Impeachment: A primer
(AllPolitics, Sept. 14) If the House Judiciary Committee institutes impeachment hearings, it would then have to decide what constitutes an impeachable offense. The U.S. Constitution says a president can be removed from office if he committed "treason, bribery, or other high crimes and misdemeanors." It does not, however, provide any guidance as to what "high crimes and misdemeanors" are or what the burden of proof might be. Searchable U.S. Constitution Web site
A formal accusation
Impeachment is the act of formally accusing a public official of crimes or serious misconduct. Under the Constitution, the power to impeach lies with the House of Representatives. The Senate conducts any trial that might result from an impeachment. An official found guilty of impeachable offenses is subject to removal from office and disqualification from holding other federal posts.

When the House of Representatives approved two articles of impeachment on December 19, accusing President Bill Clinton of obstruction of justice and perjury in connection with his relationship with former White House intern Monica Lewinsky, lawmakers set the stage for a Senate trial of the president. Here are answers to questions about the impeachment trial, what rules govern the process, the history of the process and what roles various figures will play in the trial: Q: When was the last time the Senate conducted a presidential impeachment trial? A: The Senate has not dealt with the impeachment of a president in 131 years. The last time was the case of Andrew Johnson, a Democrat who became president following the assassination of Abraham Lincoln. Johnson was impeached by the House for firing his secretary of war against the wishes of Congress. The deeper issue was Republican opposition to Johnson's efforts to bring South back into the Union after the Civil War. In 1868, the Senate failed to remove him from office by one vote after a two-month trial. Q: When did the Senate impeachment trial of President Clinton begin?

The right to impeach public officials is secured by the U.S. Constitution
The Infamous Sixteen Since 1797 the House of Representatives has impeached sixteen federal officials. These include two presidents, a cabinet member, a senator, a justice of the Supreme Court, and eleven federal judges. Of those, the Senate has convicted and removed seven, all of them judges. Not included in this list are the office holders who have resigned rather than face impeachment, most notably, President Richard M. Nixon
The Small Fry
The first official impeached in this country was Senator William Blount of Tennessee for a plot to help the British seize Louisiana and Florida from Spain in 1797. The Senate dismissed the charges on Jan. 14, 1799, determining that it had no jurisdiction over its own members. The Senate and the House do, however, have the right to discipline their members, and the Senate expelled Blount the day after his impeachment.

The Impeachment of Andrew Johnson
Only one president in U.S. history has been impeached by the House of Representatives: Andrew Johnson in 1868. At his trial in the Senate, Johnson escaped conviction by a single vote. In the election of 1864, Abraham Lincoln, a Republican, chose Senator Andrew Johnson, a Tennessee Democrat, as his vice-presidential running mate. Lincoln believed that Johnson, the only senator from a rebel state to remain loyal to the Union, would help persuade Democrats to vote Republican. After Lincoln was assassinated, Andrew Johnson took the oath of office on April 15, 1865. Two profound questions faced the nation. First, under what conditions should the Southern rebel states be readmitted into the Union? Second, what rights should the freedmen, or ex-slaves, have? A little over a month after becoming president, Johnson began executing his plan for reconstructing the South. Johnson pardoned all rebels except Confederate leaders. He also restored all rebel property except for slaves. Finally, he authorized each rebel state to call a convention of white delegates to draw up a new constitution. Once completed, a new state government could then be formed, and the state could apply for readmission to the Union.

Previous Chapter Next Chapter Quote Fourth Circuit Court of Virginia was the jurisdiction Andrew Johnson wanted for the treason trial of Confederate President Jefferson Davis Military officials wanted to try him in their courts. The authorities debated over the jurisdiction for two years while Davis was imprisoned. Johnson knew a military trial would make Davis a martyr. Chase refused to hear cases in the Virginia Circuit while the State was still under the military government and not until the writ of habeas corpus was restored. When Chase finally sat at the Davis trial in November 1868 he approved Davis' lawyer's argument that the 14th Amendment that had recently gone into effect applied to Davis. In December Johnson issued a general amnesty. At the next session of circuit court, Chase discharged Davis on the grounds he was included in the pardon and could not be tried ex post facto.
Impeachment trial of President Andrew Johnson
At the only impeachment trial of a president in history, the Impeachment of Andrew Johnson for High Crimes and misdemeanors, (1868), Chase refused to let the Senate turn the hearings into a mockery of the law when he faced an angry mob of radical senators who wanted to limit the Chief Justice's power in the trial. Chase insisted and by cleverly out maneuvering the senators, he insured that the trial would be conducted with impartially and with the proper character of judicial process assuring the President a fair trial. The Senate knew if Chase didn't have his way, the Chief Justice could refuse to preside over the trial thereby violating the Constitution.
