The nonpartisan Urban Institute publishes studies, reports, and books on timely topics worthy of public consideration. The views expressed are those of the authors and should not be attributed to the Urban Institute, its trustees, or its funders. INTRODUCTION No one likes the current welfare system. Governors complain that federal law is overly prescriptive and are willing to take less federal money in return for more flexibility. The public believes that welfare is anti-work and anti-family although polls show that the public wants welfare reformed in ways that do not penalize children. Welfare recipients find dealing with the system degrading and demoralizing; most would prefer to work . Experts note that welfare has done little to stem the growth of poverty among children. In all but two states, welfare benefits (including food stamps) are insufficient to move a family above the poverty line In short, the current indictment against the welfare system has four particulars:

Impact of the Welfare Reform Legislation on Legal Immigrants with Disabilities
June 23, 1997 It is the statutory mandate of the National Council on Disability to advise the Congress and the President when the laws and policies of the United States adversely affect the well-being and progress of individuals with disabilities. The National Council on Disability therefore must convey its serious concern, and that of the members of this community, at the economic, physical and emotional injury that the 1996 welfare reform legislation will inflict, in fact has already inflicted, on certain members of the community, legal immigrants with disabilities. The welfare law's toll on the community of persons with disabilities has already been enormous. Letters mailed earlier this year by the Social Security Administration ("SSA"), warning legal immigrants of the U.S. Government's plans to terminate their benefits this summer, created such dismay and panic in the community that disability advocates fear a rash of suicides as the deadline for termination of benefits approaches. The bipartisan budget accord reached last May purported to restore certain benefits to legal immigrants who arrived in the country before August 23, 1996. However, the budget accord did not go far enough in restoring benefits desperately needed by individuals with disabilities. Moreover, recent Congressional proposals to implement the budget accord have stripped certain of the benefits that were restored to individuals with disabilities by the budget accord, despite new official estimates that sufficient funding could be made available within the budgetary limits established by the accord to restore all such benefits to persons with disabilities and to restore benefits to aging legal immigrants as well.

HHS TO HOLD NATIONAL FORUMS WITH STATE LEADERS, RECIPIENTS AS EARLY STEP TOWARD WELFARE REFORM REAUTHORIZATION HHS Secretary Tommy G. Thompson today announced a series of national "listening and discussion sessions" to gather insights from those on the front lines of welfare reform to prepare for next year's reauthorization of federal welfare reform legislation. The nation's governors, state legislators, county officials, welfare program directors and welfare recipients will be invited to discuss ways to strengthen the Temporary Assistance for Needy Families (TANF) program, which was created by the welfare reform legislation enacted in 1996. The sessions will allow Secretary Thompson and other top HHS officials to learn more about states' experiences implementing welfare reforms and running assistance programs. "Welfare reform has been a remarkable success story, resulting in historic reductions in welfare dependency and child poverty, and dramatic gains in employment especially among single mothers. Yet, welfare reform has only just begun," Secretary Thompson said. "We must now build on the lessons of the past five years to help more families become self-sufficient in the future."

Rep. Howard P. “Buck” McKeon (R-CA), chairman of a House subcommittee with jurisdiction over federal welfare programs, today formally introduced the Working Toward Independence Act (H.R. 4092), which reauthorizes the 1996 welfare reform law. The bill, based on President George W. Bush’s welfare reform proposal, would strengthen work requirements under the Temporary Assistance for Needy Families (TANF) program and make necessary improvements to the Child Care and Development Block Grant (CCDBG) program. “The 1996 welfare reform has been a dramatic success, but a majority of welfare recipients today are still not working for their benefits,” McKeon said. “The bill I’ve introduced marks the second phase of welfare reform. It will put even more Americans on the path to self-sufficiency.” “The only way for welfare families to become self-reliant is through productive work,” McKeon noted. “But we also recognize that states need the flexibility to ensure that welfare recipients can pursue higher education and training to improve their job skills.”

Senate Committee Passes State-Friendly Welfare Reform Legislation
Click here for a printer friendly version of this information alert (Adobe Acrobat required) June 26, 2002 On June 26 th , by a vote of 13 to 8, the Senate Finance Committee passed the "Work, Opportunity, and Responsibility for Kids (WORK) Act of 2002," a welfare reform reauthorization bill that differs from and improves on the House-passed legislation, H.R. 4737. Many provisions sought by NCSL are in the Work bill. Three Republicans joined all Democrats but one in voting for passage. The bill proposed by the Chairman, Senator Baucus (D-Montana) resembles the "tripartisan" proposal put forward by Senators Breaux (D-Louisiana), Hatch (R-Utah), Lincoln (D-Arkansas), Jeffords (I-Vermont), Snowe (R-Maine) and Rockefeller (D-West Virginia), who all voted for final passage. A third Republican Senator, Senator Murkowski of Alaska, also voted for the measure. Senator Daschle (D-South Dakota), the Senator Majority Leader, differed from his fellow Democrats and voted against final passage. In a statement, Senator Daschle, citing state budget woes, indicated his concern that the bill contains insufficient child care funding. He stated "My vote on this mark does not diminish my commitment to getting this bill including strong child care provisions enacted this year." Both the House bill and a Senate version of the House bill (S 2648) were scheduled to be offered by Senator Nickles (R-Oklahoma) and Senator Lott (R-Mississippi), respectively, but were not offered during committee consideration. The Ranking Member, Senator Grassley (R- Iowa), voted against the bill while expressing his hope that issues of disagreement could be worked out before Senate floor action.

