Brown Professor of Law The time has come for a serious and comprehensive public debate on these and many other questions related to the future roles and objectives of higher education in Utah and how best to achieve those roles and objectives. The tendency to ignore the problems of higher education because of other pressing demands upon state government like postponed infrastructure needs, can only insure the continued unplanned growth of the present system and the decline of what has been a premier research university, the University of Utah. The ultimate question may soon be not who is the "boss" of higher education, but is there anything left worth bossing? John J. Flynn is the Hugh B. Brown Professor of Law at the University of Utah College of Law, where he has taught since 1963. He has often provided advice and legal counsel for University administrators and state officials.     However, even though USBA correctly identified that a significant portion of education costs are variable, USBA arrived at the wrong conclusion regarding the impact of tuition tax credits. USBA mistakenly compares the variable cost per student with the revenue each district receives for each student. To determine the actual savings, the appropriate comparison is the variable cost per student and the amount of the tuition tax credit. If the variable cost is higher than tuition tax credit amount, then the available per student funding increases even though the aggregate spending decreases.
    Tax credit opponents have claimed that students using a tuition tax credit must all come from the same neighborhood so that a school can be closed. However, the USBA analysis refutes this claim, noting that instructional costs are variable which means that fewer instruction personnel are needed as enrollment declines.

    • LIFT YOUR CAP: While we've barely finished a quarter of 2003, this state has already wrapped up its legislative action, with good news for charter fans. On the last day of the session, lawmakers approved a bill that will modestly raise the charter school cap and will also provide $1.5 million for a revolving facilities loan fund. The bill raises the number of charters that the state board can approve from 16 to 24 in 2003-04 with an additional eight in each subsequent year. CER Newswire March 11, 2003
