The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

March 15, 1999 "Back to Basics in Education" Weekly Column One of my top priorities this Congress is to help schools have the proper tools to provide our students with a challenging and enriching education. This week I supported, and the House passed, much-needed relief for our schools and improved the opportunity for the academic achievement of our students with the passage of the Education Flexibility Partnership Act of 1999. While I am home in Texas, I spend a great deal of time listening to teachers, administrators, students and parents about their education needs. What I hear time and again is that the federal government is too intrusive and too stringent on local school matters. Time- consuming regulations often hinder a school's ability to provide students with effective opportunities, and the schools face administrative burdens in completing applications for federal assistance and documenting their needs for funds. Some requirements will always be needed, but many times, the paperwork is simply excessive. Schools spend more time filling out paperwork and less time devoted to our children's educational development. Too often, federal policies don't recognize that every state, school district and local school in America is different. The most effective policies have proven to be those flexible enough to allow states and schools to mold federal assistance to meet their individual needs.

    Appendix A. Residency Regulations
    Under state statutes and Coordinating Board rules and regulations interpreting those statutes, a student or prospective student is classified as a resident of Texas, a nonresident, or a foreign student. A person who has lived in the state under circumstances specified in these rules is eligible for classification as a resident. A citizen, a national, or a permanent resident of the United States who does not meet resident criteria is classified a nonresident. An alien who is not a permanent resident of the United States and has not been permitted by Congress to adopt the United States as domicile while in this country is classified as a foreign student. An individual classified as a nonresident or foreign student may qualify, under certain exceptions specified in these rules, for resident tuition rates and other charges while continuing to be classified as a nonresident or a foreign student.     UIL publishes this document to provide member schools notice of Texas Education Agency regulations which relate to UIL and all other extracurricular activities sponsored or sanctioned by the school district. Texas Education Agency staff does not answer questions for UIL activities concerning the issues set forth in this document. That authority was delegated to the UIL by the commissioner of education effective June 1, 1994. This document provides explanations and interpretations of SBOE rules, UIL Constitution and Contest Rules, and statute. There are numerous interpretations of statue and rules that are continually under review. In some instances, further review of an issue possibly due to additional information or unusual circumstances may result in a modified response, depending on the individual case. Bold print denotes new language. Local district officials may impose stricter standards than those cited in rule or statute, but shall not impose more lenient standards.
    DISTRIBUTION OF THIS DOCUMENT
    This material should be made available to elementary, middle school and junior high school principals, to counselors, UIL academic coordinators and sponsors/coaches, directors of UIL music activities and one-act play, and athletic administrators, coaches, and others who sponsor extracurricular activities.
