Press Office No.6 Convent Place, Gibraltar Tel: 70071 Fax: 74524 Press Release No: Date: 09 January 2003 Pensions Issue (Link to Written evidence of Common Foreign Affairs Committee - July 2002) The Gibraltar Government notes the response of the Foreign Office to the House of Commons Foreign Affairs Committee Report which was very favorable to Gibraltar. In overall effect, the Foreign Office appears to reject the fundamental conclusions of the Report, but the fact is that those conclusions remain, and they are the judgement of a cross party committee of MPs with a Labour majority. The Gibraltar Government rejects HMG'S failure to distinguish between Community Care payments and pensions. These two types of payments are made by different entities, under different entitlement rules, to a different class of persons and on different terms and conditions. HCA is a matter for Gibraltar. Any liability to pay non residents of Gibraltar an uprated pension is a matter for HMG. The Gibraltar Government has been clearly and firmly committed throughout, and will remain committed, to the principles that Gibraltar will not pay uprated Spanish pensions and that Community Care Trust payments should continue on the present basis, without it being reduced or withdrawn from anybody in Gibraltar.

The Gibraltar Government London representative is Mr Albert Poggio MBE who is also director of the Gibraltar Tourist Board, Vice Chairman of the Calpe House Trust, Chairman of the UK Overseas Territories Association, Director of the Friends of Gibraltar Heritage and a Director of MedCruise, the association of Mediterranean Ports. The UK activities relating to the Finance Centre under the direction of the DTI are also co-ordinated through the London base. The well being and care of Gibraltar patients required to travel to the UK for specialist medical treatment is an important role for the London office. Calpe House, the residential home used by these patients and their escorts, plus patient support, is provided under the Government of Gibraltar sponsored medical scheme. The Strand offices provide a contract point for the Gibraltar Heritage Society. The Society supports all matters relating to the Gibraltar Heritage Trust. A limited range of souvenir items such as books and special edition stamps are available for sale from the offices in the Strand.

All the Treaty provisions on the free movement of capital, services and persons apply fully to Gibraltar. The fourth 'freedom' on movement of goods is restricted by Gibraltar's position outside the Customs Territory, although in effect this is largely mitigated by the application of the Generalised System of Preferences to Gibraltar. The Gibraltar Government itself has introduced enabling legislation to allow for a swift and flexible response to the changing demands which emerge in today's highly competitive economic environment. Tax legislation, for example, has been amended to provide for qualifying companies engaged in international business to pay tax ranging from a minimum of 0% to a maximum rate of 35%. Banking and insurance legislation has also been introduced on UK lines, with supervision by an independent regulatory authority, the Financial Services Commission. In effect, the Gibraltar authorities can issue insurance licences which are Community wide.

Scottish CND News Response to Gibraltar Goverment approval for submarine repair The Gibraltar Government has said that it is not opposed to the repair of HMS Tireless in a statement issued on 14 Sep. Meanwhile there has been substantial opposition to the proposal in Andalusia. The Andalusian Parliament has agreed to oppose the repair and is investigating legal action to stop it. Between 6,000 and 10,000 people took part in a demonstration against HMS Tireless in La Linea on 14 Sep. The Mayors of towns in the area are organising protests in each town next Thursday. The MoD have said they will make a statement today (15 Sep) in which they are expected to announce when work will start. Local groups in Gibraltar who are opposing the repair will also be considering what action they will take next. There are a number of weaknesses in the case presented by the Gibraltar Government and their reassurances should not be taken at face value: (1) With regard to para 5.1

    • The people of Gibraltar, like all colonial peoples before them, enjoy the inalienable right to self-determination, that is, the right to decide their own future.
      Bilateral Anglo-Spanish agreements about the principles applicable to Gibraltar’s future, sovereignty and status, entered into against the wishes of the people of Gibraltar betrays Gibraltarians’ right to self-determination.
      Spain has failed to accept, and refuses to accept, the principle of consent in respect of the future of Gibraltar (unlike the Republic of Ireland in the case of Northern Ireland).
      As the Foreign Affairs Committee of the House of Commons has recognised and lamented in a comprehensive report, Spain is allowed by HMG and the EU to get away with impunity with systematic breaches of Gibraltar’s EU rights and her own EU obligations in her behaviour towards Gibraltar. Now these very long-standing breaches are being offered as reasons to justify a sovereignty deal that the people of Gibraltar do not want. The future of Gibraltar is secure, stable and prosperous without the need for a sovereignty deal with Spain against our wishes.
