Charter schools are drowning in the very sea of bureaucratic regulations and red tape they were supposed to escape, supporters say. And with money, personnel and other woes causing them to feel like sinking ships, their struggle to keep their schools afloat in Hawaii appears headed for the courtroom and other battlegrounds. "I think the courts are going to give short-term relief, but it has to be fixed at the Legislature," said Bryan Fitzgerald, legal counsel for Connections Public Charter School on the Big Island. But state officials say that while charter schools may be exempt from most laws, government agencies are not, and that is where conflict comes. "On one hand they say, 'Give us our independence ... but give us everything else that you've got, as well.' And it just doesn't work that way," said Board of Education member Donna Ikeda, the board's charter school committee chairwoman. Charter schools in Hawaii are publicly funded but are free from most laws and regulations except collective bargaining, health and safety, discrimination and federal policies. Schools are held accountable for student performance and funding through a contract or charter with the state.

July 17, 1980) Reversing the judgment of the district court, 9 ELR 20625 , the court of appeals rules that the Navy must prepare an environmental impact statement (EIS) in connection with the reconstruction of a weapons storage facility to accommodate nuclear weapons. Acepting as true appellees' contention that the Atomic Energy Act forbids disclosure of whether nuclear weapons are in fact stored or planned to be stored at the facility, the court rules that this constraint does not relieve the Navy from preparing an EIS that fully discloses the environmental consequences of the action without revealing classified information. Navy regulations permitting selective classification of sensitive portions of EISs can harmonize appellees' duties under the Atomic Energy Act with the requirements of the National Environmental Policy Act. March 13, 1979) ELR Digest Plaintiffs sought to enjoin use of a United States Navy munitions and nuclear weapons facility at the Pearl Harbor Naval Base near Honolulu. Plaintiffs, residents of Honolulu who use the areas adjacent to the new facilities for recreational and residential purposes, asserted violations of the National Environmental Policy Act (NEPA) for failure to prepare an environmental impact statement (EIS), the Endangered Species Act (ESA), and the National Historic Preservation Act (NHPA). In reply, Defense Department and Navy officials contended that they are excused from preparing an EIS due to a conflict between NEPA and the Atomic Energy Act and that they have complied with the ESA and the NHPA. The Navy did not submit an EIS because it would involve discussion of classified information regarding nuclear weapons.
