How to Apply for a Pardon
State of California Office of the Governor Statement of Philosophy A Governor's pardon is an honor usually granted only to individuals who have demonstrated a high standard of constructive behavior following conviction for a felony, or in some cases for certain specified misdemeanor sex offenses. A pardon will not be issued unless it has been earned. Obtaining a pardon is a distinct achievement based upon proof of a useful, productive, and law-abiding life following conviction. It is a worthy and admirable goal, requiring sincere effort and commitment. In accord with the above philosophy, pardon applications will not be considered unless an applicant has been discharged from probation or parole for at least ten years and has not engaged in further criminal activity during that period. While the receipt of a Certificate of Rehabilitation will be considered in evaluating a pardon application, it is but one factor and is not the sole determinant.

Persons Who Are Inadmissible to Canada
Persons who have been convicted of a CRIMINAL OFFENCE in ANY COUNTRY may be INADMISSIBLE TO CANADA as a result of their criminal record. Even persons who do not require a Visa to enter Canada may still be refused permission to enter Canada if they are MEMBERS OF AN INADMISSIBLE CLASS. INADMISSIBLE CLASSES: Members of Inadmissible Classes include those who have been convicted of MINOR OFFENCES (including shoplifting, theft, assault, dangerous driving, unauthorized possession of a firearm, possession of illegal substances, etc.), or of INDICTABLE CRIMINAL OFFENCES (including assault with a deadly weapon, manslaughter, etc.). As well, those who have been convicted of DRIVING WHILE INTOXICATED (DWI) are considered Members of an Inadmissible Class. Driving while under the influence of alcohol is regarded as an extremely serious offence in Canada. Those who have received TRAFFIC VIOLATIONS (including parking/speeding tickets, etc.) and other minor violations (i.e. littering, etc.) most likely will NOT be prohibited from entering Canada. Similarly, those who have JUVENILE CONVICTIONS (convictions for crimes committed while under age 18) most likely will NOT be prohibited from entering Canada unless they could have been tried as an adult for their offences.

Pardons serve
useful purpose
GOVERNOR Cayetano's pardon of Thomas Foley set off a torrent of public comment about the general issue of pardons in Hawaii. Such a discussion could be worthwhile were it not laced with confusion about the process of receiving a pardon, a process with which I became familiar while in charge of pardons for the Hawaii Paroling Authority. The definition of a pardon, formulated some years ago with the assistance of former state Deputy Attorney General Michael Lilly, is "an act of grace which exempts the individual on whom it is bestowed, from the punishment the law inflicts for a crime the applicant has committed. It, nevertheless, does not imply innocence of the crime for which the individual is pardoned." To clarify a point made in the Star-Bulletin's Aug. 16 article on pardons: Once an inmate leaves prison on parole or serves the maximum sentence, he or she has the right to seek public office and to vote as well. A pardon is not required. "Express authorization to possess or use firearms" is granted only to those who require firearms in the course of employment, for example, police officers, prison guards and, in one case, for the security guard for former Gov. George Ariyoshi.

A. WHAT IS EXECUTIVE CLEMENCY? "Executive Clemency" refers to the constitutional power (Me. Const. Art. V, pt. 1, Section 11) given exclusively to the Governor which allows him, following a criminal conviction or juvenile adjudication, to grant a commutation of sentence or a pardon. A pardon forgives an individual for his or her crime. A commutation is a reduction in sentence for persons currently incarcerated. A commutation , which does not forgive an individual, can be granted for an entire sentence or any part thereof.

Appeals tell the court that you, do not agree with it. An appeal is a request to a higher court for the rehearing or review of your case. You can appeal against your conviction and/or your sentence. Ask staff.
  • You may appeal your case if you feel you should not have been convicted; If you feel your sentence is too long; If you were not represented by a lawyer; If you entered a plea of guilty, and did not have a lawyer; If you feel you were unfairly treated or did not understand the procedure of the court; If you were denied rights provided by the Charter of Rights and Freedoms.
You have thirty ( 30) days to let the court know you want to appeal. Tell staff right away and they will help.

