy of Adoption Attorneys said Thursday after arguing the case.

FREE PRESS STAFF WRITER Molly Bascom-Keller sat inside the Summit Place Mall's new primary-colored play structure, discreetly nursing her baby while her older children romped in the ball pit. WHAT THE LAW SAYS Federal law allows mothers to publicly breast-feed anywhere they would be authorized to go with their babies. In Michigan, legislation was enacted in 1994 to further protect and clarify a mother's rights. State law stipulates that nursing women are not subject to prosecution when breast-feeding, even if the breast, nipple or area around the nipple are exposed during feeding. Source: U.S. Congress and the La Leche League International. WHEN OUT IN THE OPEN Mothers may avoid harassment by breast-feeding discreetly in public. Despite the many advances that have been made, however, LGBT people continue to face discrimination in many areas of life. No federal law prevents a person from being fired or refused a job on the basis of sexual orientation. The nation’s largest employer – the U.S. military – openly discriminates against gays and lesbians. Mothers and fathers still lose child custody simply because they are gay or lesbian. And gay people are still denied the right to marry in all states. The ACLU has actively supported the struggle for lesbian and gay civil rights since the 1960s and in 1986, it established its national Lesbian and Gay Rights Project. Working in close coordination with the ACLU’s affiliates nationwide, the Project coordinates an extensive legal program and conducts a broad range of public policy and public education activities. The Project targets five areas for its litigation, lobbying, and public education activities: discrimination; family and relationships, including marriage; lesbian and gay teens and young adults; laws which criminalize sexual intimacy; and expression and association.
