March 5, 2003 As this Commission moves toward issuance of a final report, committees of the Congress are just beginning to review the outlines of an Administration proposal to restructure the Medicaid program. The sharp debate provoked by that planeven among the nation's governors suggests that Congress and the Administration may need guidance in the months ahead in considering future directions for the Medicaid program. We believe this commission should be among the voices offering that guidance. As you know, the Medicaid program is a vital safety net for people with mental illness, funding approximately 50 percent of state and local spending on mental health services. Many of the services and benefits that Medicaid covers enable individuals to remain in their homes and communities, and avoid costly institutionalization.

Housing Discrimination Law Project,
Legal Aid Society of Minneapolis Housing and civil rights advocates can use federal civil rights requirements to influence government agencies' implementation of housing programs and increase housing choice for protected classes and low-income tenants. The following illustrates that cross-specialty advocacy in conjunction with work by community allies has helped get civil rights-oriented changes in the administration of Low Income Housing Tax Credit (LIHTC) and other tax-advantaged housing in Minnesota. For the past several years the Legal Aid Society of Minneapolis' Housing Discrimination Law Project (HDLP) has worked on Analysis of Impediments (AI) and Consolidated Plan ("Conplan") issues with several local jurisdictions. The Conplan is required of recipients of Community Development Block Grants and other funds from the U.S. Department of Housing and Urban Development. It includes the obligation to conduct an AI to fair housing and develop an action plan to address the impediments. It also includes a certification that the jurisdiction affirmatively furthers fair housing. The AI and Conplan of the Minnesota Housing Finance Agency (MHFA), the "lead agency" among several state agencies, has been one of targeted by HDLP's work.

Introduction to the Project
The Southern Oregon Fair Housing Project, sponsored by the Eugene-Springfield-Lane County Community Housing Resource Board, is a HUD funded effort to prevent discrimination in housing based on the federal Fair Housing law. NIMBY is, essentially, an individual or community resistance to the siting of low cost housing, services or group homes near that individual or in that community. HUD asked the Fair Housing Project to develop models to prevent NIMBY. The Fair Housing Project asked the Whiteaker Community Council, at the regular meeting in March 1998, for volunteers to develop an IMBY planning team and construct a model to increase neighborhood input into these planning and siting issues. This paper is the draft of a set of values, created by the team, regarding low cost housing, services and group homes in the Whiteaker neighborhood. We offer it as a point for the developmentof discussion.

Population
Although current statistics are not available, the 1990 census indicates that the Whiteaker area is both more diverse and less prosperous than other areas of Eugene. Whiteaker is densely populated with 4.5% of the city's residents. Whiteaker's Hispanic population of 7.99% is significantly higher than the 2.87% found in other areas. According to a 1992 report in the Eugene Register Guard, Hispanics were under reported in the census and may actually comprise as much as 16% of the Whiteaker population.

Housing Trust Fund Program (HTF)
Chapter 67 of the Laws of 1985 created the Housing Trust Fund Corporation (HTFC), a public benefit corporation which administers the Low-Income Housing Trust Fund Program (HTF). The Housing Trust Fund Program was established under Article XVIII of the Private Housing Finance Law to help meet the critical need for decent, affordable housing opportunities for people of low income. The Corporation, under the direction of a Board of Directors chaired by the Commissioner of the Division of Housing and Community Renewal (DHCR), receives staff and administrative support from DHCR. HTF provides funding to construct low-income housing, to rehabilitate vacant or under-utilized residential property (or portions of a property), or to convert vacant non-residential property to residential use for occupancy by low-income homesteaders, tenants, tenant-cooperators or condominium owners. HTF can also provide seed funding to eligible non-profit applicants who need financial assistance in developing a full HTF application. Since 1985, HTF has received annual appropriations generally of $25 million; approximately one and one-half percent of each appropriation has been used for administration of the program by the State. A one-time High Cost Areas appropriation of $2 million was made in fiscal year 1987-88. Since 1987, HTF has been part of DHCR's Unified Funding Process.

