Housing Advocacy The Housing Advocacy Clinic is an innovative collaborative effort between New College School of Law and Northern California’s largest legal aid provider, Bay Area Legal Aid (BALA) This innovative program places third and fourth year New College law students in our on-campus clinical offices which we share with BayLegal, to provide direct representation to low income clients facing the imminent threat of a loss of their housing. The clinic represents defendants in Superior Court unlawful detainer actions, provides assistance to clients in Rent Board proceedings, advocates on behalf of tenants with habitability defects and in fair housing matters, and provides counseling at the San Francisco Tenants Union. How You Can Help HISTORY OF THE ASIAN LAW ALLIANCE In 1975, several of the founding members of the ALA began to investigate the possibility of starting a community law office similar to the Asian Law Caucus which had been founded in Oakland in 1972. Our main challenge was convincing people that there was a significant Asian/Pacific Islander community in need of legal services. Two roadblocks stood in our way. The first was the dearth of research statistics to prove that an identifiable Asian/Pacific community existed. The second was the popular stereotype that Asian-Americans were a "model minority" who did not need social assistance. We determined that we had to gather evidence to support the contention that the "model minority" stereotype had overshadowed the existence of a sizable Asian Pacific population that did not have access to the legal system. As volunteers, we conducted extensive outreach by speaking with many community leaders, human service providers, and members of the Asian American community itself who needed our services. Staffing the Information and Referral Project that had just been initiated by the San Jose Japanese American Citizens League provided us with a base from which to conduct our research.

Stillwater Housing Authority It is the mission of the Stillwater Housing Authority to promote adequate and affordable housing, economic opportunity and a suitable living environment free from discrimination. The concepts surrounding Housing Authorities have been with us since during the late 1930’s, and in the years that followed, the housing programs that were activated on the federal level were adopted by individual states. Oklahoma adopted legislation in 1965 and, as a result, passed the Oklahoma Housing Act that same year. Stillwater residents started to realize the need for a local Housing Authority in the late 1960’s, but chose to initiate an Urban Renewal Program as an initial step toward the improvement of its residential neighborhood in 1970. In the years immediately following this action, as Stillwater’s economic and social base started a rapid expansion, the residential needs of the Stillwater community also experienced shortages in available housing units due to increasing demand placed on the market for all types of housing. This housing shortage, combined with inflation, higher utility rates, and an increase in the number of retired persons, prompted the City of Stillwater and its Housing Advisory Board to analyze the housing needs of the community. As a first step, the city conducted a City Services Evaluation Survey in January 1977. By using direct mailing and neighborhood meetings, the city was told by over 1,000 citizens that housing, especially for the elderly, should be expanded.

BLUMNER Can the racism of public speakers at a city council meeting be imputed to the subsequent actions of the council? On Tuesday, the U.S. Supreme Court will hear arguments in a case asking that very question. The case has received little attention but it could have broad implications for the right of the public to speak freely at public meetings. When the Buckeye Community Hope Foundation bought some property in 1995 in the city of Cuyahoga Falls, Ohio, in order to put up low-income apartments, not every city resident was tickled with the idea. In the town of about 50,000 people near Cleveland, a handful of residents expressed their concerns at series of public meetings. They objected to the way the 6-acre, 72-unit apartment project would change the character of their neighborhood with comments like: "there will be a different class of people living there," as well as explicit statements about an increase in drugs, crime and unsupervised children. It was no secret that African-American families would disproportionately benefit from the planned housing. Despite the criticism, city officials in Cuyahoga Falls approved the project. But a group of residents, consistent with the town's charter, obtained the signatures necessary to send the site plan before voters in a referendum. While this process was under way, the city denied the foundation a building permit to start work.

Housing Income Education Civil Rights Homelessness and ... Poverty in America Housing The lack of affordable housing is a primary cause of homelessness. The Law Center's Housing Project seeks to impact homelessness by using education, advocacy, and litigation to increase the supply of decent, affordable housing across the United States. Ensuring Access to Vacant Federal Property: Through national litigation and monitoring work, the Law Center has advocated for conversion of federal property worth over $83.5 million into housing, job training, and child care facilities for homeless people. These sites serve more than 17,000 homeless people annually. Helping to Increase Housing Through Enforcement of Civil Rights: Through advocacy and legal consultation, the Law Center helps local groups to combat Not-In-My-Back-Yard (NIMBY) opposition to siting of housing for homeless persons. The Law Center has issued two reports documenting NIMBY impact on housing and services for homeless persons, discussing Fair Housing Act protections for siting of such facilities, and recommending constructive steps to avoid or reduce NIMBY opposition. East Bay Community Law Center Collaborative Partnerships One of the primary strengths of EBCLC is our ability to effectively collaborate with other human service agencies and governmental entities. For the past seven years, we have been an active participant in several innovative partnerships. Access to HIV medicines literally is a life or death issue for the millions of HIV infected individuals living outside the developed world. The East Bay Community Law Center’s HIV/AIDS Law Project has collaborated with the Human Rights Clinic at Boalt Hall School of Law, and the Samuelson Law, Technology, and Public Policy Clinic at Boalt Hall to assist the AIDS Coalition for Care, Education, and Support Services, a Sri Lankan non-governmental organization to increase access to HIV medications in Sri Lanka. The three UC Berkeley law school clinics have worked with the AIDS Coalition to develop a model program for Anti-retroviral (ARV) distribution and treatment in Sri Lanka. The clinics have adopted a multi-facetted approach to this problem and have employed a human rights model as a tool for policy development. In addition, the clinics have provided legal advice on importing and distributing affordable ARVs in compliance with international intellectual property agreements such as the Trade-Related Aspects of Intellectual Property (TRIPs). Students from the three clinics produced a Memorandum Addressing the Need for a Treatment Agenda that sets forth a proposal to provide HIV medicines in Sri Lanka. The clinics and their partners recently submitted this document to the Sri Lankan Ministry of Health and the World Bank in the context of a pending funding proposal from Sri Lanka before the international financial institution.