Friedman Largely unnoticed by the press and general public is a small provision in the 1996 federal welfare reform legislation that almost everyone can agree is constructive. Under provisions of the act, a state may use part of the block grant money "to carry out a program to fund individual development accounts" or IDAs. IDAs are savings accounts with matched deposits to enable poor families to save for important life goals such as education, home ownership and self-employment. This is a fundamental policy change. Up to now, the welfare poor have been prohibited from saving by "asset limits." The maximum saving in most states has been $1,000, a restriction that has been enormously counter-productive. (In contrast, public policy encourages asset accumulation for the middle class, particularly in home equity and retirement pensions, where federal tax benefits now total more than $200 billion per year.) With the introduction of IDAs, the poor will be able to save for their
futures like everyone else.

ecent federal welfare reform legislation and proposed state welfare reforms may cause more harm than good, having dramatic effects on families with children as well as on childless adults in New York, according to a study issued recently by the New York City Social Indicators Survey Center at Columbia's School of Social Work. The study was conducted by Jane Waldfogel, assistant professor; Irwin Garfinkel, Mitchel Ginsberg Professor of Contemporary Urban Problems, and researcher Patrick Villeneuve. Assuming that about 40 percent of those leaving welfare will be able to find work and that the state and city will cover child care costs for these families, the report says that five years from now, when federal reforms are in place, the legislation will:
  • impoverish more than 500,000 residents of New York City: 100,000 will move into poverty and more than 400,000 who are already poor will move deeper into poverty;

Home Page Six Years After Welfare Reform, Public Opposition to Welfare Spending Declines By James Devitt When the U.S. Congress passed landmark welfare reform legislation in 1996, elected officials had the support of the public to back them. Six years later, Congress is debating whether to reauthorize the legislation, officially titled Temporary Assistance to Need Families (TANF). However, Americans have become less opposed to welfare benefits since the law was first enacted, according to an analysis by Columbia Political Science Department Chair Robert Shapiro and Greg Shaw, Ph.D. '98, a professor at Illinois Wesleyan University. The research was conducted at Columbia's Institute for Social and Economic Research and Policy (ISERP), an interdisciplinary research organization for the social sciences and public policy. Analyzing poll results from several sources, including Gallup, the New York Times/CBS News and the Wall Street Journal/NBC, Shapiro and Shaw noted that in December 1994 57 percent of respondents thought that "most people who receive money from welfare could get along without it if they tried." But by January 2001 this percentage had slipped to 44 percent. Conversely, in December 1994 only 36 percent of respondents felt recipients "really need this help," but by January 2001, 47 percent held this view. Shapiro and Shaw also note that according to a survey by the National Election Studies that between 1996 and 2000, the percentage of Americans in favor of cutting federal spending on food stamps fell from 45 percent to 30 percent.

September 17, 1996 Good morning Mr. Chairman and members of the Committee. As the Commissioner of the Administration on Children, Youth and Families in the Department of Health and Human Services, I am pleased to appear before you today to provide an overview of the Department's implementation of the new welfare reform legislationthe Personal Responsibility and Work Opportunity Reconciliation Act of 1996. The Administration for Children and Families is responsible for administering several of the programs most affected by this historic legislation, including: the new temporary assistance program for needy families; the child care programs for families on welfare and other low-income working families; and the child support enforcement program. In my testimony today, I will spend much of my time addressing implementation of the Temporary Assistance for Needy Families (TANF) program, as requested by the Committee. I would like to also briefly discuss the new child care provisions and will defer discussion of the child support enforcement provisions until Thursday when you will be devoting an entire hearing to that topic. Since the legislation was signed by the President only 26 days ago, I want to focus most on the process we have undertaken to facilitate implementation. Because of the bill's early effective dates and the extraordinary interest throughout the country in moving forward on welfare reform, officials at all levels of government are very busy. At the federal level, officials from the numerous departments affected by this legislation are working together to ensure coordinated assistance to the states.

In my testimony today, I will spend much of my time addressing implementation of the Temporary Assistance for Needy Families (TANF) program, as requested by the Committee. I would like to also briefly discuss the new child care provisions and will defer discussion of the child support enforcement provisions until Thursday when you will be devoting an entire hearing to that topic. Since the legislation was signed by the President only 26 days ago, I want to focus most on the process we have undertaken to facilitate implementation. Because of the bill's early effective dates and the extraordinary interest throughout the country in moving forward on welfare reform, officials at all levels of government are very busy. At the federal level, officials from the numerous departments affected by this legislation are working together to ensure coordinated assistance to the states.

on Responsible Welfare Reform Legislation
The House-passed welfare reform bill makes a mockery of the critical need to lift families out of poverty, which should be a central part of responsible welfare reform. It also puts at risk the jobs of experienced public employees who are on the frontline providing services to the residents of our cities and states. Under the recently passed bill, welfare recipients will be expected to work longer hours, but no provision is made for childcare and no opportunity is provided for educational training – the real avenue out of poverty. The bill’s funding is woefully inadequate, particularly with the increased need for support with the added work requirement. The House legislation would allow governors to shift billions of dollars away from the people whom Congress intended to receive the funds. It provides little oversight of many critical programs, offering instead a glaring lack of accountability. The Senate has the opportunity to do better and should pass responsible legislation that will protect welfare recipients with adequate supports, get people off the welfare rolls and into good jobs, and not jeopardize the jobs of thousands of qualified and dedicated public employees.