NOCA Low-Income Housing Credit Program
  • The New York State Division of Housing and Community Renewal (DHCR) announces the availability of federal tax credit under the Low-Income Housing Credit Program (LIHC) which is authorized under Section 42 of the Internal Revenue Code.
    DHCR expects to have approximately $24 million available for LIHC reservations. The maximum amount of annual tax credit allocation per application that may be requested is $1.5 million. Of the $24 million available, up to $2 million may be made available for preservation projects as defined in DHCR's Low-Income Housing Credit Qualified Allocation Plan (QAP) dated April 17, 2001. Additionally, an amount of up to $2 million may be made available for redevelopment of public housing which has met the conditions for approvals required under the New York State Public Housing Law.
    Applications for LIHC must be delivered to DHCR by 5:00 p.m., March 24, 2003 at:

Search LSEM HUD Honors LSEM with Best Practices Award In 2000 LSEM was presented a HUD Best Practices Award for its work in establishing a Fair Housing Center to curb housing discrimination in Genesee County and the City of Flint. LSEM was one of 12 local winners who received awards. The awards were presented by James Sutton, Senior Community Builder, at a ceremony held at the new Flint HUD office. He stated "I am extremely proud of our Best Practice Award Winners and the positive impact their programs have made thus far in our communities." In addition to the HUD award, LSEM and other award winners, were acknowledged with a special certificate issued by Congressman Dale Kildee. This award was an acknowledgement not only of LSEM's work, but also of the foresight shown by the Charles Stewart Mott Foundation in taking the lead in addressing fair housing by providing initial funding for establishing the Fair Housing Center. It was also an opportunity for LSEM to recognize its ongoing partners Genesee County and the City of Flint, which took the initiative to work with LSEM on this project and to commit funding to its success.

Housing Crisis for Seniors in Los Angeles
Finding affordable housing and dealing with the eviction of long-term senior tenants are among the most difficult problems currently affecting elders and senior centers in the Los Angeles area. Several elements contribute to the current housing crisis for seniors: A shortage of affordable apartments, Rising market-rate rents, Rent control laws (Los Angeles, Beverly Hills, Santa Monica, West Hollywood) In Los Angeles, the law prevents landlords from raising rents more than 3% per year until a tenant moves out. The law also allows landlords to evict tenants in order to make repairs of $10,000 or more per unit. It has become increasingly profitable for landlords to consider this option to replace long-term tenants with low rents. Changes in federally subsidized housing programs that make it easier for landlords to stop participating in them.

(Early in 2000, then-commissioner Steve Minn of the Department of Commerce nominated the Legal Services Advocacy Project (LSAP) to participate in an official consumer advocate role in the National Association of Insurance Commissioners (NAIC) proceedings. NAIC quarterly meetings involve Insurance commissioners, staff, industry representatives and a handful of consumer advocates in activities that range from drafting model legislation and rules to compiling white papers on any number of insurance-related subjects. As a result of LSAP's participation at the NAIC meetings, LSAP began to take a closer look at the kinds of data that the state requires insurance companies to collect concerning the availability of insurance in low-income communities.) Before approving a mortgage application, lenders generally require property insurance to secure the value of the property underlying the mortgage loan. Insurance is also required for homeowners who want to refinance or obtain home improvement loans for their homes. Thus, persons who are unable to acquire homeowner's insurance are essentially unable to obtain a mortgage.

Fair Housing Protection In Santa Rosa it is illegal to discriminate based on race, color, religion, national origin, sex, marital status, the number and presence of children, age or handicap. Complaints may be made by calling 543-3230. Please have the address you are reporting ready, and be prepared to leave your name and telephone number so we may contact you for additional information. Anonymous complaints are investigated only if they constitute an immediate danger. Your complaint will be investigated to see whether it is in violation of City regulations. The City of Santa Rosa does not handle problems involving leases, rental agreements, security deposits, or evictions. You may call Fair Housing of Sonoma County (FHSC), 579-5033, regarding those types of problems. If you are in doubt as to the nature or type of complaint that you have, please call our Building Division, 543-3230 for assistance in any substandard housing-related matter.

Do not be afraid to just pick up the phone and call. (Of course, some landlords may retaliate for getting the government involved. This is probably illegal so long as you are caught up on your rent, but you still will have to deal with this problem as well.
