Johannesburg Government has agreed with telecoms regulator Icasa that neither of the two bidders for the 51% strategic equity stake in the second national operator (SNO), Optis Telecommunications nor Goldleaf Trading, is eligible for the award. But, it has decided not to accept Icasa's other proposal - that a temporary licence be granted to the three existing players. Rather, says Minister Ivy Matsepe-Casaburri, government will review and draw up an entirely new process; an exercise that could take up to three months to complete.

Origin and Mandate
    During the negotiations that led to South Africa's first elections on the basis of universal suffrage in April 1994 and the transition from a minority regime to a democratically elected government, much emphasis was placed on the need for new constitutional arrangements to ensure that the appalling human rights abuses of South Africa's past could not be repeated. The interim constitution, which was adopted in December 1993 and came into force following the elections, accordingly provided for the establishment of a range of bodies to monitor government compliance with human rights standards, including a national human rights commission. Legislation was drafted once the new government of national unity led by the African National Congress (ANC) took office, and President Nelson Mandela signed the Human Rights Commission Act, No. 54 of 1994, into law on November 24, 1994. The act came into force in September 1995 and the commission held its inaugural meeting in October 1995.
Chapter 9 of the final constitution, which was drafted by the parliament elected in 1994 sitting as a constitutional assembly and came into force in February 1997, confirmed the position of the South African Human Rights Commission (SAHRC) as one of the "state institutions supporting constitutional democracy," along with the Commission on Gender Equality, the Public Protector, the Auditor-General, the Electoral Commission, the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Minorities, and the Independent Authority to Regulate Broadcasting.

    In December 1996, the SAHRC released a business plan for the period 1996 to 2000. The plan set five goals for the commission:
167. provide information, education and training on human rights;
168. address violations of human rights; 169. establish a comprehensive research and documentation center; 170. establish the SAHRC as a national resource and focal point for human rights advocacy; and 171. establish and maintain an effective and efficient administration. At the beginning of 1998, described as "a momentous year, in which we moved from constructing a vision and setting up structures to fine-tuning the implementation of programmes," the commission set its priority programs: developing a national action plan on human rights; equality; socio-economic rights; and the administration of justice. The commission has made interventions at various levels: high level advocacy with government to affect policy or legislation; human rights education and training of the public and government officials; hearings and investigations into situations of rights abuse; and individual investigations.
    The SAHRC was the lead institution behind the drafting and adoption of the National Action Plan for the Promotion and Protection of Human Rights, working closely with the Department of Justice.

INTRODUCTION
As far back as 1989, the authors of Uprooting poverty in South Africa; report of the second Carnegie inquiry into poverty and development in South Africa predicted that corruption would loom large in a new South Africa. Noting the high degree of corruption bred by apartheid, they argued that even were a democratic government to gain power, the old clerks would not necessarily learn new habits.
Their prediction was uncannily accurate. Since the transition, corruption has burgeoned in both the public and private sectors; besides violent crime, it is probably the factor which most preoccupies those who express concern about South Africa's future. Analysts have warned that corruption is the single biggest threat to the Reconstruction and Development Programme, and the establishment of a human rights culture.
This monograph, then, examines the way in which government corruption affects the poor. Because this topic spans such a vast area, only one field, social security, is examined in depth. This area was chosen because:

I don't know that this is true, and indeed, the only press release I have seen from the South Africa government (and my own conversations with SA officials), says the contrary. Both sides have filed briefs before the Court, but the industry has made clear its preference for a negotiated, mutually acceptable solution to the dispute. In June 1999, South Africa held its second free national elections, as a result of which a new Cabinet was appointed. Via the SA PMA, the industry immediately made overtures to the new Government, for the purpose of reaching a mutually acceptable solution to the dispute over the Medicines Act. Johannesburg South Africa's government is to appeal for a second time against a court ruling saying it must provide a key anti-AIDS drug that cuts the risk of mother-to-child infection, the health minister said on Wednesday. The latest legal twist drew fresh condemnation from anti-AIDS campaigners, who accuse the government of deliberately hampering efforts to fight AIDS in South Africa the country with the biggest number of people infected in the world. Nevirapine has been shown to cut by up to 50 percent the risk that pregnant women will pass the deadly virus to their babies, but the government has so far prohibited its use beyond a pilot programme, saying it is expensive and toxic. "Our legal representatives are today filing papers with the Constitutional Court..." said minister Manto Tshabalala-Msimang. "We have also indicated that the matter should be treated as a matter of urgency," she said in a statement. The government had already appealed to the Constitutional Court against a December ruling by the Pretoria High Court saying it had a constitutional duty to widen access to Nevirapine.

Johannesburg South Africa's government said on Wednesday it would appeal a high court ruling that HIV-positive pregnant women are entitled to a drug found to reduce a newborn's risk of contracting the virus. "We have instructed our legal counsel to appeal the judgment to the Constitutional Court on this matter," Minister of Health Manto Tshabalala-Msimang said in a statement. The plan to appeal provoked an outcry from AIDS activists and child health workers, who argue that President Thabo Mbeki's government has acted too slowly to fight mother-to-child transmission of HIV, which causes AIDS. "This will result in further unnecessary infections," AIDS activist group Treatment Action Campaign (TAC) spokesman Nathan Geffen told Reuters. The South African Council of Churches urged the government to get the drug where it was needed and the white-led opposition Democratic Alliance (DA) called the government's move madness. "It equals a death sentence for thousands of babies that could otherwise be saved... Once again, they are fiddling while Rome burns," DA leader Tony Leon said.

As part of a plan to restructure higher education in South Africa, the Department of Education plans to merge Unisa, with two other distance learning institutions, Technikon Southern Africa (TSA) and the distance learning-centre of Vista University. While the majority of the students the three serve are South African, they all have learners registered across Southern Africa and the rest of the continent. With just under 112 000 students, Unisa is one of the biggest distance learning institutions in the world. While the bulk of these students are in South Africa, there are over 6000 in Southern Africa and the rest of the continent - and another 2 500 across the world.
