The Supreme Court ruled yesterday that public school districts must pay for
one-on-one continuous nursing care for some disabled students, a decision
that could cost schools nationwide $500 million per year. The court's 7-2 ruling came in the case of an Iowa teen-ager who is a quadriplegic in a wheelchair and depends on a ventilator to breathe. The justices said the federal Individuals With Disabilities Education Act (IDEA) requires the school district to pay for Garret Frey's daily nursing care because it does not need to be performed by a physician. Public school officials said the ruling could overburden taxpayer-funded school budgets. Said Lew Finch, superintendent of the Cedar Rapids Community School District where Garret is enrolled: "This is a landmark case that's going to have a tremendous effect nationwide. ... Accommodations are determined by the IEP team and are documented in the student IEP. Adapted Physical Education (APE) ­ A diversified program of developmental activities, games, sports, and rhythms suited to the interests, capabilities and needs of children with disabilities who may not successfully engage in a regular physical education program. Age of Majority/Transfer of Rights ­ When a student with a disability reaches the age of 18, all rights accorded to a parent transfer to the student. The parent and student must be informed of the transfer of rights at least one year prior to the student’s 18 th birthday. Americans with Disabilities Act (ADA) ­ Federal law requiring accommodations for people with disabilities in the community and workplace. Asperger’s Syndrome - Was first described by German doctor, Hans Asperger, in 1944. Children with Asperger’s have a qualitative impairment in social interactions with marked delays in nonverbal behaviors (i.e., gesturing, facial expression, body posture); impairments in establishing peer relationships; absence of “spontaneous seeking to share enjoyment, interests or achievements with others”; and delays in social reciprocity.

The financial funds for schools all over the country will be significantly slimmer after the bill passed on March 3. The Supreme Court now requires that public schools finance one-on- one nursing care for some disabled students.
The voting was based on the case of a sophomore in Iowa, Garret Frey, a thriving quadriplegic teenager. He and his parents now need not worry about the thousands of dollars it will cost to keep him in his public high school because it's now the responsibility of Iowa's Cedar Rapids Community School District.
This new law does not seem feasible for the National School Boards Association to accept. The funds for schools are already stretched as it is and the cost of covering the needs of students with severe disabilities may go over its limit.
"At the current time, the public educational system in this country is not aquately funded to provide full medical services for approximately 17,000 students with severe disabilities," said the executive director, Anne L. Bryant.
It's not reasonable for the country to expect public schools to fund the special attention disabled students need. Frey needs the attention that many of us only expect to see in a hospital catheter lab.

Career Development Program
Since 1978, students with special learning needs have been enrolled in non-credit, community-based, pre-vocational and vocational training programs in Iowa Falls, Grinnell, Marshalltown and Tama. Nearly 25 years have passed, and while the format for meeting these special needs has changed, Iowa Valley Continuing Education is still assisting students of all ages meet their life skill development and vocational needs. Today, there are four IVCE Career Development Programs:

The three centers are staffed by longtime professionals who offer training to dependent adults in these areas: age-appropriate personal and social skills, communication, daily living, functional math skills, community awareness, exercise, leisure and recreational activities, and paid work. The students may be mentally/developmentally disabled, or mentally ill, and they function somewhat below the level of those who participate in sheltered workshops or others in supported work situations. Some states, such as New Hampshire, simply weight all special education students the same in their formulas. This means that a student with a substantial physical disability has the same weight as a student with a minor reading disability if both students are enrolled in special education programs. Some states have created subcategories of special education students and provided each of those with a specific weight (e.g, South Carolina and Texas). Another approach is to weight a student based on his or her ability to spend time in a “regular classroom” (e.g., Iowa). This system provides the student a higher formula weight for the extra time he or she must spend outside of a regular classroom. A fourth approach is to provide all special education students with a single weight plus an additional weight based on the district’s financial need (e.g., New York). On March 3, the U.S. Supreme Court issued a decision that may force Congress to re-examine the federal government’s obligation to serve students with disabilities.
In its 7-2 ruling in Cedar Rapids Community School District v. Garret F., the court held that the Individuals With Disabilities Education Act required the district to provide Garret Frey, a medically fragile high school sophomore, with the nursing services he needed during school hours. The youth was left a quadriplegic following a motorcycle accident at age 4 and now requires continuous nursing care.
A Broad Definition The dispute involves the Supreme Court’s interpretation of "related services" for students with disabilities under the IDEA. The court determined that the related services definition broadly encompasses those supportive services that "may be required to assist a child with a disability to benefit from special education."

    WASHINGTON The school district in Cedar Rapids, Iowa, had already overspent its special education budget by $1 million when the Supreme Court ruled it had to pay for one-on-one nursing for a student adding $30,000 a year.
    Garret Frey, the 16-year-old sophomore on a ventilator because of an accident that left him paralyzed, is not the issue, said Superintendent Lew Finch.
    The case is really about the federal government creating rules requiring schools to educate children who have disabilities, but not sending enough money to ensure they can afford it.
    If schools do not get more help, they might need to raise local taxes, Finch said. "This might be the case that opens a lot of eyes."
    Special education is one of the most emotional issues schools face, and one of their fastest-growing costs. States have long fought with local schools and the Education Department over costs. Now Republicans and Democrats in Congress are debating how much the federal government should help.
    Nearly 6 million children receive special education instruction and services costing $60 billion, about $5 billion of that from the federal government. About $55 billion comes from states and local districts, which follow strict rules stemming from the 1975 federal law covering special education.

    WASHINGTON Public schools must finance one-on-one nursing care for some disabled students throughout the school day, the Supreme Court ruled yesterday in a decision that may strain educational budgets across the nation.
    Voting 7-2 in the case of an Iowa teen-ager, the court said public financing is required under the Individuals with Disabilities Education Act because the federal law's exemption for "medical services" applies only when a doctor's help is needed.
    The decision's immediate impact is certain: Iowa's Cedar Rapids Community School District must pay tens of thousands of dollars a year to provide nursing care for Garret Frey, a quadriplegic on a ventilator who is thriving as a high school sophomore.
    The ruling's broader impact is cloudier.
    The court's two dissenters said the decision "blindsides unwary states with fiscal obligations they could not have anticipated." But Justice John Paul Stevens wrote for the court that Congress wanted to "help guarantee that students like Garret are integrated into the public schools."
    Contacted at his Cedar Rapids school and told about his victory, Garret said: "It's going to help a lot of other kids, not just me and other kids in Iowa. It's going to help all over."