The Maryland Parole Commission originated in 1914 as the Advisory Board of Parole (Chapter 500, Acts of 1914). In 1922, Board functions were assumed by the Parole Commissioner (Chapter 29, Acts of 1922). The Board of Parole and Probation succeeded the Parole Commissioner in 1939 (Chapter 406, Acts of 1939). Ongoing probe targets state Pardons and Paroles leaders

Morris News Service ATLANTA Georgia's Board of Pardons and Paroles has the final say on death penalty cases and decides when inmates are ready to go free. But for the past nine months, its two most prominent members have been on the flip side of the justice system, as investigators seek to determine whether the men used their positions to break the law. The probe, by the Georgia Bureau of Investigation and state attorney general's office, is studying whether board Chairman Walter Ray and member Bobby Whitworth received money in exchange for political favors. The pair has repeatedly denied the claims, saying they expect their names to be cleared when the open-ended investigation is complete. But that hasn't stopped election-year calls for Gov. Roy Barnes to remove Ray and Whitworth from office. ''The governor appointed those individuals and should ask for their resignation,'' said Sen. Eric Johnson, of Savannah, the Senate's Republican leader. ''Regardless of whether the criminal investigation identifies criminal wrongdoing, it is certainly a conflict of ethical interest to be making money off of your responsibilities to the state taxpayers.''

DEFINITIONS
AMNESTY - is a form of Executive Clemency which is extended to a class or group of persons, usually persons who have all committed the same crime. It is extended without regard to the special circumstances of individual cases. Traditionally amnesties have been granted to restore social peace after a period of political upheaval. APPLICATION FORM BOARD OF PAROLE - is the Alaska Board of Parole. The Governor may refer applications for executive clemency to the Board of Parole. The Board through its staff investigates each case and submits to the Executive Clemency Advisory Committee and the Governor a report of the investigation, together with all other information the Board has regarding the applicant. When the report or investigation is completed, the Board also transmits to the Executive Clemency Advisory Committee and the Governor the comments it has received from the victim. COMMENTS REGARDING THE CLEMENCY APPLICATION COMMUTATION OF SENTENCE - is a reduction or lessening of the original sentence. Usually it takes the form of a reduction in the length of imprisonment. A commutation may be granted conditionally.

GENERAL INFORMATION LISTING OF CURRENT PROJECTS/ACTIVITIES

I. Programming and Data Repository for the Statewide Judicial Information System (SJIS)
The Alabama Judicial Data Center (AJDC) is the central repository for all programs dealing with the information management of the Trial Courts. Current systems include support processing for all case jurisdictions: Traffic (TR), District Criminal (DC), Circuit Criminal (CC), Juvenile (JU), Small Claims (SM), District Civil (DV), Circuit Civil (CV), Domestic Relations (DR), and Child Support (CS). Within these systems are functions that allow for case initiation, docketing and noticing, case management, accounting, required reports, ad hoc reports and forms production. These systems are extensively used in all Trial Courts in the State of Alabama. In addition to the "case based" functions, the SJIS systems support witness subpoenas, jury selection, management and payment, warrant production and court order enforcement.
The systems are designed around an integrated concept. For example, data is not entered repetitively in criminal case activities. The original warrant is "rolled" into the District Criminal case, into the Grand Jury record, and, finally, into the Circuit Criminal case. Likewise, accounting functions, docketing, etc., are "spin offs" of the original case.
Currently, the systems in use support some 4000+ users in 123 remote locations throughout Alabama. On an average day the main system processes some 700,000 requests for the equivalent of a user hitting the ENTER key some 972 times per second over the 12 hour day that the system is in use. There are some 900 gigabytes of data currently stored on the main storage devices.
