CUBA's ADVERSARY FOREIGN INTELLIGENCE OPERATIONS

When the Cold war ended, it was widely believed that a new era of international cooperation had begun. However, simply put, the end of the Cold war has not led to a more peaceful world. The United States is the target of those who challenge the status quo, and one of those is Cuba. Furthermore, the PRC has joined efforts with Cuba in a new axis. The deterioration in China's relations with the United States is also being accompanied by a warmer relationship with Russia. Of course, rapprochement between Russia and China, by itself, would not be worrisome. The problem with the Chinese-Russian raprochement is what is driven by mutual dissatisfaction with the United States, and that involves Cuba and its expansion in Latin America. There are four nations that use intensively their intelligence services to harm the interests of the United States. The nations are: Russia, PRC, Cuba, and North Korea. These nations continue to expend significant resources to conduct intelligence operations against the United States. These efforts are centered on producing intelligence concerning the U.S. military capabilities, other national security activities, and military research and development activities. They have now expanded their collection efforts to place additional emphasis on collecting scientific, technical, economic, and proprietary information. These collection efforts are designed to provide technologies required for the acquisition and maintenance of advanced military systems, as well as to promote the national welfare of these nations.

by Gary Hunt A few people have questioned what, exactly, was intended by the proclamation made by Bill Clinton in Executive Order 12949, titled "Foreign Intelligence Physical Searches" (entire text follows). We may never know what Bill had in mind, but we can look at the wording of the EO and see what might be created as a result of this "Executive Order" . The foundation or justification, of the Order is the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801) and it's subsequent amendment by Public Law 103-359. I have not reviewed these "laws", but it is clear by the first paragraph of the Executive Order that the President may authorize physical searches for foreign intelligence purposes, which method appears to be defined by this document. Section 2 gives the authority to approve application to the Foreign Surveillance Intelligence Court [which, apparently, is created by the "Act"]. Surely not an Article III (Constitutional) court, but, more likely an administrative agency tribunal, much like tax courts and traffic courts. If it were a real court, there would be no problem "issuing" warrants, which are what the Executive Order circumvents.

WASHINGTON (November 4, 2001 5:40 p.m. EST) - Congress has just given the Foreign Intelligence Surveillance Court new powers - even as some fear the court's growing power. "The secrecy surrounding the court's proceedings is a real problem for democratic accountability and for the rule of law," said Lee Tien, senior staff attorney with the Electronic Frontier Foundation. When the Justice Department wants to tap a suspected foreign agent's phone, or secretly send investigators to ransack the suspect's home, it comes to the Foreign Intelligence Surveillance Court for approval. Meeting in a windowless, soundproof room in the Justice Department, with its members drawn from the nationwide pool of U.S. District Court judges, the court almost always gives the Justice Department what it wants. Last year, the court received a record 1,005 requests for intelligence gathering operations. All were approved. The previous year 886 applications were received. All were approved. The year before that, 796 applications were received. All were approved.

Foreign Report presents an alternative view Israel’s military intelligence service, Aman, suspects that Iraq is the state that sponsored the suicide attacks on the New York Trade Center and the Pentagon in Washington. Directing the mission, Aman officers believe, were two of the world’s foremost terrorist masterminds: the Lebanese Imad Mughniyeh, head of the special overseas operations for Hizbullah, and the Egyptian Dr Ayman Al Zawahiri, senior member of Al-Qaeda and possible successor of the ailing Osama Bin Laden. The two men have not been seen for some time. Mughniyeh is probably the world’s most wanted outlaw. Unconfirmed reports in Beirut say he has undergone plastic surgery and is unrecognisable. Zawahiri is thought to be based in Egypt. He could be Bin Laden’s chief representative outside Afghanistan. The Iraqis, who for several years paid smaller groups to do their dirty work, were quick to discover the advantages of Al-Qaeda. The Israeli sources claim that for the past two years Iraqi intelligence officers were shuttling between Baghdad and Afghanistan, meeting with Ayman Al Zawahiri. According to the sources, one of the Iraqi intelligence officers, Salah Suleiman, was captured last October by the Pakistanis near the border with Afghanistan. The Iraqis are also reported to have established strong ties with Imad Mughniyeh.
