General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state. As Amici Curiae STATEMENT OF THE CASE The adult appellants are Negro citizens of the United States and of the State of Kansas while the infant appellants are their children eligible to attend and now attending elementary schools in Topeka, Kansas, a city of the first class within the meaning of Section 13-101, General Statutes of Kansas, 1949. Appellees are State officers empowered by State law to maintain and operate the public schools of Topeka, Kansas. On March 22, 1951, appellants instituted this action seeking a declaratory judgment and an injunction to compel the State to admit Negro children to the elementary publlic schools of Topeka on an unsegregated basis on the ground that segregation deprived them of equal educational opportunities within the meaning of the Fourteenth Amendment. In their answer, appellees admitted that they acted pursuant to the statute, that infant appellants were not eligible to attend any of the eighteen "white" elementary schools soley because of their race and color, but that they were eligible to attend the equivalent public schools maintained for Negro children in the City of Topeka. The Attorney General of the State of Kansas filed a separate answer defending the validity of the statute in question.

  • Local financial effort and funding choices should be expanded to permit local control of school district financial operations. The Board supports removal or an increase of the 25% cap on school district local option budgets and other local initiatives, such as, the voter-approved economic development sales tax for schools in Johnson County. The threshold for qualification for school facilities weighting and ancillary school weighting should remain at the current level. The Kansas State Board of Education and the Gubernatorial Task Force demonstrated leadership in outlining improvements needed in the financing of public schools. The Board supports the State Board and Task Force school finance efforts to increase the base level funding for all schools of Kansas.

The General Assembly that convenes Wednesday will usher in a new era, with new leaders, a new majority and new ideas. The agenda will be set by Republicans who say that government needs to tax less and do less so that individuals can do more. A more austere government, they say, will create a more prosperous Missouri. The Republican majority in both chambers the first since 1948 has promised to reshape state government's relationship with the public.

He paused, dropped his chin and mumbled, Siete. Wendell Phillips Elementary School teacher Philippe Vinaimont smiled and urged an answer in English. When the Kansas City third-grader hesitated, Vinaimont helped him count the plastic figures out loud. "Seven," Armando finally said with a shy smile. Vinaimont nodded, and then moved on with the math lesson. Across the Kansas City area, public schools are filling with Hispanic students, reflecting a nationwide trend. They come from Mexico, California, Texas and other states and countries, educators say. Many are fluent in English and are second- or third-generation Americans. But others speak little or no English and have been in this country for mere weeks.

    Serving Kansas' Schools and Students What is the KSHSAA?

    A private/non-profit association of accredited member schools, whose purpose is to administer a program of interscholastic activities, festivals, clinics and contests among member schools. The KSHSAA offers state championships in ten boys and girls' sports, and ten additional championships in music activities, debate, speech and drama, and scholars bowl. Of particular importance are efforts to elevate standards of good sportsmanship and to encourage growth of good citizenship among students and spectators.
    Who makes up the KSHSAA?
    The Association is comprised of more than 370 senior high and 427 middle/junior high member schools. Member schools must be accredited and are both public and private schools. How is the KSHSAA structured?
    The Association has a three-branch system of governance. The Executive Board (9 - 14 members) meets six times annually and is charged with making policy, conducting hearings and managing the affairs of the organization. Legislative authority to make rules and bylaws changes is vested in the seventy plus member Board of Directors. Members are school administrators, educators and local board of education members from throughout the state. Two members of the Kansas State Board of Education also serve. The Appeal Board acts as an impartial hearing panel in matters pertaining to rule interpretations.
