Iowa federal judge overturns state law barring corporate pork processors from owning own hogs By Jerry Perkins, Des Moines Register via the Agribusiness Examiner DES MOINES, Iowa, January 27, 2003 CropChoice news: A federal judge in Des Moines on Wednesday struck down an Iowa ban that prevents pork processors from owning hog operations, saying the state law violates the commerce clause of the U.S. Constitution. The ruling by Judge Robert Pratt in a case involving Smithfield Foods Inc., the world's largest pork producer and processor, drew immediate criticism from farmers and politicians. If the decision withstands an appeal, it would undermine decades of efforts in Iowa to protect small farmers from competition from conglomerates and it would open the way for further consolidation in agriculture. "This ruling can only be viewed as devastating to family farmers in Iowa," said Curtis Meier, a hog producer from Clarinda who is president of the Iowa Pork Producers Association. "The Iowa law, first adopted in 1975, was intended to allow packers to be packers and let farmers raise pigs."

Court of Appeals
The Iowa Court of Appeals, which was created in 1976, is an intermediate court. It hears cases assigned to it by the supreme court. Typically, it hears appeals in which the principles of law are settled. The Iowa Court of Appeals is composed of nine judges. Judge Huitink, Ireton, has served on the Court of Appeals since 1994. He was born in Orange City. Judge Huitink attended the University of Iowa for his undergraduate education. He graduated with his B.A. in 1974 and then went to Drake University Law School. After earning his law degree in 1976, he went into general practice and served as a juvenile court referee until 1988. At that time he was appointed to be a district court judge for the third district. Judge Huitink is a member of the Sioux County and Iowa State Bar Associations. He is married and has four sons. Clive's History
C live is an old community, but a young city, incorporated on October 9, 1956. Maps dated in the 1870's first show Clive as a small settlement clustered around the intersection of Walnut Creek, a railroad and a county road. The community was an early rail shipping point and coal mining area. It was platted on January 18, 1882 by the Union Land Company. Three of Clive's first buildings still remain:
  • Railway Depot at 86th Street and Swanson Boulevard, built about 1882.
  • Swanson Grocery, 8641 Swanson Boulevard (now a private residence) built in 1911.
  • Dobberthein Farm House, 8181 Harbach (now a private residence) built about 1897. Where the name "Clive" came from is under speculation. One theory is that the name "Clive" came from a British General, Robert Clive, who served in the late 1700's as administrator and founder of the British Empire in India. The other theory is that when the rail line was being constructed, there was a section gang foreman named "Clive" (unknown whether this was his first or last name). When a car at the main yard in Des Moines had been loaded with rails, ties, spikes, etcetera, the workers were told to get this car out to "Clive."

The primary purpose of accounting is to provide relevant information to both internal users (management) and external users such as investors, creditors, government, and the general public. Accounting is an integral part of the management of business and public organizations. Accountants, therefore, participate in planning, evaluating, and controlling the activities of the firm. Accounting is needed by external users in order to make investment decisions, grant or withhold credit, and, in the case of government, to collect revenue and gather statistical information. In order to provide useful information, accountants collect, analyze, synthesize, and report data in an understandable manner. We have previously considered the law in question and have determined that FCUs must comply with its registration and filing requirements. However, it is our opinion that certain other provisions of Chapter 536C and related provisions of Iowa Code Chapter 537 are preempted in their application to FCUs.     Retired effective Sep 22, 2002 Deputy Commander, 34 th Infantry Division Brigadier General Paul Wieck assumed duties as Deputy Commander, 34th Infantry Division on 24 October 1998. As Deputy Commander, he is responsible for all matters pertaining to support of the Division, and for the training and readiness of Iowa’s units assigned to the Division. The General’s active military service began when he was commissioned in the Regular Army from ROTC in 1973. He qualified and served in Air Defense Artillery, Ordnance and Field Artillery duty positions during six years of active duty, including assignments in the Southern European Task Force in Italy and III Corps Artillery at Fort Sill, Oklahoma. Prior to his current assignment Brigadier General Wieck served as Special Projects Officer and most recently as Assistant Adjutant General, Iowa Army National Guard. In that capacity, General Wieck was responsible for mobilization and readiness of the Iowa Army National Guard.
