  • Introduction
  • As education moves increasingly from the realm of books and papers to instructional technology, questions have arisen about the proper use of this new technology. Two critical issues that have emerged are commercialism associated with the use of computers and the internet in the classroom and equal access to such technology for all students, regardless of parents' ability or willingness to pay. This memorandum provides a general legal framework within which the use of technology should be evaluated. It is not intended to be an exhaustive legal analysis of this complex subject. Rather, as with any important policy decision, school administrators and boards of education should carefully review these issues with the guidance of your legal counsel before adopting or implementing technology plans.
  • Commercialism
  • Regents Rules . Part 23 of the Regents Rules prohibits commercialism in public schools. Specifically, §23.2 provides that boards of education cannot enter into contracts, agreements or arrangements in exchange for a promise to permit commercial promotional activity on school premises.     The language department promotes and encourages the teaching of German as a foreign language in primary and secondary schools, universities and adult education institutions. We provide support services for teaching German as a foreign language, supply information on new methodology, materials, examinations and language promotion, including up-to-date information on all aspects of life in today’ s Federal Republic of Germany. We also arrange in-service training seminars and workshops on methodology, didactics and German studies (e.g. history and culture) locally in collaboration with other educational institutions as well as in Germany. The Goethe-Institut has 127 branches in 76 countries, including 15 teaching centers in Germany, enabling us to maintain a comprehensive network of contacts in the Ministries/Boards of Education, professional German teaching associations, universities, technical institutes, and experts on German as a foreign language.

    Back To Basics There was a quiet coup at 110 Livington Street this summer. In early June, the city's public school system underwent its most dramatic overhaul in more than three decades. Mayor Michael Bloomberg regained control over the Board of Education, and oversaw the demise of thirty-two community school boards. John Fager, who teaches at an alternative high school in Manhattan, is thrilled. The recent bill, which was passed by the State Legislature in June, reverses what he sees as a thirty-three year mistake: the Decentralization Act of 1969. A self-described pain-in-the-side of the Board of Education, Fager started teaching in 1968, the same year that the controversy over community-based control first erupted. At the time, a coalition of activists, former civil rights leaders and representatives from the city's growing Hispanic population were fighting to abolish the Board of Education and replace it with local community boards. They hoped that a decentralized system would be more responsive to the city's needs. The idea gained the support of Mayor John V. Lindsay, and in 1967, as part of an experiment in community control, three district boards were formed and allowed to break away from the central administration. But when one community board fired 19 faculty members in 1968, over 90% of teachers citywide went on strike. Fager, who was teaching at P.S. 175 in Harlem that year, remembers the period as "devastating to the city. People were expected to choose between the union and serving the community and it just ripped apart the schools."
