    WASHINGTON - Hoping to quash the congressional impeachment process in its nascent stages, President Clinton in recent days discussed with Senate Majority Thomas A. Daschle, D-S.D., about organizing an effort to have Democratic senators sign a letter declaring that none of the allegations or evidence in the Monica Lewinsky investigation would merit impeachment, according to Democratic sources.
    Daschle discouraged the idea, which Clinton apparently first heard from another Democratic senator, and for now it has been shelved.
    The hope, as Democrats familiar with the discussions described it, was to get at least 34 Democrats - or more than one-third of the Senate - to declare up front that they would never vote to convict. Since two-thirds of the Senate must vote to evict a president, such a letter would make a House impeachment vote moot, for all practical purposes. Clinton, sources said, apparently hoped the letter could defeat the gathering momentum for a full impeachment inquiry in the House, which is set to authorize the process later this week.
    "This is an idea which was generated on the Hill which is not getting much traction, because it's premature," said a senior White House official.

    Bush and Company's Grab for a Blank Check We've been treated to some astonishingly vile images over the last two weeks: office workers hurling themselves into a hundred-floor-high abyss. A gaping, smouldering hole in the financial center of our greatest city. George W. Bush passing himself off as a patriot, even as he disassembles the Constitution with the voracious glee of piranha skeletonizing a cow. "There is no opposition party," Republican congressional leader Trent Lott chillingly announced as Democratic counterpart Tom Daschle watched in silent, cowed assent after Bush's speech to a joint session of Congress. And even if it's mainly the result of our pathetic desire to follow someone anyone in the aftermath of Sept. 11, there's little opposition out in the cities and towns across our vast continent: Bush's job-approval rating is hovering up there with puppies and sunny days. It may have seemed meaningless at the time, but now we know why 7,000 people sacrificed their lives so that we'd all forget how Bush stole a presidential election. And as it turns out, national amnesia was only the beginning.

    Introduction N o one could have ever predicted the bizarre ending to this election season six weeks ago. Rather than the President being removed from office, the Speaker of the House removed himself from office after the election. Elections are most often lost and they are rarely won because incumbents have the decided edge over challengers. The 1998 midterm elections, unlike the 1994 midterm elections, were characterized by relative contentment by citizens with incumbent members of Congress. The election itself did not produce an upheaval. The upheaval occurred after the election because the party controlling the White House gained seats in a midterm election, which rarely happens. There was no surprise that Republicans maintained their majority status in the House and Senate as a result of the election. The shock was that Democrats improved their representational standing in the House and did not lose any Senate seats. It was the first time since 1934 that the party controlling the White House gained seats in the House of Representatives in a midterm election.

    ABSTRACT
    In this Article, Professor Turley addresses the use of impeachment, specifically the Senate trial, as a method of resolving factional disputes about an impeached official's legitimacy to remain in office. While the Madisonian democracy was designed to regulate factional pressures, academics and legislators often discuss impeachments as relatively static events focused solely on removal. Alternatively, impeachment is sometimes viewed as an extreme countermajoritarian measure used to "reverse" or "nullify" the popular election of a President. This Article advances a more dynamic view of the Senate trial as a Madisonian device to resolve factional disputes. This Article first discusses the history of impeachment and demonstrates that it is largely a history of factional or partisan disputes over legitimacy. The Article then explores how impeachment was used historically as a check on the authority of the Crown and tended to be used most heavily during periods of political instability. English and colonial impeachments proved to be highly destabilizing in the absence of an integrated political system. The postcolonial impeachment process was modified to convert it from a tool of factional dissension to a vehicle of factional resolution. This use of Senate trials as a Madisonian device allows for the public consideration of the full rec-
