Robert W. Pratt is a federal judge with a sense a humor. In his Jan. 22 opinion on Smithfield Foods, Inc. v. Thomas J. Miller, a lawsuit that pitted the giant integrated pork packer against Iowa's Attorney General, Pratt headlined sections of his written decision "These Little Piggies Went to Market," "These Little Piggies Stayed Home," and "These Little Piggies Cried Wee Wee Wee All the Way to Federal Court." Pratt's opinion, however, was anything but humorous to family farm advocates. In unambiguous language, Pratt junked Iowa's decades-old, anti-corporate farming law dead because "on its face, in its purpose, and in its effect (the law) unconstitutionally discriminates against out-of-state interests in favor of local ones." Iowa is the second state in eight months to have its corporate farm law tossed. Last May, South Dakota Federal Judge Charles B. Kornmann ruled that state's 1998 law, Amendment E, unconstitutional. An appeal hearing on his decision is scheduled for Feb. 10 in St. Paul, Minn. (Kornmann was busy last summer. In June, he struck down the national beef checkoff. That decision is under appeal, also.)

Iowa Cooperative Laws In General
Cooperatives, to be responsible to their owners and to the laws of the land, are formally organized under a specific law that fits their purpose for being. They are generally organized under some state law rather than a federal law and usually under a law in the state where their headquarters are located. These state laws permit a company to be created and to exist. Each of them describes the allowable nature, in a general way, of a company created under them. The company’s founders choose the law that fits their purposes best and file "articles of incorporation" with the state’s Secretary of State. If all is in order, the Secretary of State issues a charter, or some similar authorization, to show that the company is permitted to be created.
The company’s articles of incorporation are written by the company’s founders to describe the purposes and general structure of their particular company more specifically than the law does, but they must stay within the limits of the law. The founders also create a set of "bylaws" to even more specifically spell out how the company will function. The bylaws must conform to the provisions in the articles of incorporation. In Iowa, the co-op laws require that the cooperative company’s members must approve any changes to the articles of incorporation (as must the Secretary of State), but the bylaws may be changed either by the members or by the company’s board of directors. In some states, the board of directors may not change the bylaws without the approval of the members.

Child Support Background
The legal obligation of a parent to support a child began in the common law. "The duty of the parent to maintain his offspring until they attain the age of maturity is a perfect common law duty." Dawson v. Dawson, 12 Iowa 512 (1861). Today, child support is a statutory obligation. For many years, the amount of court-ordered child support in each case was in the court's discretion. Judges were guided by a few statutory considerations and a body of case law that had developed over the years. In 1987, the Iowa Supreme Court adopted, by administrative order, the state's first child support guidelines . The purpose of the guidelines was to try to provide predictability and statewide uniformity in court-ordered child support. These guidelines applied to temporary support orders.
