If You Can't Beat 'Em, Ban 'Em
Like prisoners, army recruits, the mentally ill, and foreigners, children don't have the same rights that most American adults do. The abridgers of those rights take many formsparents, state, religious moralists, club ownersbut perhaps nowhere is kids' freedom more heatedly contested than in public schools... Got a problem in school? Try banning something. Lots of things are banned, and for lots of different reasons. Usually these reasons aren't very good. One could conceive of a ban to improve communication and learning, in which case corporate promotions, moral evangelicals, and guns would be banned. There aren't too many cases like that, though. In Pikeville, Kentucky, Karla Chapman, 13, is sent home from school for wearing black lipstick. She returns to school wearing a better-looking shade of purple, is sent home and suspended. Karla responds by attempting suicide and, upon failing, returns clean-lipped in hopes of transferring to a nearby school that doesn't prohibit black lipstick. (Associated Press 1/14/97)
School District 202 in Plainfield, Illinois, joins other school districts across the nation in banning "look-alike drugs": candy cigarettes, fake chewing tobacco, non-alcoholic beer, and oregano. Various reasons are cited for the ban, one being that candy cigarettes can possibly lead to real cigarette use, that they send an inappropriate presmoking message. Secondly, that the prevalence of fake drugs makes it difficult for school administrators to find the real ones. And that the use of certain substitutes such as mint-flavored herbal snuff increase the chance that users may be considered "yuppies." (

Accreditation is important as a way of validating a given school, or department within a school; it proves the organisation has been thoroughly investigated by a group of impartial experts and found worthy of approval. Accrediting agencies will investigate the mission statement of the organisation, require proof that the school is living up to its mission goals, met its academic standards, and also look into the financial standing of the academic institution. In most other nations, colleges and universities are chartered by their national or provincial governments. Eg., the UK the Open and Distance Learning Quality Council assesses distance learning programs. But the bad news is that investigating accreditation of US schools can be really confusing, like opening a can of worms. There are many different accrediting agencies. Also beware that many "unaccredited" US schools call themselves accredited in their prospectuses and websites.. You really need to understand what the recognised accrediting agencies are. For example, the Department of Education does not accredit any school or institution, it merely "licenses" it or approves it as fulfilling certain legal requirements in order to exist at all, ranging from incorporation to certification or other state approval. Many schools which call themselves accredited private schools are in fact "licensed" schools.

With a massive revenue shortfall and a funding crisis in education, now is not the time for Utah leaders to fixate on school choice, whether through tuition tax credits or by expanding the state's charter schools program.
The Employer's Education Coalition has recommended a package of improvements for public education, including two school choice components tuition tax credits and additional charter schools. Republican legislative leadership has embraced the coalition's report and plans are in the works to offer a bill this session adopting its many provisions. Several of the coalition's ideas could be implemented with limited fiscal impact on the state's schools. The same cannot be said for the school choice options.
Gov. Mike Leavitt is similarly supportive of the coalition's work, though he is more reticent about tax credits. Leavitt proposes expanding school choice by adding public charter schools, equalizing their funding and creating a revolving loan for charter building projects.
Charter schools are public schools open to all students, regardless of geography. Sponsors of a charter school apply for a charter from the local school district. If they are turned down, they may apply for one of the State Board of Education's 16 charters. The schools face fewer state rules and regulations, enabling them to limit class sizes and focus on specialized fields or alternative general education methods. The state's 11 operating charter schools enroll about 1,500 students.

Utah Office of Energy Services programs are designed to assist all sectors of Utah's economy achieve energy-cost savings and improve our environment. ACCOMPLISHMENTS FOR FY 98 Public Building Energy Financing Program - During FY98 the Public Building Energy Financing Program completed 24 federally-funded energy efficiency projects with Utah school districts, higher education facilities and hospitals. Projects included upgrades to lighting systems, controls and boilers. Nine new contracts were also issued to local governments for energy efficient upgrades on historic buildings, with an additional 29 projects currently being processed. Administration of $1.5 million in loans continues with 16 other public institutions. As federal and state funding for building retrofits becomes more scarce, the Office of Energy Services continues to market and facilitate partnerships between public institutions and private energy service companies, such as one on the University of Utah campus that will leverage between $16 and $18 million in private funding. The return on investments in public building energy efficiency averages a 4 to 5 year simple payback. The Utah Clean Fuels Loan Program promotes the transition to cleaner-burning transportation fuels to help improve Utah's air quality and reduce reliance on foreign oil. Zero-interest loans are available for public fleet operators and low-interest loans are available for private businesses to convert vehicles to cleaner-burning fuels, to purchase vehicles manufactured to operate on cleaner burning fuel and to install fueling facilities. Over $2.3 million is available. A total of $475,000 in loans have been issued to convert more than 85 vehicles and install refueling facilities.

Charter Schools: A State
Legislative Update*
Charter School Legislation. Charter schools are a growing phenomenon in American education. The first charter school law was passed in Minnesota in 1991; the second, by California in 1992. By June 1998, 33 states and the District of Columbia had passed charter school legislation. (See Figures 1 and 2.) Four of these states (Idaho, Missouri, Virginia and Utah) passed charter school laws during the 1997-98 legislative session. Puerto Rico also has charter school legislation. The purpose of this legislative update is to provide information on the four states that enacted charter school laws during the 1998 legislative session, as well as to provide information on legislative changes occurring in other states with charter school legislation. The report updates information in A National Study of Charter Schools (1998), which provides details on charter school legislation passed through the 1997 legislative session.
