SPECIAL EDUCATION TIMELINES IN PA There are several steps to the PENNSYLVANIA SPECIAL EDUCATION SYSTEM. Timelines are included in state law to insure that school districts complete each step promptly. Please note that some timelines are in calendar days, while others are in school days; that is, days in which the schools are open. If you find that your district does not follow a timeline, contact the special education director and discuss the problem. If you cannot get your school district to comply, you can file a complaint with the Division of Compliance, Bureau of Special Education, 333 Market Street, Harrisburg, PA In some cases, you may have the right to receive compensatory services for your child if the violation is serious. THE PRE-SCHOOL SYSTEM. For children ages 3 to 5: All evaluations must be completed and a copy of the report given to the parents within 60 calendar days of the parents’ consent.

The Parents Involved Network of Pennsylvania ( PIN ) indicates that on February 14 the Pennsylvania House of Representatives Education Committee voted 12-12 to approve/disapprove the new Pennsylvania Special Education Regulations (Chapter 14). Because there was a tie, they will make no comment to the Independent Regulatory Review Commission (IRRC). The information below, provided by PIN, reports on the status of the proposed regulations.
Next Steps
The PA Senate Education Committee will now review the regulations, followed by the IRRC.
Main Issues
The new special education regulations eliminate many protections for students with disabilities, while making the regulations difficult for non-attorneys to read or use. Particularly, class size limit restrictions have been removed and advocates may no longer represent families at Due Process Hearings.
What You Can Do
Make sure your state senator, the senators on the PA Senate Education Committee, and the IRRC know your concerns regarding changes to Chapter 14, which regulates how special education occurs in Pennsylvania. The Pennsylvania State Board of Education promulgates regulations through a regulatory process, which includes the publication of proposed rules in the Pennsylvania Bulletin. After comments and revision, the State Board gives approval to the regulations but the Independent Regulatory Review Commission, the House and Senate education committees, and the office of the Attorney General of Pennsylvania must still approve the regulations. When the regulations have been given final approval they are published in the Pennsylvania Code in volume 22. These regulations are binding on the Pennsylvania Department of Education and the school districts of the Commonwealth. See and
Each regulation is placed in the appropriate chapter of volume 22 and can be located by using a citation, which includes the section of the chapter in which the regulation is located. For example, regulations concerning students are placed in Chapter 12. The section of Chapter 12 dealing with "Corporal punishment" is § 12.5. Jennings offers a full range of educational programs. A unique attraction at the center is its relict prairie, which includes the spectacular and well-known prairie flower, the blazing star. The relict prairie ecosystem is rare in Pennsylvania. Visitors should try to visit in late July or early August when the pairie is in full bloom. The Jennings Environmental Education Center, Butler County, is approximately 300 acres. It is managed by the Pennsylvania Department of Conservation and Natural Resources, Bureau of State Parks. The office is open from 8 a.m. to 4 p.m. Monday through Friday. The grounds are open from 8 a.m. to sunset, seven days a week for hiking and other nature related activities. Weekend and evening programs may be scheduled during each month. The environmental education center will be staffed when a weekend or an evening program is offered. Please check the newspaper, bulletin boards and program announcements for weekend program dates. Goals of the center are to protect the fragile natural ecosystems, manage the center's resources and educate the public in various aspects of ecological responsibility through environmental education and interpretive programming.
