The Supreme Court now requires that public schools finance one-on- one nursing care for some disabled students. The voting was based on the case of a sophomore in Iowa, Garret Frey, a thriving quadriplegic teenager. He and his parents now need not worry about the thousands of dollars it will cost to keep him in his public high school because it's now the responsibility of Iowa's Cedar Rapids Community School District. This new law does not seem feasible for the National School Boards Association to accept. The funds for schools are already stretched as it is and the cost of covering the needs of students with severe disabilities may go over its limit. "At the current time, the public educational system in this country is not aquately funded to provide full medical services for approximately 17,000 students with severe disabilities," said the executive director, Anne L. Bryant. It's not reasonable for the country to expect public schools to fund the special attention disabled students need. Frey needs the attention that many of us only expect to see in a hospital catheter lab.

Some states, such as New Hampshire, simply weight all special education students the same in their formulas. This means that a student with a substantial physical disability has the same weight as a student with a minor reading disability if both students are enrolled in special education programs. Some states have created subcategories of special education students and provided each of those with a specific weight (e.g, South Carolina and Texas). Another approach is to weight a student based on his or her ability to spend time in a “regular classroom” (e.g., Iowa). This system provides the student a higher formula weight for the extra time he or she must spend outside of a regular classroom. A fourth approach is to provide all special education students with a single weight plus an additional weight based on the district’s financial need (e.g., New York). Garret Frey, the 16-year-old sophomore on a ventilator because of an accident that left him paralyzed, is not the issue, said Superintendent Lew Finch. The case is really about the federal government creating rules requiring schools to educate children who have disabilities, but not sending enough money to ensure they can afford it. If schools do not get more help, they might need to raise local taxes, Finch said. "This might be the case that opens a lot of eyes." Special education is one of the most emotional issues schools face, and one of their fastest-growing costs. States have long fought with local schools and the Education Department over costs. Now Republicans and Democrats in Congress are debating how much the federal government should help. Nearly 6 million children receive special education instruction and services costing $60 billion, about $5 billion of that from the federal government. About $55 billion comes from states and local districts, which follow strict rules stemming from the 1975 federal law covering special education.

The decision's immediate impact is certain: Iowa's Cedar Rapids Community School District must pay tens of thousands of dollars a year to provide nursing care for Garret Frey, a quadriplegic on a ventilator who is thriving as a high school sophomore. The ruling's broader impact is cloudier. The court's two dissenters said the decision "blindsides unwary states with fiscal obligations they could not have anticipated." But Justice John Paul Stevens wrote for the court that Congress wanted to "help guarantee that students like Garret are integrated into the public schools." Contacted at his Cedar Rapids school and told about his victory, Garret said: "It's going to help a lot of other kids, not just me and other kids in Iowa. It's going to help all over."
