CJ Letter News on Criminal Justice Issues October 1998 CJ Letter - Back Issues New Sex Offender Civil Commitment Laws Follow Court Ruling Legislatures in Florida, Iowa, Missouri and South Carolina passed laws in 1998 providing for involuntary civil commitment of violent sex offenders following their criminal sentence. The U.S. Supreme Court paved the way for states in the 1997 Kansas vs. Hendricks ruling that upheld that state’s Sexually Violent Predator Act. Thirteen states now have such "sexual predator" laws, including Arizona, California, Illinois, Kansas, Minnesota, North Dakota, New Jersey, Washington and Wisconsin. The new Florida law passed as House Bill 3327 commits sexually dangerous individuals to the Department of Children and Family Services and also requires that those committed pay for all or a fair portion of subsistence costs, if they have the ability to pay. The Iowa law (Senate Bill 2398) gives the State Department of Human Services responsibility for control and custody of committed sexual predators, including evaluation and treatment costs. Criminal law of Michigan Territory, which governed neighboring Iowa County (now part of Wisconsin) was not extended west of the Mississippi to the "counties of Dubuque and Demoine" until 10/1 of that year, but O'Connor was tried and sentenced in an orderly manner several days after the crime by a jury of peers, and appeals were made to the governor of Missouri and to President Jackson, both of whom determined that they had no jurisdiction over the case. (Childs, pp. 363-66; Oldt, p. 447) 1838: From Governor Robert Lucas's first annual message to the Territorial General Assembly: "[T]he general conclusion [of 'some of the greatest statesmen and philanthropists of the age'] has been . . . that the general policy of all criminal laws should be to prevent crimes, rather than to inflict punishment, and that all punishments should be inflicted with a view to reform, rather than exterminate, the criminal. Code of Student Conduct: APPENDIX H: SEXUAL ABUSE Punishment of Perpetrators of Sexual Abuse Procedures for Reporting Sexual Abuse Sexual abuse occurs in epidemic proportions. This is especially true of "date rape" incidents involving college students. The Drake University policy on sexual abuse includes definitions, reporting procedures, prevention suggestions, criminal penalties and University sanctions. STATEMENT OF POLICY. Sexual abuse of students, faculty or staff is criminal behavior and is not tolerated at Drake University. It is the policy of the University to provide education to help prevent sexual abuse. Recommended measures are as follows: Inform faculty, staff and students of the procedures for reporting sexual abuse to the Des Moines Police Department and Campus Security. Educate faculty, staff and students as to the common sense practices which may enable them to avoid becoming victims of sexual abuse. Assure that Campus Security and University supervisors are aware of their responsibilities, the University's policy, the laws and potential liabilities when sexual abuse occurs.
