Special Education The Special Education Office is both a state and federal program. Tasks includes accreditation of and technical assistance to local education agencies and state supported educational programs for compliance with the "Standards for Excellence for New Mexico Schools;" the implementation of federal and state statutes and regulations; and the collection and review of information for federal and state revenue distribution. Additional responsibilities include developing and recommending the adoption of state legislation; recommending changes to compliance regulations, policies, and procedures for implementation of special education programs; providing leadership and technical assistance to local education agencies, state supported educational programs, regional center cooperatives (RCCs), and regional education cooperatives (RECs); and collaborating with programs and services within the State Department of Education, within state government, and with other schools and communities throughout the state through local long-range planning. Another major responsibility is application for federal funds under the Individuals with Disabilities Act (IDEA). Activities specific to IDEA include the awarding of single and consolidated IDEA subgrants; establishing RCCs and RECs; cooperative agreements, applications, and administration of IDEA related projects including programs for infants and toddlers with disabilities; preschool programs for children with disabilities; school-to-work transition; assistive technology; complaint and due process procedure management; competitive subgrants; preschool demonstration sites; tuition stipends to support students in teacher training institutions; mental health services; multicultural education; student nutrition, and related services including transportation and inclusive education.

Policy Framework for Private Postsecondary Licensure
A fundamental aspect of the New Mexico Commission on Higher Education's mission is the responsibility to provide statewide leadership for a coordinated system of higher education for our citizens. To that end, the Commission has articulated a vision of "high quality, student centered education and training delivered efficiently throughout the state at higher education campuses, learning centers, homes and businesses." As part of the coordinating responsibility, the Commission is also responsible for the licensure and oversight of certain private post-secondary institutions operating in New Mexico. In order to effectively carry out these responsibilities, it is the intent of the Commission to fulfill certain policy objectives on behalf of the citizens of the State. Three significant policy objectives direct the Commission's oversight responsibilities and licensure process. The Commission recognizes the important role private post-secondary institutions play in the delivery of quality educational services to the citizens of New Mexico.

Biography
Robert H. Pasternack serves as Assistant Secretary for Special Education and Rehabilitative Services, the principal adviser to the U.S. Secretary of Education on all matters related to special education and rehabilitative services. Prior to being sworn in, Mr. Pasternack served as State Director of Special Education for the New Mexico State Department of Education since 1998. As state director, Mr. Pasternack led the development and implementation of state regulations for special education and created a variety of statewide initiatives designed to improve results for students with disabilities, including dropout prevention; a statewide inclusion initiative; research?based professional development; research?based screening and assessment in reading; entrepreneurship programs; mental health in the schools; and various programs targeted toward low-incidence disabilities. Mr. Pasternack was chief executive officer of New Mexico's first licensed Comprehensive Children's Community Mental Health Center from 1993 to 1998; superintendent of the New Mexico Boys' School from 1990 to 1993; and a school psychologist from 1980 to1993. He also started New Mexico's first Residential Treatment Center in 1978.

March 28, 2002 I am Kevin Jewell, a Policy Associate with the Consumers Union Southwest Regional Office, and lead researcher on Consumers Union SWRO's Manufactured Housing Project. I will be commenting on behalf of Consumers Union regarding proposed changes to the down payment and deposit rules, section 14.12.2.20 of the New Mexico Administrative Code. Consumers Union is a non-profit membership organization dedicated to providing consumers with information, education, and counsel about goods, services, health and personal finance. Consumers Union also initiates and cooperates with individual and group efforts to maintain and enhance the quality of life for consumers. Consumers Unions' income is solely derived from the sale of Consumer Reports, its other publications, and from noncommercial contributions, grants and fees. Consumers Union has advocated for improvements in the construction and sale of manufactured homes for over 25 years, starting with our work on the 1974 federal legislation that created the HUD code. Most recently, we launched a two year project to study equity building for low income manufactured home buyers. Homeownership is a national priority. Buying a home buys not just shelter, but a stake in the community and an opportunity for a family to build equity. Homeownership is a well-worn track up the economic ladder for families and communities alike.
