Pennsylvania's vast state forests, game lands, state parks and streams, lakes and rivers are about to be managed with a closer emphasis on biodiversity. Biodiversity? That new buzzword that became a four-letter word to many a couple years ago when the United Nations uncorked a sweeping worldwide Biodiversity Treaty? Yep. The Fish and Boat Commission recently adopted a Biodiversity Vision Statement. So did the Department of Conservation and Natural Resources, which controls state forests and parks. The staff of the Game Commission is recommending approval. A vote may come in April. The state's land and water managers promise to share information and work jointly to promote a greater variety of plants and animals and protect their homes. The word, biodiversity, has been misinterpreted by many people and has become unnecessarily inflammatory, says Mike Schmit, the Game Commission's deputy executive director. "There will be no dramatic change at all," he says. "We're simply recognizing that in future decisions we'll be aware of the important interactions that are necessary in all components of the outdoors."

It is the policy of the Fish and Game Commission to: Conserve, restore, maintain and utilize California's wild deer populations. Such conservation shall be in accordance with the principles of conservation of wildlife resources set forth in Section 1801 of the Fish and Game Code and in accordance with the objectives and elements stated in "A Plan for California Deer, 1976". Management Program: I. The Department shall designate deer herd management units. Such units may encompass a single deer herd or group of deer herds having similar management and habitat requirements and characteristics. Boundaries of such units, unless appropriate, need not follow county boundary lines. II. The Department shall develop and submit plans for all deer herd management units to the Commission by December 1, 1985. The goals of such plans shall be the restoration and maintenance of critical deer habitats to perpetuate healthy deer herds in the wild state as set forth in the appropriate deer herd management plans and to provide for high quality and diversified use of deer as a renewable resource in California. Specific objectives shall be stated in each management plan designed to achieve these goals, including objectives relating to the long-term protection of critical seasonal habitat located on both privately owned and public lands. Such objectives shall be the standards for determining if land use plans (including general plans reviewed pursuant to the Commission's Land Use Policy), proposed development projects and other agencies' plans and programs adequately address deer needs.

Ross, Executive Director Pennsylvania Game Commission 2001 Elmerton Avenue Harrisburg, PA 17110-9797 Dear Mr. Ross: At your request, we have reviewed General Assembly of Pennsylvania House Bill 2181 and its potential impacts on how the Pennsylvania Game Commission manages State Game Lands. Our opinion is that this proposed regulation, if adopted, would result in the Game Commission losing control of its capital assets which would be a violation of the “Administrative Requirements, Federal Aid in Fish and Wildlife Restoration Acts” 50 CFR 80.4, Diversion of license fees, and perhaps 50 CFR 80.14 Application of Federal Aid funds. In order for States to participate in the Federal Aid in Sport Fish and Wildlife Restoration Programs, they must have laws (Assent Legislation) that require license fees paid by hunters and fishermen to serve purposes that directly relate to the administration of the State fish and wildlife agency. Our regulations (50 CFR 80.1) also define the State fish and wildlife agency as that agency or official of a State designated under State law or regulation to carry out the laws of the State in relation to the management of the State’s fish and wildlife resources. House Bill 2181 has several problems. First, it would impose undue restrictions on the Pennsylvania Game Commission in carrying out their responsibilities to administer wildlife programs. Some of our activities include: being an adopter, making sure the trail is kept in order to help work and negotiate with landowners for their permission for the trail to pass, recruiting new members, planning hikes and events, promoting the chapter through public publicity and building new trail, our chapter has it all. We're always looking for volunteers. When volunteers working on the trail, reporting their hours reach the 100 or the 400 hour mark they receive special gifts of gratitude from our national office and the National Park Service. These hours also helps us show our volunteerism and helps us get grants.
