The DePaul University College of Law has provided us, its students, with the unique opportunity to produce an on-line sports law journal. This journal debuted in October of 2001. Official publication of the journal occurs on CD-ROM rather than in print and consists solely of writing from this website. Many of our articles focus on hot topics in professional sports. Most recently, these include Antitrust Concerns in the New Era of Televised Sports (which focuses on team-owned television networks, NFL Sunday Ticket, and NBA League Pass) and The Exclusion of Women from Augusta National. Our Case Notes include the analysis of court decisions ranging from Major League Soccer and NCAA Basketball to marathon running and high school girl's basketball. Our Comments include the dispute over Barry Bonds' Home Run Ball and Jeremy Bloom's fight to earn sponsorship dollars as a skier while playing football for the University of Colorado. This season, industry professionals have continued to visit the law school as part of our Symposium Series. These professionals included one of the owners of the Chicago Cubs, an Executive Vice President for the NFL's Detroit Lions, an in-house counsel for the Chicago White Sox, and sports agents from the NBA and NFL. These professionals have proven invaluable to the journal's success.

ESPN's Peter Gammons to Address HLS Sports Law Conference
April 4, 2002 9:45 a.m. The Boston Globe and ESPN commentator, will give the keynote address. The conference will examine topics ranging from legal issues in player-agent-management relationships to regulatory issues in boxing. In addition to Gammons, panelists will include Boston Celtics General Manager Chris Wallace, NFL agent Drew Rosenhaus, and Richard Berthelsen, general counsel of the NFL Players Association. Harvard Law School Professor Paul Weiler will give the opening remarks and moderate one of the panel discussions. The event which begins at 1:30 p.m. in the Langdell South classroom, is free and open to the public. Additional Resources:

    The World of Sports and Entertainment Law
    Harvard Law Professor Paul Weiler discusses sports and entertainment law, athletes as role models, and Harvard Law School's role in the history of American football. Is there a difference between sports law and entertainment law? Aren’t sports just a form of entertainment? It seems that athletes are criticized for not being good role models, but actors are not. It’s true. People hardly cared that Robert Downey had been arrested and convicted so many times for drug use. No one would ever have dreamed of saying we need a commissioner of television to take Downey out of Ally McBeal. And yet, the immediate reaction as soon as an athlete is found to be in possession of even our least dangerous substance, marijuana, is that he or she is immediately suspended. I think that’s because athletes by comparison really are judged as role models. When we watch Robert Downey, for example, or listen to musicians, we’re actually caught up in the work, not in the particular individual. Whereas when we watch Michael Jordan or Tiger Woods, we are caught up in that individual, not just in the sport. Athletes make the vast majority of the money earned from the publicity rights market. Mel Gibson or Tom Hanks or Julia Roberts make $20 million to $25 million as the basic fee for just one of their movies—far more than the full-season salary of most athletes. But actors make just a tiny, tiny fraction of the $50 million or so a year that Tiger or Michael makes off the golf course or basketball court. The big companies sign up such star athletes because they know if Tiger or Michael is identified with their product, it’s going to enhance the likelihood that the consumer will buy it. So if the athletes are making so much money by selling their identity as something that really influences people’s behavior, then they cannot really say, “Well it’s unfair to be disciplining us if the kind of behavior we’re influencing is very illegal behavior.”

PREVIOUS EVENTS 2002 - 2003 March 27, 2003 Committee Meeting The Fine Art of Art Law This meeting focused on current legal and business issues in the fine art world. Topics included current issues involved in artist/gallery contracts, nonprofits, and the donation of fine art to nonprofits. Speakers: Jim McDonald is Executive Director of The Art Connection, a nonprofit that facilitates the donation of original works of art to qualifying nonprofit organizations. Jim holds an MFA degree in Arts Administration from the University of Iowa, and both an MA and BA in music performance. He currently hosts music events at the Harvard Musical Association on Beacon Hill.
