    In 1990, when the last state plan for the education of gifted students was adopted by the Texas State Board of Education, the mandate to identify and serve these students had just been implemented. That plan was designed to provide program guidance and to assure that all students had the opportunity to be fairly and accurately assessed for advanced level services. This new Texas state plan, adopted by the State Board of Education in November 1996, builds on that effort and takes districts and campuses to the next level of program implementation: refining existing services and creating additional curricular options that lead to exceptionally high levels of student performance.     APPLICABILITY: TOTAL UNIVERSITY Section I . Applicability of Criminal Laws All the general and criminal laws of the State are declared to be in full force and effect within the area under the control and jurisdiction of the University of North Texas. Penalties for violations of these laws are specified in the Texas Penal Code and other criminal codes. Section II . Rules and Regulations: Penalty The University of North Texas Board of Regents promulgates rules and regulations for the safety and welfare of students, employees, and property, and other rules and regulations it may deem necessary to carry out the provisions of Chapter 51, subchapter E, Texas Education Code and the governance of the University. (a) A person who violates any provision of this subchapter, or any rule or regulation promulgated under the authority of this subchapter is guilty of a misdemeanor and on conviction is punishable by a fine of not more than $200. Section III . Courts Having Jurisdiction The judge of a municipal court or any justice of the peace of any city or county where property under the control and jurisdiction of a state institution of higher education is located is each separately vested with all jurisdiction necessary to hear and determine criminal cases involving violations of provisions of Chapter 51, subchapter E, Texas Education Code or rules or regulations promulgated under this chapter of the code for which the punishment does not exceed a fine of $200.

    Rules and Regulations
    The Texas State Approving Agency (SAA) operates under contract with the U.S. Department of Veterans Affairs (USDVA). As such, the SAA has its foundation in federal law, Title 38 United States Code (USC). We, however, operate as part of the government of the state of Texas, and maintain the state's authority to approve or disapprove veterans' education and training programs. We also serve to prevent abuses and promote equality in veterans' education by evaluating and monitoring education and training programs. The Code of Federal Regulations [38 CFR 21.4151(b)] summarizes the SAA responsibilities under the law:
    • to inspect and supervise schools and training establishments within Texas, to determine those programs of education and training which may be approved for veterans and other eligible persons, to determine whether a school or training establishment at all times complies with established standards relating to the approved programs, and to render services and obtain information necessary for the DVA to approve or disapprove programs offered by any agency or instrumentality of the federal government within Texas.
