This new Internet censorship bill, the Child Online Protect Act (COPA, a.k.a. "CDA II") would establish criminal penalties for any "commercial" distribution of material deemed "harmful to minors". The numerous problems with this legislation include overbreadth, vagueness of definitions of key terms such as "commercial", an illegal attempt to force adults to give up privacy to excerise their right to read, prior restraints on publication, and a flawed "community standards" approach that would allow the most conservative jurisdiction in the US country to set the "decency" standards for all Web content nationally (indeed, globally). NVAA 2000 Text Chapter 22 Supplement Special Topics Section 7, International Issues in Victim Assistance Statistical Overview Recent studies indicate that of the estimated 9 million prostitutes working in India, 30% are children, a large number of whom have been trafficked from Bangladesh, Nepal, and Pakistan (ECPAT n.d.). It is estimated that 30% of the commercial sex workers in Cambodia are less than eighteen years of age, at least one-half of whom have been forced into the trade (Ibid) A recent study in Greece identified 2,900 minors in prostitutionmore than 200 were younger than twelve years old. Forty percent of the minors had been brought from regional countries suffering from conflicts and lack of social cohesion including Uzbekistan, Armenia, Albania, and Iraq (Ibid) Assistance to Families of Pan Am 103 Victims The bombing of Pan Am Flight 103 on December 21, 1988, over Lockerbie, Scotland, took the lives of 270 individuals from twenty-one countries, including 189 Americans. It was the worst terrorist atrocity in aviation history. Reserve funds from the Crime Victims Fund, available through the Victims of Crime Act (VOCA) set aside for victims of terrorism and mass violence have been drawn upon to assist families of Pan Am 103 victims. The U.S. Department of Justice, Office for Victims of Crime (OVC), in partnership with the Scottish government, is working to ensure that Pan Am 103 victims' families receive information and assistance throughout the trial process. Helping the World Combat International Crime By Bruce Swartz Deputy Assistant Attorney General Criminal Division U.S. Department of Justice The U.S. Justice Department is engaged in a variety of initiatives to help emerging democracies build stronger law enforcement and criminal justice systems as a strategy to curtail the activities of organized crime T he complex and growing threat of international crime requires a multi-faceted response. The U.S. Justice Department's response to international crime is threefold: investigation and prosecution of criminal activity; creation of a network of international agreements to facilitate cooperation in the fight against international crime; and training and technical assistance programs for foreign countries that are striving to improve their legal infrastructure and law enforcement capabilities, the focus of this article. The 1998 U.S. International Crime Control Strategy, a White House policy document, states: "Police and judicial systems in many developing countries are ill-prepared to combat sophisticated criminal organizations because they lack adequate resources, have limited investigative authorities, or are plagued by corruption. Many countries have outdated or nonexistent laws to address corruption, money laundering, financial and high-tech crimes, intellectual property violations, corrupt business practices, or (trafficking in humans.) Moreover, many governments have been slow to recognize the threat posed by criminal activities and increasingly powerful organized crime groups."

THE WHISTLEBLOWER PROTECTION ACT Recently, Contributing Editor David Pitts talked with Thomas Devine, legal director for the Government Accountability Project (GAP) , a nonprofit, nonpartisan public interest group that defends the rights of employees who "blow the whistle" on illegal or potentially harmful activities of government agencies. Below is the edited transcript. Mr. Pitts What is the Whistle Blower Protection Act of 1989, and why was it passed? Mr. Devine : It's a government statute that implements First Amendment free speech protection for government workers challenging betrayals of the public trust. The law protects disclosures regarding illegality, abuse of authority, gross waste, gross mismanagement or substantial and specific danger to public health or safety. Congress passed this law as part of a unanimous, bipartisan good-government mandate. In fact, leading sponsors of the legislation explained that it more properly could have been called the "Taxpayer Protection Act." And that helps to explain why the votes for the law were cast unanimously in 1989 and also unanimously strengthened in 1994. Congress seldom passes any significant law unanimously once, let alone twice. Mr. Pitts

Home Page Courts Contact Us APPELLATE DIVISION Functions of Appellate Division Whether decided in the Norfolk Superior Court or one of the District Courts, criminal cases often do not end with the verdict at trial. A defendant has the right to appeal his or her convictions to one of the appellate courts of the Commonwealth for a determination of whether the judge, prosecutor or defense attorney committed certain legal errors which prevented the defendant from receiving a fair trial. Appeals Following Conviction The main function of the Appellate Division is to handle these types of appeals, which are heard by either the Appeals Court of Massachusetts or the Supreme Judicial Court of Massachusetts, the highest court in the Commonwealth. The Appeals Court decides all post conviction appeals except those from convictions of first-degree murder - which by statute are automatically heard in the Supreme Judicial Court - and those which the Supreme Judicial Court elects to transfer from the Appeals Court. Should the appropriate appellate court determine that the defendant did not receive a fair trial, it may vacate the convictions and order a new trial, or in certain cases, enter a judgment for the defendant. Should the Appeals Court affirm the convictions, the defendant may file an application for further appellate review requesting that the Supreme Judicial Court review the case.
