Schuck This commentary originally appeared in the August 8, 2002 edition of The New York Times Advocates for the poor proclaimed a rare victory last week in their long campaign for more affordable housing in the suburbs. They hailed the latest court decision upholding New Jersey's so-called Mount Laurel doctrine, a set of rules designed to open suburbia to low-income families. But if past is prologue, the ruling by the New Jersey Supreme Court will mainly benefit builders of mid-priced and luxury homes. For more than three decades, the court has tried to prevent New Jersey suburbs from using zoning laws to exclude the poor. The goal is admirable, and the court's legal solution has attracted national attention. But as other states and municipalities have learned, a judicial remedy is not the best tool for reforming housing markets. Instead, the lesson to be learned from New Jersey's experience is that the most effective way to enable low-income families to live in better communities is for government to directly subsidize the poor who rent housing. The Mount Laurel doctrine began more than 30 years ago. In 1971, a group of low- and moderate-income families sued Mount Laurel, a growing suburban township in New Jersey, claiming that its zoning practices excluded them from the community in violation of the state constitution's provision requiring the state to "promote the general welfare."

April 9, 2003 Ruling on Housing Law a Blow to Battered Women Run Date: 03/31/02 By Tom Schram WEnews correspondent A Supreme Court affirmation of a federal housing law intended to root out violent drug crimes in public housing projects spotlights an unintended side effect of the guidelines: the evictions of women who report domestic violence. DETROIT (WOMENSENEWS)Aaronica Warren was battered, bruised and bleeding, the result of a beating she had just taken from her ex-boyfriend. It was Leap Year Day, Feb. 29, 2000, and she was about to take a leap of her own. Warren picked up the phone and called the police. Eight days later, under a law that requires authorities to hold eviction hearings for public housing tenants whenever any resident or guest of the home is arrested for drug or violent crimes in or near the residence, Warren received an eviction notice, the result of her plea to police in the Detroit suburb of Ypsilanti to protect her from the man who was beating her. "I asked myself, many times, 'How could the city of Ypsilanti allow the enforcement of a policy that forces battered women and their babies into homelessness?'" said Warren, now 23 and the mother of a 3-year-old son. The Supreme Court on Tuesday upheld the Anti-Drug Abuse Act of 1988 that produced Warren's notice and thousands like it. Though the guidelines, commonly referred to as the "one-strike" law, were intended primarily to root out drug-related violence in federally subsidized housing projects, the law has unintentionally put battered women at risk of losing their homes, allowing housing officials to evict any public-housing resident or visitor who has been convicted of a felony that occurred there or nearbyas well as others who live in the household.

Students lend helping hand to nonprofit groups Adam W. Lasker Chicago Daily Law Bulletin October 25, 2002 The University of Chicago Law School has expanded its clinical programs to help various organizations build houses for low-income residents. The school's Edwin F. Mandel Legal Aid Clinic, established in 1957, now gives second- and third-year students hands-on training in transactional legal matters including securing loans, acquiring real estate and getting building permits for nonprofit groups dedicated to making affordable housing available in Chicago neighborhoods. The clinic already had programs focused on criminal and juvenile justice, employment discrimination, mental health law and police accountability. This past summer, a new clinical professor began recruiting clients for the Irwin Askow Housing Initiative, and this semester six students are earning class credit for helping manage the clients' legal transactions. "It fits with our notion of expanding or varying our clinical programs in ways that do socially desirable things and educates our students," Saul Levmore, dean of the law school, said of the new initiative.

The housing needs vary according to the specific needs of each individual. There is currently not a good assessment available to assess the housing needs of people with disabilities. Many individuals who need accessible affordable housing receive their income from Supplemental Security Income (SSI) which amounts to less than $500 per month. Being low income presents another barrier to this issue. Issues and Recommendations Issue 1: Addressing Housing Needs. The Department of Housing and Community Affairs should develop a strategic plan to provide affordable housing and community support services. It is critical that the Department employ a fair share strategy with regard to allocation of housing and community support services resources. Data regarding the housing needs of persons with disabilities and other vulnerable populations must be included in allocation plans.
