Selected Supreme Court Decisions The judicial branch is headed by the U.S. Supreme Court, which is the only court specifically created by the Constitution. In addition, Congress has established 13 federal courts of appeals and 95 federal district courts. The president has the authority to appoint federal judges as vacancies occur, including justices of the Supreme Court. The Supreme Court meets in Washington, D.C., and the other federal courts are located in cities throughout the United States.
The federal courts hear cases arising out of the Constitution, federal laws and treaties and maritime cases; cases involving foreign citizens or governments; and cases, in which the federal government is itself a party. With minor exceptions, cases come to the Supreme Court on appeal from lower courts. Most of these cases involve disputes over the interpretation and constitutionality of actions taken by the executive branch and of laws passed by Congress or the states.

The Judicial Branch of government is third and final branch of government. It's responsibility, through the United States' system of checks-and-balances, is to keep an eye on and to punish those who have committed federal crimes. Through the Federal Court's Home Page , you can view their hypertext document, Understanding the Federal Courts (PDF requires Adobe Acrobat Reader). This document will give you an overview of how the federal courts system works. It is divided into subjects which explain the Third Branch of Government, The Courts themselves, the Administration of the U.S. Courts, and a directory of the U.S. Courts of Appeals, U.S. District Courts, and a Glossary of Terms. Also through the Federal Court Home Page, you can read selected articles from the The Third Branch , the monthly newsletter of the federal courts.
The Federal Judicial Center is the federal courts' agency for research and continuing education. They offer publications regarding Guideline Sentencing, Voluntary Arbitration, Electronic Media Coverage of Federal Proceedings,a Manual for Complex Litigation, and more. The Federal Judicial Branch
The position of the United States courts in the nation's system of government is not difficult to understand when that system is viewed as a whole. The government of the United States is a dual onefederal (national) and state. The federal government has three separate branches: the legislative branch (Congress), the executive branch (the President, administrative agencies, and military services), and the judicial branch (the courts). The powers of the U.S. courts are limited first to the powers granted to the federal government by the U.S. Constitution and second to judicial powers. The courts cannot exercise powers granted by the Constitution to the legislative branch or the executive branch of the federal government. The Constitution ensures the judicial branch's equality with and independence from the legislative and executive branches. Although federal judges are appointed by the President with the advice and consent of the Senate and the funds for the operation of the courts are appropriated by Congress, the independence of the U.S. courts is provided for in three respects: o Under the Constitution, these courts can be called upon to exercise only judicial powers and to perform only judicial work.

Advanced Search The principle of judicial independence is central to a functioning democracy. Essentially, this means that the courts are shielded from politics or any other force that could compromise its ability to make fair rulings. Judicial independence includes two elements: decisional independence and institutional independence. Some further sources of information on judicial independence include: Despite the general success of efforts to shield the courts, the American Judicature Society ( www.ajs.org/cji/cji_whatisji.asp ) lists dangers which may threaten judicial independence. Some of these include:
  • Underfunding and workload Inappropriate threats of impeachment prompted by individual decisions Misleading criticism of individual decisions, which is compounded by the prohibition on judicial response

Judicial Branch The judicial branch hears cases that challenge or require interpretation of the legislation passed by Congress and signed by the President. It consists of the Supreme Court and the lower federal courts. Appointees to the federal bench serve for life or until they voluntarily resign or retire. The Supreme Court is the most visible of all the federal courts. The number of Justices is determined by Congress rather than the Constitution, and since 1869, the Court has been composed of one Chief Justice and eight Associate Justices.
